57 relating to the criteria for review by the Sunset Advisory
68 Commission of an agency that licenses an occupation.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 325.0115, Government Code, is amended by
911 adding Subsections (c) and (d) to read as follows:
1012 (c) As part of the commission's review of an agency that
1113 licenses an occupation or profession, the commission and its staff
1214 shall determine whether the governing body of the agency being
1315 reviewed has made an evaluation regarding the type of personal
1416 information of license holders that the agency should make
1517 available on the agency's Internet website based on the following
1618 factors:
1719 (1) the type of information the public needs to file a
1820 complaint with the agency;
1921 (2) the type of information the public needs to locate
2022 an existing or potential service provider;
2123 (3) the type of information the public needs to verify
2224 a license; and
2325 (4) whether making the information available on the
2426 agency's Internet website could subject a license holder to
2527 harassment, solicitation, or other nuisance.
2628 (d) If the commission determines that the governing body of
2729 an agency has not completed the evaluation described by Subsection
2830 (c), the commission shall make a recommendation that the governing
2931 body of the agency perform such an evaluation.
3032 SECTION 2. This Act takes effect September 1, 2019.
