117 relating to the creation of the Montgomery County Management
128 District No. 1; providing authority to issue bonds; providing
139 authority to impose assessments, fees, and taxes.
1410 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1511 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1612 Code, is amended by adding Chapter 3979 to read as follows:
1713 CHAPTER 3979. MONTGOMERY COUNTY MANAGEMENT DISTRICT NO. 1
1814 SUBCHAPTER A. GENERAL PROVISIONS
1915 Sec. 3979.0101. DEFINITIONS. In this chapter:
2016 (1) "Board" means the district's board of directors.
2117 (2) "Commission" means the Texas Commission on
2218 Environmental Quality.
2319 (3) "County" means Montgomery County.
2420 (4) "Director" means a board member.
2521 (5) "District" means the Montgomery County Management
2622 District No. 1.
2723 Sec. 3979.0102. CREATION AND NATURE OF DISTRICT; IMMUNITY.
2824 (a) The district is a special district created under Section 59,
2925 Article XVI, Texas Constitution.
3026 (b) The district is a governmental unit, as provided by
3127 Section 375.004, Local Government Code.
3228 (c) This chapter does not waive any governmental or
3329 sovereign immunity from suit, liability, or judgment that would
3430 otherwise apply to the district.
3531 Sec. 3979.0103. PURPOSE; DECLARATION OF INTENT. (a) The
3632 creation of the district is essential to accomplish the purposes of
3733 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3834 Texas Constitution, and other public purposes stated in this
3935 chapter.
4036 (b) By creating the district, the legislature has
4137 established a program to accomplish the public purposes set out in
4238 Sections 52 and 52-a, Article III, Texas Constitution.
4339 (c) The creation of the district is necessary to promote,
4440 develop, encourage, and maintain employment, commerce,
4541 transportation, housing, tourism, recreation, the arts,
4642 entertainment, economic development, safety, and the public
4743 welfare in the district.
4844 (d) This chapter and the creation of the district may not be
4945 interpreted to relieve the county or a municipality from providing
5046 the level of services provided as of the effective date of the Act
5147 enacting this chapter to the area in the district. The district is
5248 created to supplement and not to supplant county or municipal
5349 services provided in the district.
5450 Sec. 3979.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
5551 (a) All land and other property included in the district will
5652 benefit from the improvements and services to be provided by the
5753 district under powers conferred by Sections 52 and 52-a, Article
5854 III, and Section 59, Article XVI, Texas Constitution, and other
5955 powers granted under this chapter.
6056 (b) The district is created to serve a public use and
6157 benefit.
6258 (c) The creation of the district is in the public interest
6359 and is essential to further the public purposes of:
6460 (1) developing and diversifying the economy of the
6561 state;
6662 (2) eliminating unemployment and underemployment; and
6763 (3) developing or expanding transportation and
6864 commerce.
6965 (d) The district will:
7066 (1) promote the health, safety, and general welfare of
7167 residents, employers, potential employees, employees, visitors,
7268 and consumers in the district, and of the public;
7369 (2) provide needed funding for the district to
7470 preserve, maintain, and enhance the economic health and vitality of
7571 the district territory as a community and business center;
7672 (3) promote the health, safety, welfare, and enjoyment
7773 of the public by providing pedestrian ways, road facilities,
7874 transit facilities, parking facilities, recreational facilities,
7975 and public art objects and by landscaping and developing certain
8076 areas in the district, which are necessary for the restoration,
8177 preservation, and enhancement of scenic beauty; and
8278 (4) provide for water, wastewater, and drainage
8379 facilities for the district.
8480 (e) Pedestrian ways along or across a street, whether at
8581 grade or above or below the surface, and street lighting, street
8682 landscaping, parking, and street art objects are parts of and
8783 necessary components of a street and are considered to be a street
8884 or road improvement.
8985 (f) The district will not act as the agent or
9086 instrumentality of any private interest even though the district
9187 will benefit many private interests as well as the public.
