8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 16 | | SECTION 1. Subchapter E, Chapter 531, Government Code, is |
---|
10 | 17 | | amended by adding Section 531.172 to read as follows: |
---|
11 | 18 | | Sec. 531.172. MEDICAID WAIVER LEGISLATIVE OVERSIGHT |
---|
12 | 19 | | COMMITTEE. (a) In this section: |
---|
13 | 20 | | (1) "Committee" means the Medicaid Waiver Legislative |
---|
14 | 21 | | Oversight Committee established under this section. |
---|
15 | 22 | | (2) "Section 1115 waiver" means the Texas Healthcare |
---|
16 | 23 | | Transformation and Quality Improvement Program waiver under |
---|
17 | 24 | | Section 1115 of the federal Social Security Act (42 U.S.C. Section |
---|
18 | 25 | | 1315). |
---|
19 | 26 | | (b) The Medicaid Waiver Legislative Oversight Committee is |
---|
20 | 27 | | created to oversee and advise the commission regarding the Section |
---|
21 | 28 | | 1115 waiver and the commission's negotiations with the Centers for |
---|
22 | 29 | | Medicare and Medicaid Services or other appropriate federal agency |
---|
23 | 30 | | to renew the waiver, including the extension or renewal of the |
---|
24 | 31 | | uncompensated care pool and the transition plan for the delivery |
---|
25 | 32 | | system that will succeed the Delivery System Reform Incentive |
---|
26 | 33 | | Payment (DSRIP) program. |
---|
27 | 34 | | (c) The committee is composed of eight members, as follows: |
---|
28 | 35 | | (1) four members of the senate, appointed by the |
---|
29 | 36 | | lieutenant governor; and |
---|
30 | 37 | | (2) four members of the house of representatives, |
---|
31 | 38 | | appointed by the speaker of the house of representatives. |
---|
32 | 39 | | (d) A member of the committee serves at the pleasure of the |
---|
33 | 40 | | appointing official. |
---|
34 | 41 | | (e) The lieutenant governor and the speaker of the house of |
---|
35 | 42 | | representatives shall each designate a co-chair from among the |
---|
36 | 43 | | committee members. |
---|
37 | 44 | | (f) A member of the committee may not receive compensation |
---|
38 | 45 | | for serving on the committee but is entitled to reimbursement for |
---|
39 | 46 | | travel expenses incurred by the member while conducting the |
---|
40 | 47 | | business of the committee as provided by the General Appropriations |
---|
41 | 48 | | Act. |
---|
42 | 49 | | (g) The committee shall: |
---|
43 | 50 | | (1) oversee the Section 1115 waiver and facilitate the |
---|
44 | 51 | | design and development of the renewed waiver; |
---|
45 | 52 | | (2) meet at the call of the co-chairs; and |
---|
46 | 53 | | (3) research, take public testimony, and issue reports |
---|
47 | 54 | | requested by the lieutenant governor or speaker of the house of |
---|
48 | 55 | | representatives. |
---|
49 | 56 | | (h) The committee may request reports and other information |
---|
50 | 57 | | from the commission. |
---|
51 | 58 | | (i) The committee shall use existing staff of the senate, |
---|
52 | 59 | | the house of representatives, and the Texas Legislative Council to |
---|
53 | 60 | | assist the committee in performing its duties under this section. |
---|
54 | 61 | | (j) On September 1, 2023, the committee is abolished and |
---|
55 | 62 | | this section expires. |
---|
56 | 63 | | SECTION 2. Not later than October 1, 2019, the lieutenant |
---|
57 | 64 | | governor and the speaker of the house of representatives shall |
---|
58 | 65 | | appoint the members of the Medicaid Waiver Legislative Oversight |
---|
59 | 66 | | Committee as required by Section 531.172(c), Government Code, as |
---|
60 | 67 | | added by this Act. |
---|
61 | 68 | | SECTION 3. This Act takes effect immediately if it receives |
---|
62 | 69 | | a vote of two-thirds of all the members elected to each house, as |
---|
63 | 70 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
64 | 71 | | Act does not receive the vote necessary for immediate effect, this |
---|
65 | 72 | | Act takes effect September 1, 2019. |
