| 10 | 10 | SECTION 1. Section 981.004, Insurance Code, is amended by | |
| 11 | 11 | adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) Notwithstanding Subsection (a)(1), the availability of | |
| 13 | 13 | windstorm and hail insurance from the Texas Windstorm Insurance | |
| 14 | 14 | Association does not preclude an eligible surplus lines insurer | |
| 15 | 15 | from providing windstorm and hail insurance under Subsection (a) or | |
| 16 | 16 | limiting the amount of insurance that may be provided under | |
| 17 | 17 | Subsection (b). | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2019. |
