411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to certain deceptive trade practices by interactive
714 computer services.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. This Act may be cited as the Social Media
1017 Deceptive Trade Practices Act.
1118 SECTION 2. Chapter 17, Business & Commerce Code, is amended
1219 by adding Subchapter M to read as follows:
1320 SUBCHAPTER M. DISCOURSE ON INTERACTIVE WEB-BASED PLATFORMS
1421 Sec. 17.961. DEFINITIONS. In this subchapter:
1522 (1) "Interactive computer service" means any
1623 information service, system, or access software provider that
1724 provides or enables computer access by multiple users to a server,
1825 including a service, system, web site, web application, or web
1926 portal that provides a social media platform for users to engage in
2027 expressive activity.
2128 (2) "User" means any person that posts, uploads,
2229 transmits, or otherwise publishes content through any interactive
2330 computer service, including a social media platform.
2431 Sec. 17.962. INAPPLICABILITY OF SUBCHAPTER. This
2532 subchapter does not apply to an Internet service provider as
2633 defined by Section 324.055.
2734 Sec. 17.963. UNLAWFUL ACTS. (a) Except as provided by
2835 Subsection (b), an interactive computer service that represents the
2936 service as viewpoint neutral, impartial, or non-biased may not on
3037 the basis of the content or viewpoint expressed:
3138 (1) block a user's speech;
3239 (2) censor a user's speech;
3340 (3) ban a user;
3441 (4) remove a user's speech;
3542 (5) shadow ban a user;
3643 (6) de-platform a user;
3744 (7) de-boost a user's speech;
3845 (8) de-monetize a user; or
3946 (9) otherwise restrict speech of a user.
4047 (b) Pursuant to 47 U.S.C. Section 230(c), it is a defense to
4148 liability under this section that an interactive computer service:
4249 (1) voluntarily and in good faith acted to restrict
43- access to or availability of content that the interactive computer
44- service reasonably considers to be obscene, lewd, lascivious,
45- filthy, excessively violent, harassing, or otherwise
46- objectionable, whether or not such content is constitutionally
47- protected; or
50+ access to or availability of content that is objectively considered
51+ to be obscene, lewd, lascivious, filthy, excessively violent,
52+ harassing, or otherwise objectionable, whether or not such content
53+ is constitutionally protected; or
4854 (2) acted to enable or make available the technical
4955 means to restrict access to content described in Subdivision (1).
5056 Sec. 17.964. DECEPTIVE TRADE PRACTICE. A violation of this
5157 subchapter is a false, misleading, or deceptive act or practice
52- within the meaning of Section 17.46 and is subject to an enforcement
53- action by the attorney general under Subchapter E and to the
54- penalties and remedies contained in Section 17.47.
58+ within the meaning of Section 17.46 and is actionable in a public
59+ suit brought under Subchapter E.
5560 SECTION 3. This Act takes effect September 1, 2019.
