32 | 24 | | Sec. 3963.0103. PURPOSE; DECLARATION OF INTENT. (a) The |

33 | 25 | | creation of the district is essential to accomplish the purposes of |
---|
34 | 26 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
35 | 27 | | Texas Constitution, and other public purposes stated in this |
---|
36 | 28 | | chapter. |
---|
37 | 29 | | (b) By creating the district and in authorizing the city and |
---|
38 | 30 | | other political subdivisions to contract with the district, the |
---|
39 | 31 | | legislature has established a program to accomplish the public |
---|
40 | 32 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
41 | 33 | | (c) The creation of the district is necessary to promote, |
---|
42 | 34 | | develop, encourage, and maintain employment, commerce, |
---|
43 | 35 | | transportation, housing, tourism, recreation, the arts, |
---|
44 | 36 | | entertainment, economic development, safety, and the public |
---|
45 | 37 | | welfare in the district. |
---|
46 | 38 | | (d) This chapter and the creation of the district may not be |
---|
47 | 39 | | interpreted to relieve the city from providing the level of |
---|
48 | 40 | | services provided as of the effective date of the Act enacting this |
---|
49 | 41 | | chapter to the area in the district. The district is created to |
---|
50 | 42 | | supplement and not to supplant city services provided in the |
---|
51 | 43 | | district. |
---|
52 | 44 | | Sec. 3963.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. |
---|
53 | 45 | | (a) All land and other property included in the district will |
---|
54 | 46 | | benefit from the improvements and services to be provided by the |
---|
55 | 47 | | district under powers conferred by Sections 52 and 52-a, Article |
---|
56 | 48 | | III, and Section 59, Article XVI, Texas Constitution, and other |
---|
57 | 49 | | powers granted under this chapter. |
---|
58 | 50 | | (b) The district is created to serve a public use and |
---|
59 | 51 | | benefit. |
---|
60 | 52 | | (c) The creation of the district is in the public interest |
---|
61 | 53 | | and is essential to further the public purposes of: |
---|
62 | 54 | | (1) developing and diversifying the economy of the |
---|
63 | 55 | | state; |
---|
64 | 56 | | (2) eliminating unemployment and underemployment; and |
---|
65 | 57 | | (3) developing or expanding transportation and |
---|
66 | 58 | | commerce. |
---|
67 | 59 | | (d) The district will: |
---|
68 | 60 | | (1) promote the health, safety, and general welfare of |
---|
69 | 61 | | residents, employers, potential employees, employees, visitors, |
---|
70 | 62 | | and consumers in the district, and of the public; |
---|
71 | 63 | | (2) provide needed funding for the district to |
---|
72 | 64 | | preserve, maintain, and enhance the economic health and vitality of |
---|
73 | 65 | | the district territory as a community and business center; |
---|
74 | 66 | | (3) promote the health, safety, welfare, and enjoyment |
---|
75 | 67 | | of the public by providing pedestrian ways and by landscaping and |
---|
76 | 68 | | developing certain areas in the district, which are necessary for |
---|
77 | 69 | | the restoration, preservation, and enhancement of scenic beauty; |
---|
78 | 70 | | and |
---|
79 | 71 | | (4) provide for water, wastewater, drainage, road, and |
---|
80 | 72 | | recreational facilities for the district. |
---|
81 | 73 | | (e) Pedestrian ways along or across a street, whether at |
---|
82 | 74 | | grade or above or below the surface, and street lighting, street |
---|
83 | 75 | | landscaping, parking, and street art objects are parts of and |
---|
84 | 76 | | necessary components of a street and are considered to be a street |
---|
85 | 77 | | or road improvement. |
---|
86 | 78 | | (f) The district will not act as the agent or |
---|
87 | 79 | | instrumentality of any private interest even though the district |
---|
88 | 80 | | will benefit many private interests as well as the public. |
---|
89 | 81 | | Sec. 3963.0105. INITIAL DISTRICT TERRITORY. (a) The |
---|
90 | 82 | | district is initially composed of the territory described by |
---|
91 | 83 | | Section 2 of the Act enacting this chapter. |
---|
92 | 84 | | (b) The boundaries and field notes contained in Section 2 of |
---|
93 | 85 | | the Act enacting this chapter form a closure. A mistake in the |
---|
94 | 86 | | field notes or in copying the field notes in the legislative process |
---|
95 | 87 | | does not affect the district's: |
---|
96 | 88 | | (1) organization, existence, or validity; |
---|
97 | 89 | | (2) right to issue any type of bonds for the purposes |
---|
98 | 90 | | for which the district is created or to pay the principal of and |
---|
99 | 91 | | interest on the bonds; |
---|
100 | 92 | | (3) right to impose or collect an assessment or tax; or |
---|
101 | 93 | | (4) legality or operation. |
---|
102 | 94 | | Sec. 3963.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |

103 | 95 | | All or any part of the area of the district is eligible to be |
---|

---|
105 | 97 | | (1) a tax increment reinvestment zone created under |
---|
106 | 98 | | Chapter 311, Tax Code; or |
---|
107 | 99 | | (2) a tax abatement reinvestment zone created under |
---|
108 | 100 | | Chapter 312, Tax Code. |

109 | 101 | | Sec. 3963.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT |
