96 relating to a prohibition against certain local regulation of the
107 scheduling and overtime compensation practices of private

129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Subtitle D, Title 2, Labor Code, is amended by
1411 adding Chapter 83 to read as follows:
1512 CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF CERTAIN
1613 EMPLOYMENT PRACTICES
1714 Sec. 83.001. DEFINITIONS. In this chapter:
1815 (1) "Employee" means an individual who is employed by
1916 an employer for compensation.
2017 (2) "Employer" means a person who employs one or more
2118 employees.
2219 Sec. 83.002. LOCAL REGULATION OF EMPLOYER SCHEDULING
2320 PRACTICES OR OVERTIME COMPENSATION PROHIBITED. (a) A political
2421 subdivision of this state may not adopt or enforce an ordinance,
2522 order, rule, regulation, or policy regulating a private employer's
2623 terms of employment relating to scheduling practices or overtime
2724 compensation.
2825 (b) An ordinance, order, rule, regulation, or policy that
2926 violates Subsection (a) is void and unenforceable.
30- Sec. 83.003. EFFECT OF CHAPTER. This chapter does not
31- affect:
32- (1) the Texas Minimum Wage Act under Chapter 62; or
33- (2) an ordinance, order, rule, regulation, or policy
34- that prohibits employment discrimination, regardless of whether
35- the ordinance, order, rule, regulation, or policy is adopted
36- before, on, or after September 1, 2019.
3727 SECTION 2. Chapter 83, Labor Code, as added by this Act,
3828 applies to an ordinance, order, rule, regulation, or policy adopted
3929 before, on, or after the effective date of this Act.
4030 SECTION 3. This Act takes effect September 1, 2019.
