66 AN ACT
77 relating to the creation of the Harris-Waller Counties Municipal
88 Utility District No. 4; granting a limited power of eminent domain;
99 providing authority to issue bonds; providing authority to impose
1010 assessments, fees, and taxes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1313 Code, is amended by adding Chapter 8047 to read as follows:
1414 CHAPTER 8047. HARRIS-WALLER COUNTIES MUNICIPAL UTILITY DISTRICT

1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 8047.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "Commission" means the Texas Commission on
2020 Environmental Quality.
2121 (3) "Director" means a board member.
2222 (4) "District" means the Harris-Waller Counties
2323 Municipal Utility District No. 4.
2424 Sec. 8047.0102. NATURE OF DISTRICT. The district is a
2525 municipal utility district created under Section 59, Article XVI,
2626 Texas Constitution.
2727 Sec. 8047.0103. CONFIRMATION AND DIRECTOR ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect five permanent
3030 directors as provided by Section 49.102, Water Code.
3131 Sec. 8047.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3232 temporary directors may not hold an election under Section
3333 8047.0103 until each municipality in whose corporate limits or
3434 extraterritorial jurisdiction the district is located has
3535 consented by ordinance or resolution to the creation of the
3636 district and to the inclusion of land in the district.
3737 Sec. 8047.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3838 (a) The district is created to serve a public purpose and benefit.
3939 (b) The district is created to accomplish the purposes of:
4040 (1) a municipal utility district as provided by
4141 general law and Section 59, Article XVI, Texas Constitution; and
4242 (2) Section 52, Article III, Texas Constitution, that
4343 relate to the construction, acquisition, improvement, operation,
4444 or maintenance of macadamized, graveled, or paved roads, or
4545 improvements, including storm drainage, in aid of those roads.
4646 Sec. 8047.0106. INITIAL DISTRICT TERRITORY. (a) The
4747 district is initially composed of the territory described by
4848 Section 2 of the Act enacting this chapter.
4949 (b) The boundaries and field notes contained in Section 2 of
5050 the Act enacting this chapter form a closure. A mistake made in the
5151 field notes or in copying the field notes in the legislative process
5252 does not affect the district's:
5353 (1) organization, existence, or validity;
5454 (2) right to issue any type of bond for the purposes
5555 for which the district is created or to pay the principal of and
5656 interest on a bond;
5757 (3) right to impose a tax; or
5858 (4) legality or operation.
5959 SUBCHAPTER B. BOARD OF DIRECTORS
6060 Sec. 8047.0201. GOVERNING BODY; TERMS. (a) The district is
6161 governed by a board of five elected directors.
6262 (b) Except as provided by Section 8047.0202, directors
6363 serve staggered four-year terms.
6464 Sec. 8047.0202. TEMPORARY DIRECTORS. (a) The temporary
6565 board consists of:
6666 (1) Ruth Delaney;
6767 (2) Tracy Butcher;
6868 (3) Erica Tabrizi;
6969 (4) Virginia Bryant; and
7070 (5) Way Denkler.
7171 (b) Temporary directors serve until the earlier of:
7272 (1) the date permanent directors are elected under
7373 Section 8047.0103; or
7474 (2) the fourth anniversary of the effective date of
7575 the Act enacting this chapter.
7676 (c) If permanent directors have not been elected under
7777 Section 8047.0103 and the terms of the temporary directors have
7878 expired, successor temporary directors shall be appointed or
7979 reappointed as provided by Subsection (d) to serve terms that
8080 expire on the earlier of:
8181 (1) the date permanent directors are elected under
8282 Section 8047.0103; or
8383 (2) the fourth anniversary of the date of the
8484 appointment or reappointment.
8585 (d) If Subsection (c) applies, the owner or owners of a
8686 majority of the assessed value of the real property in the district
8787 may submit a petition to the commission requesting that the
8888 commission appoint as successor temporary directors the five
8989 persons named in the petition. The commission shall appoint as
9090 successor temporary directors the five persons named in the
9191 petition.
9292 SUBCHAPTER C. POWERS AND DUTIES
9393 Sec. 8047.0301. GENERAL POWERS AND DUTIES. The district
9494 has the powers and duties necessary to accomplish the purposes for
9595 which the district is created.
