12 | 14 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
13 | 15 | | Sec. 3970.0101. DEFINITIONS. In this chapter: |
---|
14 | 16 | | (1) "Board" means the district's board of directors. |
---|
15 | 17 | | (2) "City" means the City of Crowley. |
---|
16 | 18 | | (3) "County" means Tarrant County. |
---|
17 | 19 | | (4) "Director" means a board member. |
---|
18 | 20 | | (5) "District" means the Karis Municipal Management |
---|
19 | 21 | | District of Tarrant County created by order of the Texas Commission |
---|
20 | 22 | | on Environmental Quality on February 19, 2019. |
---|
21 | 23 | | Sec. 3970.0102. CONFLICTS. In the case of a conflict |
---|
22 | 24 | | between the order of the Texas Commission on Environmental Quality |
---|
23 | 25 | | dated February 19, 2019, that created the district and this |
---|
24 | 26 | | chapter, this chapter prevails. |
---|
25 | 27 | | Sec. 3970.0103. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
26 | 28 | | (a) All or any part of the area of the district is eligible to be |
---|
27 | 29 | | included in: |
---|
28 | 30 | | (1) a tax increment reinvestment zone created under |
---|
29 | 31 | | Chapter 311, Tax Code; |
---|
30 | 32 | | (2) a tax abatement reinvestment zone created under |
---|
31 | 33 | | Chapter 312, Tax Code; or |
---|
32 | 34 | | (3) an enterprise zone created under Chapter 2303, |
---|
33 | 35 | | Government Code. |
---|
34 | 36 | | (b) If the city creates a tax increment reinvestment zone |
---|
35 | 37 | | under Chapter 311, Tax Code, the city, by contract with the |
---|
36 | 38 | | district, may grant money deposited in the tax increment fund to the |
---|
37 | 39 | | district to be used by the district for the purposes permitted for |
---|
38 | 40 | | money granted to a corporation under Section 380.002(b), Local |
---|
39 | 41 | | Government Code, including the right to pledge the money as |
---|
40 | 42 | | security for any bonds issued by the district for an improvement |
---|
41 | 43 | | project. |
---|
42 | 44 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
43 | 45 | | Sec. 3970.0201. VACANCY. The governing body of the city |
---|
44 | 46 | | shall fill a vacancy on the board for the remainder of the unexpired |
---|
45 | 47 | | term in the same manner as the original appointment. |
---|
46 | 48 | | Sec. 3970.0202. QUORUM. For purposes of determining the |
---|
47 | 49 | | requirements for a quorum of the board, the following are not |
---|
48 | 50 | | counted: |
---|
49 | 51 | | (1) a board position vacant for any reason, including |
---|
50 | 52 | | death, resignation, or disqualification; or |
---|
51 | 53 | | (2) a director who is abstaining from participation in |
---|
52 | 54 | | a vote because of a conflict of interest. |
---|
53 | 55 | | Sec. 3970.0203. COMPENSATION. A director is entitled to |
---|
54 | 56 | | receive fees of office and reimbursement for actual expenses as |
---|
55 | 57 | | provided by Section 49.060, Water Code. Sections 375.069 and |
---|
56 | 58 | | 375.070, Local Government Code, do not apply to the board. |
---|
57 | 59 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
58 | 60 | | Sec. 3970.0301. DEVELOPMENT CORPORATION POWERS. The |
---|
59 | 61 | | district, using money available to the district for that purpose, |
---|
60 | 62 | | may exercise the powers given to a development corporation under |
---|
61 | 63 | | Chapter 505, Local Government Code, including the power to own, |
---|
62 | 64 | | operate, acquire, construct, lease, improve, or maintain a project |
---|
63 | 65 | | under that chapter. |
---|
64 | 66 | | Sec. 3970.0302. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. |
---|
65 | 67 | | The district may join and pay dues to a charitable or nonprofit |
---|
66 | 68 | | organization that performs a service or provides an activity |
---|
67 | 69 | | consistent with the furtherance of a district purpose. |
---|
68 | 70 | | Sec. 3970.0303. ECONOMIC DEVELOPMENT PROGRAMS. (a) The |
---|
69 | 71 | | district may engage in activities that accomplish the economic |
---|
70 | 72 | | development purposes of the district. |
---|
71 | 73 | | (b) The district may establish and provide for the |
