10	6		AN ACT
11	7		relating to the creation of the Wood Trace Municipal Utility
12	8		District No. 4 of Montgomery County, Texas; granting a limited
13	9		power of eminent domain; providing authority to issue bonds;
14	10		providing authority to impose assessments, fees, and taxes.
15	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	12		SECTION 1. Subtitle F, Title 6, Special District Local Laws
17	13		Code, is amended by adding Chapter 8052 to read as follows:
18	14		CHAPTER 8052. WOOD TRACE MUNICIPAL UTILITY DISTRICT NO. 4 OF
19	15		MONTGOMERY COUNTY, TEXAS
20	16		SUBCHAPTER A. GENERAL PROVISIONS
21	17		Sec. 8052.0101. DEFINITIONS. In this chapter:
22	18		(1) "Board" means the district's board of directors.
23	19		(2) "Commission" means the Texas Commission on
24	20		Environmental Quality.
25	21		(3) "Director" means a board member.
26	22		(4) "District" means the Wood Trace Municipal Utility
27	23		District No. 4 of Montgomery County, Texas.
28	24		Sec. 8052.0102. NATURE OF DISTRICT. The district is a
29	25		municipal utility district created under Section 59, Article XVI,
30	26		Texas Constitution.
31	27		Sec. 8052.0103. CONFIRMATION AND DIRECTOR ELECTION
32	28		REQUIRED. The temporary directors shall hold an election to
33	29		confirm the creation of the district and to elect five permanent
34	30		directors as provided by Section 49.102, Water Code.
35	31		Sec. 8052.0104. CONSENT OF MUNICIPALITY REQUIRED. The
36	32		temporary directors may not hold an election under Section
37	33		8052.0103 until each municipality in whose corporate limits or
38	34		extraterritorial jurisdiction the district is located has
39	35		consented by ordinance or resolution to the creation of the
40	36		district and to the inclusion of land in the district.
41	37		Sec. 8052.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
42	38		(a) The district is created to serve a public purpose and benefit.
43	39		(b) The district is created to accomplish the purposes of:
44	40		(1) a municipal utility district as provided by
45	41		general law and Section 59, Article XVI, Texas Constitution; and
46	42		(2) Section 52, Article III, Texas Constitution, that
47	43		relate to the construction, acquisition, improvement, operation,
48	44		or maintenance of macadamized, graveled, or paved roads, or
49	45		improvements, including storm drainage, in aid of those roads.
50	46		Sec. 8052.0106. INITIAL DISTRICT TERRITORY. (a) The
51	47		district is initially composed of the territory described by
52	48		Section 2 of the Act enacting this chapter.
53	49		(b) The boundaries and field notes contained in Section 2 of
54	50		the Act enacting this chapter form a closure. A mistake made in the
55	51		field notes or in copying the field notes in the legislative process
56	52		does not affect the district's:
57	53		(1) organization, existence, or validity;
58	54		(2) right to issue any type of bond for the purposes
59	55		for which the district is created or to pay the principal of and
60	56		interest on a bond;
61	57		(3) right to impose a tax; or
62	58		(4) legality or operation.
63	59		SUBCHAPTER B. BOARD OF DIRECTORS
64		-	Sec. 8052.0201. GOVERNING BODY; TERMS. (a) The district
65		-	is governed by a board of five elected directors.

66	62		(b) Except as provided by Section 8052.0202, directors
67	63		serve staggered four-year terms.
68	64		Sec. 8052.0202. TEMPORARY DIRECTORS. (a) On or after the
69	65		effective date of the Act enacting this chapter, the owner or owners
70	66		of a majority of the assessed value of the real property in the
71	67		district may submit a petition to the commission requesting that
72	68		the commission appoint as temporary directors the five persons
73	69		named in the petition. The commission shall appoint as temporary
74	70		directors the five persons named in the petition.
75	71		(b) Temporary directors serve until the earlier of:
76	72		(1) the date permanent directors are elected under
77	73		Section 8052.0103; or
78	74		(2) the fourth anniversary of the effective date of
79	75		the Act enacting this chapter.
80	76		(c) If permanent directors have not been elected under
81	77		Section 8052.0103 and the terms of the temporary directors have
82	78		expired, successor temporary directors shall be appointed or
83	79		reappointed as provided by Subsection (d) to serve terms that
84	80		expire on the earlier of:
85	81		(1) the date permanent directors are elected under
86	82		Section 8052.0103; or
87	83		(2) the fourth anniversary of the date of the
88	84		appointment or reappointment.
89	85		(d) If Subsection (c) applies, the owner or owners of a
90	86		majority of the assessed value of the real property in the district
91	87		may submit a petition to the commission requesting that the
92	88		commission appoint as successor temporary directors the five
93	89		persons named in the petition. The commission shall appoint as
94	90		successor temporary directors the five persons named in the
95	91		petition.