9696 Sec. 8047.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
9797 DUTIES. The district has the powers and duties provided by the
9898 general law of this state, including Chapters 49 and 54, Water Code,
9999 applicable to municipal utility districts created under Section 59,
100100 Article XVI, Texas Constitution.
101101 Sec. 8047.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
102102 52, Article III, Texas Constitution, the district may design,
103103 acquire, construct, finance, issue bonds for, improve, operate,
104104 maintain, and convey to this state, a county, or a municipality for
105105 operation and maintenance macadamized, graveled, or paved roads, or
106106 improvements, including storm drainage, in aid of those roads.
107107 Sec. 8047.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
108108 road project must meet all applicable construction standards,
109109 zoning and subdivision requirements, and regulations of each
110110 municipality in whose corporate limits or extraterritorial
111111 jurisdiction the road project is located.
112112 (b) If a road project is not located in the corporate limits
113113 or extraterritorial jurisdiction of a municipality, the road
114114 project must meet all applicable construction standards,
115115 subdivision requirements, and regulations of each county in which
116116 the road project is located.
117117 (c) If the state will maintain and operate the road, the
118118 Texas Transportation Commission must approve the plans and
119119 specifications of the road project.
120120 Sec. 8047.0305. COMPLIANCE WITH MUNICIPAL CONSENT
121121 ORDINANCE OR RESOLUTION. The district shall comply with all
122122 applicable requirements of any ordinance or resolution that is
123123 adopted under Section 54.016 or 54.0165, Water Code, and that
124124 consents to the creation of the district or to the inclusion of land
125125 in the district.
126126 Sec. 8047.0306. DIVISION OF DISTRICT. (a) The district may
127127 be divided into two or more new districts only if:
128128 (1) the district has no outstanding bonded debt; and
129129 (2) the district is not imposing ad valorem taxes.
130130 (b) This chapter applies to any new district created by the
131131 division of the district, and a new district has all the powers and
132132 duties of the district.
133133 (c) Any new district created by the division of the district
134134 may not, at the time the new district is created, contain any land
135135 outside the area described by Section 2 of the Act enacting this
136136 chapter.
137137 (d) The board, on its own motion or on receipt of a petition
138138 signed by the owner or owners of a majority of the assessed value of
139139 the real property in the district, may adopt an order dividing the
140140 district.
141141 (e) The board may adopt an order dividing the district
142142 before or after the date the board holds an election under Section
143143 8047.0103 to confirm the creation of the district.
144144 (f) An order dividing the district shall:
145145 (1) name each new district;
146146 (2) include the metes and bounds description of the
147147 territory of each new district;
148148 (3) appoint temporary directors for each new district;
149149 and
150150 (4) provide for the division of assets and liabilities
151151 between or among the new districts.
152152 (g) On or before the 30th day after the date of adoption of
153153 an order dividing the district, the district shall file the order
154154 with the commission and record the order in the real property
155155 records of each county in which the district is located.
156156 (h) Any new district created by the division of the district
157157 shall hold a confirmation and directors' election as required by
158158 Section 8047.0103.
159159 (i) If the creation of the new district is confirmed, the
160160 new district shall provide the election date and results to the
161161 commission.
162162 (j) Any new district created by the division of the district
163163 must hold an election as required by this chapter to obtain voter
164164 approval before the district may impose a maintenance tax or issue
165165 bonds payable wholly or partly from ad valorem taxes.
166166 (k) Municipal consent to the creation of the district and to
167167 the inclusion of land in the district granted under Section
168168 8047.0104 acts as municipal consent to the creation of any new
169169 district created by the division of the district and to the
170170 inclusion of land in the new district.
171171 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
172172 Sec. 8047.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
173173 The district may issue, without an election, bonds and other
174174 obligations secured by:
175175 (1) revenue other than ad valorem taxes; or
176176 (2) contract payments described by Section 8047.0403.
177177 (b) The district must hold an election in the manner
178178 provided by Chapters 49 and 54, Water Code, to obtain voter approval
179179 before the district may impose an ad valorem tax or issue bonds
180180 payable from ad valorem taxes.
181181 (c) The district may not issue bonds payable from ad valorem
182182 taxes to finance a road project unless the issuance is approved by a
183183 vote of a two-thirds majority of the district voters voting at an
184184 election held for that purpose.
185185 Sec. 8047.0402. OPERATION AND MAINTENANCE TAX. (a) If
186186 authorized at an election held under Section 8047.0401, the
187187 district may impose an operation and maintenance tax on taxable
188188 property in the district in accordance with Section 49.107, Water
189189 Code.
190190 (b) The board shall determine the tax rate. The rate may not
191191 exceed the rate approved at the election.
