| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 562.110(h) and (i), Occupations Code, |
|---|
| 10 | 10 | | as added by Chapter 929 (S.B. 1633), Acts of the 85th Legislature, |
|---|
| 11 | 11 | | Regular Session, 2017, are amended to read as follows: |
|---|
| 12 | 12 | | (h) A [Except as provided by Subsection (j), a] telepharmacy |
|---|
| 13 | 13 | | system located at a remote dispensing site under Subsection (d)(2) |
|---|
| 14 | 14 | | may not be located within 10 [25] miles by road of a Class A |
|---|
| 15 | 15 | | pharmacy. |
|---|
| 16 | 16 | | (i) If [Except as provided by Subsection (j), if] a Class A |
|---|
| 17 | 17 | | pharmacy is established within 10 [25] miles by road of a remote |
|---|
| 18 | 18 | | dispensing site that is currently operating, the remote dispensing |
|---|
| 19 | 19 | | site may continue to operate at that location. |

| 20 | 20 | | SECTION 2. (a) Sections 562.110(g), (h), and (i), |
|---|
| 21 | 21 | | Occupations Code, as added by Chapter 485 (H.B. 2561), Acts of the |
|---|
| 22 | 22 | | 85th Legislature, Regular Session, 2017, are repealed. |
|---|
| 23 | 23 | | (b) Section 562.110(j), Occupations Code, is repealed. |
|---|
| 24 | 24 | | SECTION 3. To the extent of any conflict, this Act prevails |
|---|
| 25 | 25 | | over another Act of the 86th Legislature, Regular Session, 2019, |
|---|
| 26 | 26 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 27 | 27 | | codes. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2019. |
|---|