---|
72 | 74 | | administration of one or more programs to promote state or local |
---|
73 | 75 | | economic development and to stimulate business and commercial |
---|
74 | 76 | | activity in the district, including programs to: |
---|
75 | 77 | | (1) make loans and grants of public money; and |
---|
76 | 78 | | (2) provide district personnel and services. |
---|
77 | 79 | | (c) The district may create economic development programs |
---|
78 | 80 | | and exercise the economic development powers provided to |
---|
79 | 81 | | municipalities by: |
---|
80 | 82 | | (1) Chapter 380, Local Government Code; and |
---|
81 | 83 | | (2) Subchapter A, Chapter 1509, Government Code. |
---|
82 | 84 | | Sec. 3970.0304. WATER DISTRICT POWERS. The district has |
---|
83 | 85 | | the powers provided by the general laws relating to conservation |
---|
84 | 86 | | and reclamation districts created under Section 59, Article XVI, |
---|
85 | 87 | | Texas Constitution, including Chapters 49 and 54, Water Code. |
---|
86 | 88 | | Sec. 3970.0305. ROAD DISTRICT POWERS. The district has the |
---|
87 | 89 | | powers provided by the general laws relating to road districts and |
---|
88 | 90 | | road utility districts created under Section 52(b), Article III, |
---|
89 | 91 | | Texas Constitution, including Chapters 257 and 441, Transportation |
---|
90 | 92 | | Code. |
---|
91 | 93 | | Sec. 3970.0306. NAVIGATION DISTRICT POWERS. (a) The |
---|
92 | 94 | | district has the powers provided by the general laws relating to |
---|
93 | 95 | | navigation districts created under Section 59, Article XVI, Texas |
---|
94 | 96 | | Constitution, including Chapters 60 and 62, Water Code. |
---|
95 | 97 | | (b) The district may purchase, construct, acquire, own, |
---|
96 | 98 | | operate, maintain, improve, or extend, inside and outside the |
---|
97 | 99 | | district, a canal, waterway, bulkhead, dock, or other improvement |
---|
98 | 100 | | or facility necessary or convenient to accomplish the navigation |
---|
99 | 101 | | purposes of the district. |
---|
100 | 102 | | Sec. 3970.0307. RULES; ENFORCEMENT. (a) The district may |
---|
101 | 103 | | adopt rules: |
---|
102 | 104 | | (1) to administer or operate the district; |
---|
103 | 105 | | (2) for the use, enjoyment, availability, protection, |
---|
104 | 106 | | security, and maintenance of the district's property and |
---|
105 | 107 | | facilities; or |
---|
106 | 108 | | (3) to provide for public safety and security in the |
---|
107 | 109 | | district. |
---|
108 | 110 | | (b) The district may enforce its rules by injunctive relief. |
---|
109 | 111 | | (c) A person who violates a rule adopted under this section |
---|
110 | 112 | | is liable to the district for a civil penalty of not less than $25 or |
---|
111 | 113 | | more than $250 for each violation. |
---|
112 | 114 | | Sec. 3970.0308. USE OF ROADWAY, PARK, OR OTHER PUBLIC AREA |
---|
113 | 115 | | OR FACILITY OF DISTRICT. (a) The board by rule may regulate the |
---|
114 | 116 | | private use of a public roadway, open space, park, sidewalk, or |
---|
115 | 117 | | similar public area or facility in the district. A rule may provide |
---|
116 | 118 | | for the safe and orderly use of public roadways, open spaces, parks, |
---|
117 | 119 | | sidewalks, and similar public areas or facilities. |
---|
118 | 120 | | (b) The board may require a permit for a parade, |
---|
119 | 121 | | demonstration, celebration, entertainment event, or similar |
---|
120 | 122 | | nongovernmental activity in or on a public roadway, open space, |
---|
121 | 123 | | park, sidewalk, or similar public area or facility owned by the |
---|
122 | 124 | | district. The board may charge a fee for the permit application or |
---|
123 | 125 | | for public safety or security services for those facilities in an |
---|
124 | 126 | | amount determined by the board. |
---|
125 | 127 | | (c) The board may require a permit or franchise agreement |
---|
126 | 128 | | with a vendor, concessionaire, exhibitor, or similar private or |
---|
127 | 129 | | commercial person or organization for the limited use of an area or |