9288 Sec. 3979.0105. INITIAL DISTRICT TERRITORY. (a) The
9389 district is initially composed of the territory described by
9490 Section 2 of the Act enacting this chapter.
9591 (b) The boundaries and field notes contained in Section 2 of
9692 the Act enacting this chapter form a closure. A mistake in the
9793 field notes or in copying the field notes in the legislative process
9894 does not affect the district's:
9995 (1) organization, existence, or validity;
10096 (2) right to issue any type of bonds for the purposes
10197 for which the district is created or to pay the principal of and
10298 interest on the bonds;
10399 (3) right to impose or collect an assessment or tax; or
104100 (4) legality or operation.
105101 Sec. 3979.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
106102 All or any part of the area of the district is eligible to be
107103 included in:
108104 (1) a tax increment reinvestment zone created under
109105 Chapter 311, Tax Code;
110106 (2) a tax abatement reinvestment zone created under
111107 Chapter 312, Tax Code;
112108 (3) an enterprise zone created under Chapter 2303,
113109 Government Code; or
114110 (4) an industrial district created under Chapter 42,
115111 Local Government Code.
116112 Sec. 3979.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
117113 DISTRICTS LAW. Except as otherwise provided by this chapter,
118114 Chapter 375, Local Government Code, applies to the district.
119115 Sec. 3979.0108. LIBERAL CONSTRUCTION OF CHAPTER. This
120116 chapter shall be liberally construed in conformity with the
121117 findings and purposes stated in this chapter.
122118 Sec. 3979.0109. CONFLICTS OF LAW. This chapter prevails
123119 over any provision of general law, including a provision of Chapter
124120 375, Local Government Code, or Chapter 49, Water Code, that is in
125121 conflict or inconsistent with this chapter.
126122 SUBCHAPTER B. BOARD OF DIRECTORS
127- Sec. 3979.0201. GOVERNING BODY; TERMS. (a) The district
128- is governed by a board of five directors elected or appointed as

134130 provided by Section 49.060, Water Code. Sections 375.069 and
135131 375.070, Local Government Code, do not apply to the board.
136132 Sec. 3979.0203. TEMPORARY DIRECTORS. (a) On or after the
137133 effective date of the Act enacting this chapter, the owner or owners
138134 of a majority of the assessed value of the real property in the
139135 district according to the most recent certified tax appraisal roll
140136 for the county may submit a petition to the commission requesting
141137 that the commission appoint as temporary directors the five persons
142138 named in the petition. The commission shall appoint as temporary
143139 directors the five persons named in the petition.
144140 (b) The temporary directors shall hold an election to elect
145141 five permanent directors as provided by Section 49.102, Water Code.
146142 (c) Temporary directors serve until the earlier of:
147143 (1) the date permanent directors are elected under
148144 Subsection (b); or
149145 (2) the fourth anniversary of the effective date of
150146 the Act enacting this chapter.
151147 (d) If permanent directors have not been elected under
152148 Subsection (b) and the terms of the temporary directors have
153149 expired, successor temporary directors shall be appointed or
154150 reappointed as provided by Subsection (e) to serve terms that
155151 expire on the earlier of:
156152 (1) the date permanent directors are elected under
157153 Subsection (b); or
158154 (2) the fourth anniversary of the date of the
159155 appointment or reappointment.
160156 (e) If Subsection (d) applies, the owner or owners of a
161157 majority of the assessed value of the real property in the district
162158 according to the most recent certified tax appraisal roll for the
163159 county may submit a petition to the commission requesting that the
164160 commission appoint as successor temporary directors the five
165161 persons named in the petition. The commission shall appoint as
166162 successor temporary directors the five persons named in the
167163 petition.
168164 Sec. 3979.0204. DISQUALIFICATION OF DIRECTORS. Section
169165 49.052, Water Code, applies to the members of the board.
170166 SUBCHAPTER C. POWERS AND DUTIES
171167 Sec. 3979.0301. GENERAL POWERS AND DUTIES. The district
172168 has the powers and duties necessary to accomplish the purposes for
173169 which the district is created.
174- Sec. 3979.0302. IMPROVEMENT PROJECTS AND SERVICES.
