| 12 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 10 | | SECTION 1. Subtitle D, Title 2, Labor Code, is amended by |
|---|
| 14 | 11 | | adding Chapter 83 to read as follows: |
|---|
| 15 | 12 | | CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF CERTAIN |
|---|
| 16 | 13 | | EMPLOYMENT PRACTICES |
|---|
| 17 | 14 | | Sec. 83.001. DEFINITIONS. In this chapter: |
|---|
| 18 | 15 | | (1) "Employee" means an individual who is employed by |
|---|
| 19 | 16 | | an employer for compensation. |
|---|
| 20 | 17 | | (2) "Employer" means a person who employs one or more |
|---|
| 21 | 18 | | employees. |
|---|
| 22 | 19 | | Sec. 83.002. LOCAL REGULATION OF EMPLOYER SCHEDULING |
|---|
| 23 | 20 | | PRACTICES OR OVERTIME COMPENSATION PROHIBITED. (a) A political |
|---|
| 24 | 21 | | subdivision of this state may not adopt or enforce an ordinance, |
|---|
| 25 | 22 | | order, rule, regulation, or policy regulating a private employer's |
|---|
| 26 | 23 | | terms of employment relating to scheduling practices or overtime |
|---|
| 27 | 24 | | compensation. |
|---|
| 28 | 25 | | (b) An ordinance, order, rule, regulation, or policy that |
|---|
| 29 | 26 | | violates Subsection (a) is void and unenforceable. |
|---|
| 30 | | - | Sec. 83.003. EFFECT OF CHAPTER. This chapter does not |
|---|
| 31 | | - | affect: |
|---|
| 32 | | - | (1) the Texas Minimum Wage Act under Chapter 62; or |
|---|
| 33 | | - | (2) an ordinance, order, rule, regulation, or policy |
|---|
| 34 | | - | that prohibits employment discrimination, regardless of whether |
|---|
| 35 | | - | the ordinance, order, rule, regulation, or policy is adopted |
|---|
| 36 | | - | before, on, or after September 1, 2019. |
|---|
| 37 | 27 | | SECTION 2. Chapter 83, Labor Code, as added by this Act, |
|---|
| 38 | 28 | | applies to an ordinance, order, rule, regulation, or policy adopted |
|---|
| 39 | 29 | | before, on, or after the effective date of this Act. |

| 40 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