---|
128 | 130 | | facility owned by the district on terms and on payment of a permit |
---|
129 | 131 | | or franchise fee the board may impose. |
---|
130 | 132 | | Sec. 3970.0309. APPROVAL BY CITY. Section 375.207(c), |
---|
131 | 133 | | Local Government Code, does not apply to the district. |
---|
132 | 134 | | Sec. 3970.0310. ADDING OR EXCLUDING LAND. The district may |
---|
133 | 135 | | add or exclude land in the manner provided by Subchapter J, Chapter |
---|
134 | 136 | | 49, Water Code. |
---|
135 | 137 | | Sec. 3970.0311. NO EMINENT DOMAIN POWER. The district may |
---|
136 | 138 | | not exercise the power of eminent domain. |
---|
137 | 139 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
138 | 140 | | Sec. 3970.0401. COSTS FOR IMPROVEMENT PROJECTS. The |
---|
139 | 141 | | district may undertake separately or jointly with other persons, |
---|
140 | 142 | | including the city or the county, all or part of the cost of an |
---|
141 | 143 | | improvement project, including an improvement project: |
---|
142 | 144 | | (1) for improving, enhancing, and supporting public |
---|
143 | 145 | | safety and security, fire protection and emergency medical |
---|
144 | 146 | | services, and law enforcement in or adjacent to the district; or |
---|
145 | 147 | | (2) that confers a general benefit on the entire |
---|
146 | 148 | | district or a special benefit on a definable part of the district. |
---|
147 | 149 | | Sec. 3970.0402. TAX AND ASSESSMENT ABATEMENTS. The |
---|
148 | 150 | | district may designate reinvestment zones and may grant abatements |
---|
149 | 151 | | of a tax or assessment on property in the zones. |
---|
150 | 152 | | Sec. 3970.0403. STORM WATER USER CHARGES. The district may |
---|
151 | 153 | | establish user charges related to the operation of storm water |
---|
152 | 154 | | facilities, including the regulation of storm water for the |
---|
153 | 155 | | protection of water quality in the district, subject to approval of |
---|
154 | 156 | | the governing body of the city. |
---|
155 | 157 | | Sec. 3970.0404. NONPOTABLE WATER USER CHARGES. The |
---|
156 | 158 | | district may establish user charges for the use of nonpotable water |
---|
157 | 159 | | for irrigation purposes, subject to approval of the governing body |
---|
158 | 160 | | of the city. |
---|
159 | 161 | | Sec. 3970.0405. RESIDENTIAL PROPERTY NOT EXEMPT FROM |
---|
160 | 162 | | CERTAIN REQUIREMENTS. Section 375.161, Local Government Code, does |
---|
161 | 163 | | not apply to the district. |
---|
162 | 164 | | Sec. 3970.0406. ASSESSMENTS. The district may impose an |
---|
163 | 165 | | assessment on property in the district to pay the cost or the cost |
---|
164 | 166 | | of maintenance of any authorized district improvement in the manner |
---|
165 | 167 | | provided for: |
---|
166 | 168 | | (1) a district under Subchapters A, E, and F, Chapter |
---|
167 | 169 | | 375, Local Government Code; or |
---|
168 | 170 | | (2) a municipality or county under Subchapter A, |
---|
169 | 171 | | Chapter 372, Local Government Code. |
---|
170 | 172 | | Sec. 3970.0407. BONDS AND OTHER OBLIGATIONS. (a) In |
---|
171 | 173 | | addition to the authority to issue bonds granted to the district in |
---|
172 | 174 | | Subchapter J, Chapter 375, Local Government Code, the district may |
---|
173 | 175 | | issue, by competitive bid or private sale, bonds, notes, or other |
---|
174 | 176 | | obligations in the manner provided by Subchapter A, Chapter 372, |
---|
175 | 177 | | Local Government Code. Sections 375.207(a) and (b), Local |
---|
176 | 178 | | Government Code, do not apply to the district. |
---|
177 | 179 | | (b) At the time of issuance, the total principal amount of |
---|
178 | 180 | | bonds or other obligations issued or incurred to finance road |
---|
179 | 181 | | projects and payable from ad valorem taxes may not exceed |
---|
180 | 182 | | one-fourth of the assessed value of the real property in the |
---|
181 | 183 | | district. |
---|
182 | 184 | | (c) Section 375.243, Local Government Code, does not apply |

184 | 186 | | Sec. 3970.0408. ATTORNEY GENERAL APPROVAL NOT REQUIRED FOR |
