66 relating to establishing the supporting medically fragile children

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 32, Human Resources Code, is amended by
1010 adding Subchapter I to read as follows:
1111 SUBCHAPTER I. SUPPORTING MEDICALLY FRAGILE CHILDREN PROGRAM
1212 Sec. 32.401. DEFINITIONS. In this subchapter:
1313 (1) "Program" means the supporting medically fragile
1414 children program established under this subchapter.
1515 (2) "Section 1915(c) waiver program" has the meaning
1616 assigned by Section 531.001, Government Code.
1717 (3) "STAR Kids managed care program" means the STAR
1818 Kids managed care program operated under Section 533.00253,
1919 Government Code.
2020 Sec. 32.402. SUPPORTING MEDICALLY FRAGILE CHILDREN
2121 PROGRAM. (a) The commission shall develop and implement a program
2222 to provide financial assistance to eligible recipients who are in
2323 need of the assistance for purposes of receiving or continuing
2424 necessary health care services that have been delayed or denied
2525 under Medicaid, including care that has been denied pending appeal.
2626 Financial assistance under the program must be provided in the form
2727 of direct reimbursements to health care providers.
2828 (b) In establishing the program, the commission shall:
2929 (1) consult with appropriate stakeholders to
3030 determine:
3131 (A) application and eligibility requirements for
3232 receiving financial assistance under the program; and
3333 (B) how providers will be reimbursed with
3434 financial assistance granted through the program; and
3535 (2) designate a person within the commission to act as
3636 an ombudsman for the program and as a point of contact for
3737 recipients, recipients' families, and health care providers.
3838 Sec. 32.403. ELIGIBLE RECIPIENTS. To be eligible for
3939 assistance under the program, a recipient must be receiving
4040 benefits under:
4141 (1) a Section 1915(c) waiver program, including:
4242 (A) the Medically Dependent Children Program
4343 (MDCP);
4444 (B) the Community Living Assistance and Support
4545 Services (CLASS) waiver program;
4646 (C) the Home and Community-based Services (HCS)
4747 waiver program; and
4848 (D) the Deaf-Blind with Multiple Disabilities
4949 (DBMD) waiver program; or
5050 (2) the STAR Kids managed care program.
5151 Sec. 32.404. SUPPORTING MEDICALLY FRAGILE CHILDREN
5252 ACCOUNT. (a) The supporting medically fragile children account is
5353 an account in the general revenue fund.
5454 (b) The account consists of:
5555 (1) appropriations of money to the account by the
5656 legislature;
5757 (2) gifts, grants, including federal grants, and other
5858 donations received under Section 32.405; and
5959 (3) interest earned on the investment of money in the
6060 account.
6161 (c) Money in the account may be appropriated only to the
6262 commission for purposes of the program.
6363 (d) The account is exempt from the application of Section
6464 404.071, Government Code.
6565 Sec. 32.405. GIFTS, GRANTS, AND DONATIONS. The commission
6666 may accept gifts, grants, and donations from any source that are
6767 made for the purposes of the program. The commission shall deposit
6868 to the credit of the account money received under this section.
6969 Sec. 32.406. RULES. The executive commissioner shall adopt
7070 rules necessary to implement this section.
7171 SECTION 2. If before implementing any provision of this Act
7272 a state agency determines that a waiver or authorization from a
7373 federal agency is necessary for implementation of that provision,
7474 the agency affected by the provision shall request the waiver or
7575 authorization and may delay implementing that provision until the
7676 waiver or authorization is granted.
7777 SECTION 3. This Act takes effect September 1, 2019.
