| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 375.262, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 375.262. DISSOLUTION BY PETITION BY OWNERS. Except as |
|---|
| 13 | 13 | | limited by Section 375.264, the board shall dissolve the district |
|---|
| 14 | 14 | | on written petition filed with the board by the owners of: |
|---|
| 15 | 15 | | (1) 50 [75] percent or more of the assessed value of |
|---|
| 16 | 16 | | the property in the district based on the most recent certified |
|---|
| 17 | 17 | | county property tax rolls; or |
|---|
| 18 | 18 | | (2) 50 [75] percent or more of the surface area of the |
|---|
| 19 | 19 | | district, excluding roads, streets, highways, utility |
|---|
| 20 | 20 | | rights-of-way, other public areas, and other property exempt from |
|---|
| 21 | 21 | | assessment under Sections 375.161, 375.163, and 375.164, according |
|---|
| 22 | 22 | | to the most recent certified county property tax rolls. |

| 23 | 23 | | SECTION 2. Section 68.352(b), Water Code, is amended to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | (b) The board shall dissolve the district on written |
|---|
| 26 | 26 | | petition filed with the board by the owners of: |
|---|
| 27 | 27 | | (1) 75 percent or more of the assessed value of the |
|---|
| 28 | 28 | | property in the district based on the most recent certified county |
|---|
| 29 | 29 | | property tax rolls; or |
|---|
| 30 | 30 | | (2) 75 percent or more of the surface area of the |
|---|
| 31 | 31 | | district, excluding roads, streets, highways, utility |
|---|
| 32 | 32 | | rights-of-way, other public areas, and other property exempt from |
|---|
| 33 | 33 | | assessment under this chapter, according to the most recent |
|---|
| 34 | 34 | | certified county property tax rolls [A district may be dissolved as |
|---|
| 35 | 35 | | provided by Section 375.262, Local Government Code]. |

| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2019. |
