| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 108.73(2), Alcoholic Beverage Code, is |
|---|
| 9 | 11 | | amended to read as follows: |
|---|
| 10 | 12 | | (2) "Public entertainment facility" means an arena, |
|---|
| 11 | 13 | | stadium, automobile race track, amphitheater, auditorium, theater, |
|---|
| 12 | 14 | | civic center, convention center, or similar facility that is |
|---|
| 13 | 15 | | primarily designed and used for live artistic, theatrical, |
|---|
| 14 | 16 | | cultural, educational, charitable, musical, sporting, nationally |
|---|
| 15 | 17 | | sanctioned automobile racing, or entertainment events and includes |
|---|
| 16 | 18 | | parking areas that are adjacent to the facility. The term includes |
|---|
| 17 | 19 | | a facility that is part of an approved venue project, including the |
|---|
| 18 | 20 | | venue and related infrastructure, as those terms are defined by |
|---|
| 19 | 21 | | Section 334.001, Local Government Code. The term does not include a |
|---|
| 20 | 22 | | facility the primary purpose of which is the sale of food or |
|---|
| 21 | 23 | | alcoholic beverages, including a bar, nightclub, restaurant, |
|---|
| 22 | 24 | | hotel, bowling alley, pool hall, or dance hall, or a facility that |
|---|
| 23 | 25 | | derives 75 percent or more of the facility's annual gross revenue |
|---|
| 24 | 26 | | from the on-premise sale of alcoholic beverages, except for a |
|---|
| 25 | 27 | | facility that is part of an approved venue project, including the |
|---|
| 26 | 28 | | venue and related infrastructure, as those terms are defined by |
|---|
| 27 | 29 | | Section 334.001, Local Government Code. |
|---|
| 28 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 34 | | Act takes effect September 1, 2019. |