175- (a) The district, using any money available to the district for
176- the purpose, may provide, design, construct, acquire, improve,

185181 Sec. 3979.0303. RECREATIONAL FACILITIES. The district may
186182 develop or finance recreational facilities as authorized by Chapter
187183 375, Local Government Code, Sections 52 and 52-a, Article III,
188184 Texas Constitution, Section 59, Article XVI, Texas Constitution,
189185 and any other law that applies to the district.
190186 Sec. 3979.0304. AUTHORITY FOR ROAD PROJECTS. Under Section
191187 52, Article III, Texas Constitution, the district may own, operate,
192188 maintain, design, acquire, construct, finance, issue bonds, notes,
193189 or other obligations for, improve, and convey to this state, a
194190 county, or a municipality for ownership, operation, and maintenance
195191 macadamized, graveled, or paved roads or improvements, including
196192 storm drainage, in aid of those roads.
197193 Sec. 3979.0305. CONVEYANCE AND APPROVAL OF ROAD PROJECT.
198194 (a) The district may convey a road project authorized by Section
199195 3979.0304 to:
200196 (1) a municipality or county that will operate and
201197 maintain the road if the municipality or county has approved the
202198 plans and specifications of the road project; or
203199 (2) the state if the state will operate and maintain
204200 the road and the Texas Transportation Commission has approved the
205201 plans and specifications of the road project.
206202 (b) Except as provided by Subsection (c), the district shall
207203 operate and maintain a road project authorized by Section 3979.0304
208204 that the district implements and does not convey to a municipality,
209205 a county, or this state under Subsection (a).
210206 (c) The district may agree in writing with a municipality, a
211207 county, or this state to assign operation and maintenance duties to
212208 the district, the municipality, the county, or this state in a
213209 manner other than the manner described in Subsections (a) and (b).
214210 Sec. 3979.0306. NONPROFIT CORPORATION. (a) The board by
215211 resolution may authorize the creation of a nonprofit corporation to
216212 assist and act for the district in implementing a project or
217213 providing a service authorized by this chapter.
218214 (b) The nonprofit corporation:
219215 (1) has each power of and is considered to be a local
220216 government corporation created under Subchapter D, Chapter 431,
221217 Transportation Code; and
222218 (2) may implement any project and provide any service
223219 authorized by this chapter.
224220 (c) The board shall appoint the board of directors of the
225221 nonprofit corporation. The board of directors of the nonprofit
226222 corporation shall serve in the same manner as the board of directors
227223 of a local government corporation created under Subchapter D,
228224 Chapter 431, Transportation Code, except that a board member is not
229225 required to reside in the district.
230226 Sec. 3979.0307. LAW ENFORCEMENT SERVICES. Section 49.216,
231227 Water Code, applies to the district.
232228 Sec. 3979.0308. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
233229 The district may join and pay dues to a charitable or nonprofit
234230 organization that performs a service or provides an activity
235231 consistent with the furtherance of a district purpose.
236232 Sec. 3979.0309. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
237233 district may engage in activities that accomplish the economic
238234 development purposes of the district.
239235 (b) The district may establish and provide for the
240236 administration of one or more programs to promote state or local
241237 economic development and to stimulate business and commercial
242238 activity in the district, including programs to:
243239 (1) make loans and grants of public money; and
244240 (2) provide district personnel and services.
245241 (c) The district may create economic development programs
246242 and exercise the economic development powers that:
247243 (1) Chapter 380, Local Government Code, provides to a
248244 municipality; and
249245 (2) Subchapter A, Chapter 1509, Government Code,
250246 provides to a municipality.
251247 Sec. 3979.0310. STRATEGIC PARTNERSHIP AGREEMENT. The
252248 district may negotiate and enter into a written strategic
253249 partnership agreement with a municipality under Section 43.0751,
254250 Local Government Code.
255251 Sec. 3979.0311. REGIONAL PARTICIPATION AGREEMENT. The
256252 district may negotiate and enter into a written regional
257253 participation agreement with a municipality under Section 43.0754,
258254 Local Government Code.
259255 Sec. 3979.0312. PARKING FACILITIES. (a) The district may
260256 acquire, lease as lessor or lessee, construct, develop, own,
261257 operate, and maintain parking facilities or a system of parking
262258 facilities, including lots, garages, parking terminals, or other
263259 structures or accommodations for parking motor vehicles off the
264260 streets and related appurtenances.
