5	5	AN ACT
6	6	relating to statewide technology centers and cloud computing
7	7	services.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. The heading to Subchapter L, Chapter 2054,
10	10	Government Code, is amended to read as follows:
11	11	SUBCHAPTER L. STATEWIDE TECHNOLOGY CENTERS AND CLOUD COMPUTING
12	12	SERVICES
13	13	SECTION 2. Section 2054.375, Government Code, is amended by
14	14	10 amending Subdivision (1) and adding Subdivision (1-a) to read as
15	15	follows:
16	16	(1) "Cloud computing service" has the meaning assigned
17	17	by Section 2157.007.
18	18	(1-a) "Governmental entity" means a state agency or
19	19	local government.
20	20	SECTION 3. Section 2054.378, Government Code, is amended to
21	21	read as follows:
22	22	Sec. 2054.378. AUTHORIZATION FOR CLOUD COMPUTING SERVICES
23	23	OR SELECTION FOR CENTER SERVICES; SCOPE OF OPERATION OF CENTERS.
24	24	(a) The department shall:
25	25	(1) allows a state agency to contract with a cloud
26	26	computing service provider for services described by Subsection
27	27	(b); or
28	28	(2) allows a state agency to utilize services
29	29	described by subsection (b) by a statewide technology center.
30	30	(b) The department may operate statewide technology centers
31	31	to provide two or more governmental entities, on a cost-sharing
32	32	basis, services relating to:
33	33	(1) information resources and information resources
34	34	technology; and
35	35	(2) the deployment, development, and maintenance of
36	36	software applications.
37	37	(c) [(b)] The department may operate a statewide technology
38	38	10 center directly or contract with another person to operate the 11
39	39	center.
40	40	(d) agencies have a choice in determining whether to utilize
41	41	a cloud service provider and/or the statewide technology center.
42	42	SECTION 4. Section 2054.382(a), Government Code, is amended
43	43	to read as follows:
44	44	(a) Either a cloud service provider or the department may
45	45	[shall] manage the operations of 15 statewide technology centers
46	46	that provide data center services or disaster recovery services for
47	47	two or more state agencies, including management of the operations
48	48	of the center on the campus of Angelo State University.
49	49	SECTION 5. Section 2054.384, Government Code, is amended to
50	50	read as follows:
51	51	Sec. 2054.384. COST AND REQUIREMENTS ANALYSIS. (a) Each
52	52	state agency the department considers for participation under this
53	53	subchapter [The department] shall conduct a cost and requirements
54	54	analysis to determine the agency's information resource technology
55	55	needs and shall consider using a cloud computing service, including
56	56	any security benefits and cost savings associated with purchasing
57	57	the service from a cloud computing service provider, or [for each
58	58	state agency that the department intends to select for
59	59	participation in] a statewide technology center.
60	60	(b) A [selected] state agency shall identify the agency's
61	61	[its] particular technology requirements, operations costs, and
62	62	requested service levels for the department. The department may 6
63	63	require a state agency to validate or resubmit data related to these
64	64	factors. [The department shall fulfill the requirements and
65	65	service levels of each state agency to the extent possible.]
66	66	SECTION 6. Section 2054.390, Government Code, is amended to
67	67	read as follows:
68	68	Sec. 2054.390. PRIORITIZATION AND USE OF EXISTING CAPACITY
69	69	REQUIRED [MIGRATION OF SERVICES]. If the [(a) The] department

78	78	statewide technology center established under this subchapter, the

81	81	Data Center located on the campus of Angelo State University.
82	82	SECTION 7. Section 2054.392, Government Code, is amended to
83	83	read as follows:
84	84	Sec. 2054.392. STATEWIDE TECHNOLOGY ACCOUNT. The
85	85	comptroller shall establish in the state treasury the statewide
86	86	technology account. The account is a revolving fund account for the
87	87	administration of this subchapter. The account is the depository
88	88	for all money received from entities served under this subchapter.
89	89	Money in the account may be used only for a [the operation and
90	90	management of a statewide technology center or for any other]
91	91	purpose specified by the legislature.
92	92	SECTION 8. Sections 2054.382(c) and (d) and Section
93	93	2054.391, Government Code, are repealed.
94	94	SECTION 9. This Act takes effect September 1, 2019.
