44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the use of tax revenue by certain municipalities for the
77 payment of certain hotel-related bonds or other obligations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 351.102(e) and (g), Tax Code, are
1010 amended to read as follows:
1111 (e) In addition to the municipalities described by Subsection
1212 (b), that subsection also applies to:
1313 (1) a municipality with a population of at least 110,000
1414 but not more than 135,000 at least part of which is located in a
1515 county with a population of not more than 135,000;
1616 (2) a municipality with a population of at least 9,000
1717 but not more than 10,000 that is located in two counties, each of
1818 which has a population of at least 662,000 and a southern border
1919 with a county with a population of 2.3 million or more;
2020 (3) a municipality with a population of at least 200,000
2121 but not more than 300,000 that contains a component institution of
2222 the Texas Tech University System;
2323 (4) a municipality with a population of at least 95,000
2424 that borders Lake Lewisville;
2525 (5) a municipality that:
2626 (A) contains a portion of Cedar Hill State Park;
2727 (B) has a population of more than 45,000;
2828 (C) is located in two counties, one of which has a
2929 population of more than two million and one of which has a
3030 population of more than 149,000; and
3131 (D) has adopted a capital improvement plan for the
3232 construction or expansion of a convention center facility;
3333 (6) a municipality with a population of less than 6,000
3434 that:
3535 (A) is located in two counties each with a
3636 population of 600,000 or more that are both adjacent to a county
3737 with a population of two million or more;
3838 (B) has full-time police and fire departments; and
3939 (C) has adopted a capital improvement plan for the
4040 construction or expansion of a convention center facility;
4141 (7) a municipality with a population of at least 56,000
4242 that:
4343 (A) borders Lake Ray Hubbard; and
4444 (B) is located in two counties, one of which has a
4545 population of less than 80,000;
4646 (8) a municipality with a population of more than
4747 83,000, that borders Clear Lake, and that is primarily located in a
4848 county with a population of less than 300,000;
4949 (9) a municipality with a population of less than 2,000
5050 that:
5151 (A) is located adjacent to a bay connected to the
5252 Gulf of Mexico;
5353 (B) is located in a county with a population of
5454 290,000 or more that is adjacent to a county with a population of
5555 four million or more; and
5656 (C) has a boardwalk on the bay;
5757 (10) a municipality with a population of 75,000 or more
5858 that:
5959 (A) is located wholly in one county with a
6060 population of 575,000 or more that is adjacent to a county with a
6161 population of four million or more; and
6262 (B) has adopted a capital improvement plan for the
6363 construction or expansion of a convention center facility;
6464 (11) a municipality with a population of less than
6565 75,000 that is located in three counties, at least one of which has
6666 a population of at least four million; [and]
6767 (12) an eligible coastal municipality with a population
6868 of more than 3,000 but less than 5,000; and
6969 (13) a municipality with a population of 6,100 or less
7070 that:
7171 (A) is located in two counties one with a
7272 population of 788,400 or more and the other county with a population
7373 of 666,700 or more; and
7474 (B) contains a portion of state highway 289.
7575 (g) A municipality to which this section applies may not
7676 receive or pledge revenue or funds under Subsection (b) or (c) for a
7777 hotel project unless the municipality enters into an agreement with
7878 a person for the development of the hotel project before September
7979 1, 2019.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2019.