265261 (b) The district's parking facilities serve the public
266262 purposes of the district and are owned, used, and held for a public
267263 purpose even if leased or operated by a private entity for a term of
268264 years.
269265 (c) The district's parking facilities are parts of and
270266 necessary components of a street and are considered to be a street
271267 or road improvement.
272268 (d) The development and operation of the district's parking
273269 facilities may be considered an economic development program.
274- Sec. 3979.0313. ADDING OR EXCLUDING LAND. (a) The
275- district may add land as provided by Subchapter J, Chapter 49, Water
276- Code.

280275 (c) The district may include and exclude land as provided by
281276 Sections 54.739-54.747, Water Code. A reference in those sections
282277 to a "tax" means an ad valorem tax for the purposes of this
283278 subsection.
284279 (d) If the district adopts a sales and use tax authorized at
285280 an election held under Section 3979.0602 and subsequently includes
286281 new territory in the district under this section, the district:
287282 (1) is not required to hold another election to
288283 approve the imposition of the sales and use tax in the included
289284 territory; and
290285 (2) shall impose the sales and use tax in the included
291286 territory as provided by Chapter 321, Tax Code.
292287 (e) If the district adopts a sales and use tax authorized at
293288 an election held under Section 3979.0602 and subsequently excludes
294289 territory in the district under this section, the sales and use tax
295290 is inapplicable to the excluded territory, as provided by Chapter
296291 321, Tax Code, but is applicable to the territory remaining in the
297292 district.
298293 Sec. 3979.0314. DISBURSEMENTS AND TRANSFERS OF MONEY. The
299294 board by resolution shall establish the number of directors'
300295 signatures and the procedure required for a disbursement or
301296 transfer of district money.
302297 Sec. 3979.0315. AUDIT EXEMPTION. (a) The district may
303298 elect to complete an annual financial report in lieu of an annual
304299 audit under Section 375.096(a)(6), Local Government Code, if:
305300 (1) the district had no bonds or other long-term (more
306301 than one year) liabilities outstanding during the fiscal period;
307302 (2) the district did not have gross receipts from
308303 operations, loans, taxes, assessments, or contributions in excess
309304 of $250,000 during the fiscal period; and
310305 (3) the district's cash and temporary investments were
311306 not in excess of $250,000 during the fiscal period.
312307 (b) Each annual financial report prepared in accordance
313308 with this section must be open to public inspection and accompanied
314309 by an affidavit signed by a duly authorized representative of the
315310 district attesting to the accuracy and authenticity of the
316311 financial report.
317312 (c) The annual financial report and affidavit shall be
318313 substantially similar in form to the annual financial report and
319314 affidavit forms prescribed by the executive director of the
320315 commission under Section 49.198, Water Code.
321316 Sec. 3979.0316. NO EMINENT DOMAIN POWER. The district may
322317 not exercise the power of eminent domain.
323318 SUBCHAPTER D. ASSESSMENTS
324319 Sec. 3979.0401. PETITION REQUIRED FOR FINANCING SERVICES
325- AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance
326- a service or improvement project with assessments under this
327- chapter unless a written petition requesting that service or
328- improvement has been filed with the board.

332327 certified tax appraisal roll for the county.
333328 Sec. 3979.0402. METHOD OF NOTICE FOR HEARING. The district
334329 may mail the notice required by Section 375.115(c), Local
335330 Government Code, by certified or first class United States mail.
336331 The board shall determine the method of notice.
337- Sec. 3979.0403. ASSESSMENTS; LIENS FOR ASSESSMENTS.