96	92		SUBCHAPTER C. POWERS AND DUTIES
97	93		Sec. 8052.0301. GENERAL POWERS AND DUTIES. The district
98	94		has the powers and duties necessary to accomplish the purposes for
99	95		which the district is created.
100	96		Sec. 8052.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
101	97		DUTIES. The district has the powers and duties provided by the
102	98		general law of this state, including Chapters 49 and 54, Water Code,
103	99		applicable to municipal utility districts created under Section 59,
104	100		Article XVI, Texas Constitution.
105	101		Sec. 8052.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
106	102		52, Article III, Texas Constitution, the district may design,
107	103		acquire, construct, finance, issue bonds for, improve, operate,
108	104		maintain, and convey to this state, a county, or a municipality for
109	105		operation and maintenance macadamized, graveled, or paved roads, or
110	106		improvements, including storm drainage, in aid of those roads.
111	107		Sec. 8052.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
112	108		road project must meet all applicable construction standards,
113	109		zoning and subdivision requirements, and regulations of each
114	110		municipality in whose corporate limits or extraterritorial
115	111		jurisdiction the road project is located.
116	112		(b) If a road project is not located in the corporate limits
117	113		or extraterritorial jurisdiction of a municipality, the road
118	114		project must meet all applicable construction standards,
119	115		subdivision requirements, and regulations of each county in which
120	116		the road project is located.
121	117		(c) If the state will maintain and operate the road, the
122	118		Texas Transportation Commission must approve the plans and
123	119		specifications of the road project.
124	120		Sec. 8052.0305. COMPLIANCE WITH MUNICIPAL CONSENT
125	121		ORDINANCE OR RESOLUTION. The district shall comply with all
126	122		applicable requirements of any ordinance or resolution that is
127	123		adopted under Section 54.016 or 54.0165, Water Code, and that
128	124		consents to the creation of the district or to the inclusion of land
129	125		in the district.
130		-	Sec. 8052.0306. DIVISION OF DISTRICT. (a) The district
131		-	~~may~~ be divided into two or more new districts only if the district:

132	128		(1) has no outstanding bonded debt; and
133	129		(2) is not imposing ad valorem taxes.
134	130		(b) This chapter applies to any new district created by the
135	131		division of the district, and a new district has all the powers and
136	132		duties of the district.
137	133		(c) Any new district created by the division of the district
138	134		may not, at the time the new district is created, contain any land
139	135		outside the area described by Section 2 of the Act enacting this
140	136		chapter.
141	137		(d) The board, on its own motion or on receipt of a petition
142	138		signed by the owner or owners of a majority of the assessed value of
143	139		the real property in the district, may adopt an order dividing the
144	140		district.
145	141		(e) The board may adopt an order dividing the district
146	142		before or after the date the board holds an election under Section
147	143		8052.0103 to confirm the district's creation.
148	144		(f) An order dividing the district shall:
149	145		(1) name each new district;
150	146		(2) include the metes and bounds description of the
151	147		territory of each new district;
152	148		(3) appoint temporary directors for each new district;
153	149		and
154	150		(4) provide for the division of assets and liabilities
155	151		between or among the new districts.
156	152		(g) On or before the 30th day after the date of adoption of
157	153		an order dividing the district, the district shall file the order
158	154		with the commission and record the order in the real property
159	155		records of each county in which the district is located.
160	156		(h) Any new district created by the division of the district
161	157		shall hold a confirmation and directors' election as required by
162	158		Section 8052.0103.
163	159		(i) Municipal consent to the creation of the district and to
164	160		the inclusion of land in the district granted under Section
165	161		8052.0104 acts as municipal consent to the creation of any new
166	162		district created by the division of the district and to the
167	163		inclusion of land in the new district.
168	164		(j) Any new district created by the division of the district
169	165		must hold an election as required by this chapter to obtain voter
170	166		approval before the district may impose a maintenance tax or issue
171	167		bonds payable wholly or partly from ad valorem taxes.
172	168		(k) If the creation of the new district is confirmed, the
173	169		new district shall provide the election date and results to the
174	170		commission.
175	171		SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
176		-	Sec. 8052.0401. ELECTIONS REGARDING TAXES OR BONDS.
177		-	~~(a)~~ The district may issue, without an election, bonds and other

178	174		obligations secured by:
179	175		(1) revenue other than ad valorem taxes; or
180	176		(2) contract payments described by Section 8052.0403.
181	177		(b) The district must hold an election in the manner
182	178		provided by Chapters 49 and 54, Water Code, to obtain voter approval
183	179		before the district may impose an ad valorem tax or issue bonds
184	180		payable from ad valorem taxes.
185	181		(c) The district may not issue bonds payable from ad valorem
186	182		taxes to finance a road project unless the issuance is approved by a
187	183		vote of a two-thirds majority of the district voters voting at an
188	184		election held for that purpose.
189	185		Sec. 8052.0402. OPERATION AND MAINTENANCE TAX. (a) If
190	186		authorized at an election held under Section 8052.0401, the
191	187		district may impose an operation and maintenance tax on taxable
192	188		property in the district in accordance with Section 49.107, Water
193	189		Code.
