55 AN ACT
66 relating to statewide technology centers and cloud computing
77 services.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subchapter L, Chapter 2054,
1010 Government Code, is amended to read as follows:
1111 SUBCHAPTER L. STATEWIDE TECHNOLOGY CENTERS AND CLOUD COMPUTING
1212 SERVICES
1313 SECTION 2. Section 2054.375, Government Code, is amended by
1414 10 amending Subdivision (1) and adding Subdivision (1-a) to read as
1515 follows:
1616 (1) "Cloud computing service" has the meaning assigned
1717 by Section 2157.007.
1818 (1-a) "Governmental entity" means a state agency or
1919 local government.
2020 SECTION 3. Section 2054.378, Government Code, is amended to
2121 read as follows:
2222 Sec. 2054.378. AUTHORIZATION FOR CLOUD COMPUTING SERVICES
2323 OR SELECTION FOR CENTER SERVICES; SCOPE OF OPERATION OF CENTERS.
2424 (a) The department shall:
2525 (1) allows a state agency to contract with a cloud
2626 computing service provider for services described by Subsection
2727 (b); or
2828 (2) allows a state agency to utilize services
2929 described by subsection (b) by a statewide technology center.
3030 (b) The department may operate statewide technology centers
3131 to provide two or more governmental entities, on a cost-sharing
3232 basis, services relating to:
3333 (1) information resources and information resources
3434 technology; and
3535 (2) the deployment, development, and maintenance of
3636 software applications.
3737 (c) [(b)] The department may operate a statewide technology
3838 10 center directly or contract with another person to operate the 11
3939 center.
4040 (d) agencies have a choice in determining whether to utilize
4141 a cloud service provider and/or the statewide technology center.
4242 SECTION 4. Section 2054.382(a), Government Code, is amended
4343 to read as follows:
4444 (a) Either a cloud service provider or the department may
4545 [shall] manage the operations of 15 statewide technology centers
4646 that provide data center services or disaster recovery services for
4747 two or more state agencies, including management of the operations
4848 of the center on the campus of Angelo State University.
4949 SECTION 5. Section 2054.384, Government Code, is amended to
5050 read as follows:
5151 Sec. 2054.384. COST AND REQUIREMENTS ANALYSIS. (a) Each
5252 state agency the department considers for participation under this
5353 subchapter [The department] shall conduct a cost and requirements
5454 analysis to determine the agency's information resource technology
5555 needs and shall consider using a cloud computing service, including
5656 any security benefits and cost savings associated with purchasing
5757 the service from a cloud computing service provider, or [for each
5858 state agency that the department intends to select for
5959 participation in] a statewide technology center.
6060 (b) A [selected] state agency shall identify the agency's
6161 [its] particular technology requirements, operations costs, and
6262 requested service levels for the department. The department may 6
6363 require a state agency to validate or resubmit data related to these
6464 factors. [The department shall fulfill the requirements and
6565 service levels of each state agency to the extent possible.]
6666 SECTION 6. Section 2054.390, Government Code, is amended to
6767 read as follows:
6868 Sec. 2054.390. PRIORITIZATION AND USE OF EXISTING CAPACITY
6969 REQUIRED [MIGRATION OF SERVICES]. If the [(a) The] department

8282 SECTION 7. Section 2054.392, Government Code, is amended to
8383 read as follows:
8484 Sec. 2054.392. STATEWIDE TECHNOLOGY ACCOUNT. The
8585 comptroller shall establish in the state treasury the statewide
8686 technology account. The account is a revolving fund account for the
8787 administration of this subchapter. The account is the depository
8888 for all money received from entities served under this subchapter.
8989 Money in the account may be used only for a [the operation and
9090 management of a statewide technology center or for any other]
9191 purpose specified by the legislature.
9292 SECTION 8. Sections 2054.382(c) and (d) and Section
9393 2054.391, Government Code, are repealed.
9494 SECTION 9. This Act takes effect September 1, 2019.