338- (a) The board by resolution may impose and collect an assessment
339- for any purpose authorized by this chapter in all or any part of the

341336 (b) An assessment, a reassessment, or an assessment
342337 resulting from an addition to or correction of the assessment roll
343338 by the district, penalties and interest on an assessment or
344339 reassessment, an expense of collection, and reasonable attorney's
345340 fees incurred by the district:
346341 (1) are a first and prior lien against the property
347342 assessed;
348343 (2) are superior to any other lien or claim other than
349344 a lien or claim for county, school district, or municipal ad valorem
350345 taxes; and
351346 (3) are the personal liability of and a charge against
352347 the owners of the property even if the owners are not named in the
353348 assessment proceedings.
354349 (c) The lien is effective from the date of the board's
355350 resolution imposing the assessment until the date the assessment is
356351 paid. The board may enforce the lien in the same manner that the
357352 board may enforce an ad valorem tax lien against real property.
358353 (d) The board may make a correction to or deletion from the
359354 assessment roll that does not increase the amount of assessment of
360355 any parcel of land without providing notice and holding a hearing in
361356 the manner required for additional assessments.
362357 SUBCHAPTER E. TAXES AND BONDS
363358 Sec. 3979.0501. TAX ELECTION REQUIRED. The district must
364359 hold an election in the manner provided by Chapter 49, Water Code,
365360 or, if applicable, Chapter 375, Local Government Code, to obtain
366361 voter approval before the district may impose an ad valorem tax.
367362 Sec. 3979.0502. OPERATION AND MAINTENANCE TAX. (a) If
368363 authorized by a majority of the district voters voting at an
369364 election under Section 3979.0501, the district may impose an
370365 operation and maintenance tax on taxable property in the district
371366 in the manner provided by Section 49.107, Water Code, for any
372367 district purpose, including to:
373368 (1) maintain and operate the district;
374369 (2) construct or acquire improvements; or
375370 (3) provide a service.
376371 (b) The board shall determine the operation and maintenance
377372 tax rate. The rate may not exceed the rate approved at the
378373 election.
379374 (c) Section 49.107(h), Water Code, does not apply to the
380375 district.
381376 Sec. 3979.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
382377 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
383378 terms determined by the board.
384379 (b) The district, by competitive bid or negotiated sale, may
385380 issue bonds, notes, or other obligations payable wholly or partly
386381 from ad valorem taxes, assessments, impact fees, revenue, contract
387382 payments, grants, or other district money, or any combination of
388383 those sources of money, to pay for any authorized district purpose.
389384 (c) The limitation on the outstanding principal amount of
390385 bonds, notes, or other obligations provided by Section 49.4645,
391386 Water Code, does not apply to the district.
392387 Sec. 3979.0504. BONDS SECURED BY REVENUE OR CONTRACT
393388 PAYMENTS. The district may issue, without an election, bonds
394389 secured by:
395390 (1) revenue other than ad valorem taxes, including
396391 contract revenues; or
397392 (2) contract payments, provided that the requirements
398393 of Section 49.108, Water Code, have been met.
399394 Sec. 3979.0505. BONDS SECURED BY AD VALOREM TAXES;
400395 ELECTIONS. (a) If authorized at an election under Section
401396 3979.0501, the district may issue bonds payable from ad valorem
402397 taxes.
403398 (b) Section 375.243, Local Government Code, does not apply
404399 to the district.
405400 (c) At the time the district issues bonds payable wholly or
406401 partly from ad valorem taxes, the board shall provide for the annual
407402 imposition of a continuing direct annual ad valorem tax, without
408403 limit as to rate or amount, for each year that all or part of the
409404 bonds are outstanding as required and in the manner provided by
410405 Sections 54.601 and 54.602, Water Code.
411406 (d) All or any part of any facilities or improvements that
412407 may be acquired by a district by the issuance of its bonds may be
413408 submitted as a single proposition or as several propositions to be
414409 voted on at the election.
415410 Sec. 3979.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
416411 board may not issue bonds until each municipality in whose
417412 corporate limits or extraterritorial jurisdiction the district is
418413 located has consented by ordinance or resolution to the creation of
419414 the district and to the inclusion of land in the district.