194	190		(b) The board shall determine the tax rate. The rate may not
195	191		exceed the rate approved at the election.
196	192		Sec. 8052.0403. CONTRACT TAXES. (a) In accordance with
197	193		Section 49.108, Water Code, the district may impose a tax other than
198	194		an operation and maintenance tax and use the revenue derived from
199	195		the tax to make payments under a contract after the provisions of
200	196		the contract have been approved by a majority of the district voters
201	197		voting at an election held for that purpose.
202	198		(b) A contract approved by the district voters may contain a
203	199		provision stating that the contract may be modified or amended by
204	200		the board without further voter approval.
205	201		SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
206	202		Sec. 8052.0501. AUTHORITY TO ISSUE BONDS AND OTHER
207	203		OBLIGATIONS. The district may issue bonds or other obligations
208	204		payable wholly or partly from ad valorem taxes, impact fees,
209	205		revenue, contract payments, grants, or other district money, or any
210	206		combination of those sources, to pay for any authorized district
211	207		purpose.
212	208		Sec. 8052.0502. TAXES FOR BONDS. At the time the district
213	209		issues bonds payable wholly or partly from ad valorem taxes, the
214	210		board shall provide for the annual imposition of a continuing
215	211		direct ad valorem tax, without limit as to rate or amount, while all
216	212		or part of the bonds are outstanding as required and in the manner
217	213		provided by Sections 54.601 and 54.602, Water Code.
218	214		Sec. 8052.0503. BONDS FOR ROAD PROJECTS. At the time of
219	215		issuance, the total principal amount of bonds or other obligations
220	216		issued or incurred to finance road projects and payable from ad
221	217		valorem taxes may not exceed one-fourth of the assessed value of the
222	218		real property in the district.
223	219		SECTION 2. The Wood Trace Municipal Utility District No. 4
224	220		of Montgomery County, Texas initially includes all the territory
225	221		contained in the following area:
226	222		TRACT 1 - 505.83 ACRES:
227	223		Being a 505.83-acre tract of land, located in the Andrew J.
228	224		Hensley, Abstract No. 255 and the J.D. Cochran Survey, A-123 in
229	225		Montgomery County, Texas; said 505.83-acre tract being out of a
230	226		called 2,253.2253-acre tract of land conveyed to Terra Investments,
231	227		LP in Clerk's File Number 2004023496 of the Official Public Records
232	228		of Real Property of Montgomery County Texas (O.P.R.R.P.M.C.T.);
233	229		said 505.83 acre tract being more particularly described by metes
234	230		and bounds as follows (all bearings are referenced to the north line
235	231		of said 2,253.2253-acre tract):
236	232		Beginning at the northwest corner of a called 34.6647-acre
237	233		tract of land recorded in Clerk's File Number 2018021947 of the
238	234		O.P.R.R.P.M.C.T., same being on the northwest line of said called
239	235		2,253.2253-acre tract;
240	236		Thence, with the northwest line of said called
241	237		2,253.2253-acre tract, the following three (3) courses:
242	238		1. North 43 degrees 05 minutes 06 seconds East, a distance

855	851		SECTION 3. (a) The legal notice of the intention to
856	852		introduce this Act, setting forth the general substance of this
857	853		Act, has been published as provided by law, and the notice and a
858	854		copy of this Act have been furnished to all persons, agencies,
859	855		officials, or entities to which they are required to be furnished
860	856		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
861	857		Government Code.
862	858		(b) The governor, one of the required recipients, has
863	859		submitted the notice and Act to the Texas Commission on
864	860		Environmental Quality.
865	861		(c) The Texas Commission on Environmental Quality has filed
866	862		its recommendations relating to this Act with the governor, the
867	863		lieutenant governor, and the speaker of the house of
868	864		representatives within the required time.
869	865		(d) All requirements of the constitution and laws of this
870	866		state and the rules and procedures of the legislature with respect
871	867		to the notice, introduction, and passage of this Act are fulfilled
872	868		and accomplished.
873	869		SECTION 4. (a) If this Act does not receive a two-thirds
874	870		vote of all the members elected to each house, Subchapter C, Chapter
875	871		8052, Special District Local Laws Code, as added by Section 1 of
876	872		this Act, is amended by adding Section 8052.0307 to read as follows:
877	873		Sec. 8052.0307. NO EMINENT DOMAIN POWER. The district may
878	874		not exercise the power of eminent domain.
879	875		(b) This section is not intended to be an expression of a
880	876		legislative interpretation of the requirements of Section 17(c),
881	877		Article I, Texas Constitution.
882	878		SECTION 5. This Act takes effect immediately if it receives
883	879		a vote of two-thirds of all the members elected to each house, as
884	880		provided by Section 39, Article III, Texas Constitution. If this
885	881		Act does not receive the vote necessary for immediate effect, this
886	882		Act takes effect September 1, 2019.