420415 (b) This section applies only to the district's first
421416 issuance of bonds payable from ad valorem taxes.
422417 SUBCHAPTER F. SALES AND USE TAX
423418 Sec. 3979.0601. APPLICABILITY OF CERTAIN TAX CODE
424419 PROVISIONS. (a) Chapter 321, Tax Code, governs the imposition,
425420 computation, administration, enforcement, and collection of the
426421 sales and use tax authorized by this subchapter except to the extent
427422 Chapter 321, Tax Code, is inconsistent with this chapter.
428423 (b) A reference in Chapter 321, Tax Code, to a municipality
429424 or the governing body of a municipality is a reference to the
430425 district or the board, respectively.
431426 Sec. 3979.0602. ELECTION; ADOPTION OF TAX. (a) The
432427 district may adopt a sales and use tax if authorized by a majority
433428 of the voters of the district voting at an election held for that
434429 purpose.
435430 (b) The board by order may call an election to authorize the
436431 adoption of the sales and use tax. The election may be held on any
437432 uniform election date and in conjunction with any other district
438433 election.
439434 (c) The ballot shall be printed to provide for voting for or
440435 against the proposition: "Authorization of a sales and use tax in
441436 the Montgomery County Management District No. 1 at a rate not to
442437 exceed ____ percent" (insert rate of one or more increments of
443438 one-eighth of one percent).
444- Sec. 3979.0603. SALES AND USE TAX RATE. (a) On or after
445- the date the results are declared of an election held under Section

450445 (b) After the election held under Section 3979.0602, the
451446 board may increase or decrease the rate of the tax by one or more
452447 increments of one-eighth of one percent.
453448 (c) The initial rate of the tax or any rate resulting from
454449 subsequent increases or decreases may not exceed the lesser of:
455450 (1) the maximum rate authorized by the district voters
456451 at the election held under Section 3979.0602; or
457452 (2) a rate that, when added to the rates of all sales
458453 and use taxes imposed by other political subdivisions with
459454 territory in the district, would result in the maximum combined
460455 rate prescribed by Section 321.101(f), Tax Code, at any location in
461456 the district.
462457 Sec. 3979.0604. TAX AFTER MUNICIPAL ANNEXATION. (a) This
463458 section applies to the district after a municipality annexes part
464459 of the territory in the district and imposes the municipality's
465460 sales and use tax in the annexed territory.
466461 (b) If at the time of annexation the district has
467462 outstanding debt or other obligations payable wholly or partly from
468463 district sales and use tax revenue, Section 321.102(g), Tax Code,
469464 applies to the district.
470465 (c) If at the time of annexation the district does not have
471466 outstanding debt or other obligations payable wholly or partly from
472467 district sales and use tax revenue, the district may:
473468 (1) exclude the annexed territory from the district,
474469 if the district has no outstanding debt or other obligations
475470 payable from any source; or
476471 (2) reduce the sales and use tax in the annexed
477472 territory by resolution or order of the board to a rate that, when
478473 added to the sales and use tax rate imposed by the municipality in
479474 the annexed territory, is equal to the sales and use tax rate
480475 imposed by the district in the district territory that was not
481476 annexed by the municipality.
482477 Sec. 3979.0605. NOTIFICATION OF RATE CHANGE. The board
483478 shall notify the comptroller of any changes made to the tax rate
484479 under this subchapter in the same manner the municipal secretary
485480 provides notice to the comptroller under Section 321.405(b), Tax
486481 Code.
487482 Sec. 3979.0606. USE OF REVENUE. Revenue from the sales and
488483 use tax imposed under this subchapter is for the use and benefit of
489484 the district and may be used for any district purpose. The district
490485 may pledge all or part of the revenue to the payment of bonds,
491486 notes, or other obligations, and that pledge of revenue may be in
492487 combination with other revenue, including tax revenue, available to
493488 the district.
494489 Sec. 3979.0607. ABOLITION OF TAX. (a) Except as provided
495490 by Subsection (b), the board may abolish the tax imposed under this
496491 subchapter without an election.
497492 (b) The board may not abolish the tax imposed under this
498493 subchapter if the district has outstanding debt secured by the tax,
499494 and repayment of the debt would be impaired by the abolition of the
500495 tax.
501496 (c) If the board abolishes the tax, the board shall notify
502497 the comptroller of that action in the same manner the municipal
503498 secretary provides notice to the comptroller under Section
504499 321.405(b), Tax Code.
505500 (d) If the board abolishes the tax or decreases the tax rate
506501 to zero, a new election to authorize a sales and use tax must be held
507502 under Section 3979.0602 before the district may subsequently impose
508503 the tax.
509504 (e) This section does not apply to a decrease in the sales
510505 and use tax authorized under Section 3979.0604(c)(2).
511506 SUBCHAPTER G. HOTEL OCCUPANCY TAX
512507 Sec. 3979.0701. DEFINITION. In this subchapter, "hotel"
513508 has the meaning assigned by Section 156.001, Tax Code.
514509 Sec. 3979.0702. APPLICABILITY OF CERTAIN TAX CODE
515510 PROVISIONS. (a) For purposes of this subchapter:
516511 (1) a reference in Subchapter A, Chapter 352, Tax
517512 Code, to a county is a reference to the district; and
518513 (2) a reference in Subchapter A, Chapter 352, Tax
519514 Code, to the commissioners court is a reference to the board.
520515 (b) Except as inconsistent with this subchapter, Subchapter
521516 A, Chapter 352, Tax Code, governs a hotel occupancy tax authorized
522517 by this subchapter, including the collection of the tax, subject to
523518 the limitations prescribed by Sections 352.002(b) and (c), Tax
524519 Code.
525520 Sec. 3979.0703. TAX AUTHORIZED; USE OF REVENUE. The
526521 district may impose a hotel occupancy tax for any purpose described
527522 by Section 351.101 or 352.101, Tax Code.
528523 Sec. 3979.0704. TAX RATE. (a) The amount of the hotel
529524 occupancy tax may not exceed the lesser of:
530525 (1) the maximum rate prescribed by Section 352.003(a),
531526 Tax Code; or
532527 (2) a rate that, when added to the rates of all hotel
533528 occupancy taxes imposed by other political subdivisions with
534529 territory in the district and by this state, does not exceed the sum
535530 of the rate prescribed by Section 351.0025(b), Tax Code, plus two
536531 percent.
537532 (b) The district tax is in addition to a tax imposed by a
538533 municipality under Chapter 351, Tax Code, or by the county under
539534 Chapter 352, Tax Code.
540535 Sec. 3979.0705. INFORMATION. The district may examine and
541536 receive information related to the imposition of hotel occupancy
542537 taxes to the same extent as if the district were a county.
543538 Sec. 3979.0706. USE OF REVENUE. The district may use
544539 revenue from the hotel occupancy tax for any district purpose that
545540 is an authorized use of hotel occupancy tax revenue under Chapter
546541 351 or 352, Tax Code. The district may pledge all or part of the
547542 revenue to the payment of bonds, notes, or other obligations and
548543 that pledge of revenue may be in combination with other revenue
549544 available to the district.
550545 Sec. 3979.0707. ABOLITION OF TAX. (a) Except as provided
551546 by Subsection (b), the board may abolish the tax imposed under this
552547 subchapter.
553548 (b) The board may not abolish the tax imposed under this
554549 subchapter if the district has outstanding debt secured by the tax,
555550 and repayment of the debt would be impaired by the abolition of the
556551 tax.
557552 SUBCHAPTER I. DISSOLUTION BY BOARD
558553 Sec. 3979.0901. DISSOLUTION OF DISTRICT WITH OUTSTANDING
559554 DEBT. (a) The board may dissolve the district regardless of
560555 whether the district has debt. Section 375.264, Local Government
561556 Code, does not apply to the district.
562557 (b) If the district has debt when it is dissolved, the
563558 district shall remain in existence solely for the purpose of
564559 discharging its debts. The dissolution is effective when all debts
565560 have been discharged.

11681163 Act takes effect September 1, 2019.