192192 Sec. 8047.0403. CONTRACT TAXES. (a) In accordance with
193193 Section 49.108, Water Code, the district may impose a tax other than
194194 an operation and maintenance tax and use the revenue derived from
195195 the tax to make payments under a contract after the provisions of
196196 the contract have been approved by a majority of the district voters
197197 voting at an election held for that purpose.
198198 (b) A contract approved by the district voters may contain a
199199 provision stating that the contract may be modified or amended by
200200 the board without further voter approval.
201201 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
202202 Sec. 8047.0501. AUTHORITY TO ISSUE BONDS AND OTHER
203203 OBLIGATIONS. The district may issue bonds or other obligations
204204 payable wholly or partly from ad valorem taxes, impact fees,
205205 revenue, contract payments, grants, or other district money, or any
206206 combination of those sources, to pay for any authorized district
207207 purpose.
208208 Sec. 8047.0502. TAXES FOR BONDS. At the time the district
209209 issues bonds payable wholly or partly from ad valorem taxes, the
210210 board shall provide for the annual imposition of a continuing
211211 direct ad valorem tax, without limit as to rate or amount, while all
212212 or part of the bonds are outstanding as required and in the manner
213213 provided by Sections 54.601 and 54.602, Water Code.
214214 Sec. 8047.0503. BONDS FOR ROAD PROJECTS. At the time of
215215 issuance, the total principal amount of bonds or other obligations
216216 issued or incurred to finance road projects and payable from ad
217217 valorem taxes may not exceed one-fourth of the assessed value of the
218218 real property in the district.
219219 SECTION 2. The Harris-Waller Counties Municipal Utility
220220 District No. 4 initially includes all the territory contained in
221221 the following area:
222222 TRACT 1 - 384.139 ACRES
223223 Being a tract of land containing 384.139 acres located in the
224224 H.&T.C.R.R. Co. Survey, Section 121, Abstract 201 (A-201), and the
225225 J.W. McCutcheon Survey, Section 130, A-308, both in Waller County,
226226 Texas. Said 384.139 acres being those certain call 383.1710 acre
227227 and 1.00 acre tracts of land (styled "Tract 1" and "Tract 2",
228228 respectively) recorded in the name of Kenneth Lee Freeman, Charles
229229 Randall Freeman, David Wayne Freeman and Diana Lynn Ballard,
230230 Trustees in Volume 471, Page 468 of the Waller County Deed Records
231231 (W.C.D.R.). Said 384.139 acres being more particularly described
232232 by metes and bounds as follows (bearings are referenced to the Texas
233233 Coordinate System of 1983, South Central Zone, based on GPS
234234 observations):
235235 COMMENCING at a 1/2 inch iron rod found at the northwest
236236 corner of said A-201, the northeast corner of the F. Eule Survey,
237237 Section 112, A-373, the southeast corner of the H.&T.C.R.R. Co.
238238 Survey, Section 111, A-172, and the F. Eule Survey, Section 120,
239239 A-375, all in Waller County, Texas, being at the intersection of
240240 Schlipf Road and Stockdick Road, and from which a 1/2 inch iron pipe
241241 found at the northeast corner of said A-201 and northwest corner of
242242 said A-308 bears North 87 degrees 59 minutes 16 seconds East, a
243243 distance of 5,297.10 feet;
244244 THENCE, with said Schlipf Road and the common line between
245245 said A-201 and A-373, South 02 degrees 05 minutes 03 seconds East, a
246246 distance of 2,779.90 feet to a Nail set in asphalt at the POINT OF
247247 BEGINNING and northwest corner of aforesaid 383.1710 acre tract,
248248 same being the southwest corner of the Dollins 281.50 acre tract;
249249 THENCE, with the common line between said 383.1710 acre tract
250250 and said Dollins 281.50 acre tract, North 87 degrees 54 minutes 31
251251 seconds East, passing a 1/2 inch iron pipe found at 25.67 feet for
252252 reference, and continuing for a total distance of 2,314.64 feet
253253 (call 2,315.22 feet) to a 5/8 inch capped iron rod stamped "GBI
254254 Partners" set at the northwest corner of the Dollins 10 acre tract;
255255 THENCE, with the common lines between said 383.1710 acre
256256 tract and said Dollins 10 acre tract, the following two (2) courses:
257257 1.) South 02 degrees 05 minutes 59 seconds East, a
258258 distance of 684.50 feet to a 5/8 inch capped iron rod stamped
259259 "GBI Partners" set at the southwest corner of said Dollins 10

262262 distance of 405.00 feet to a 5/8 inch capped iron rod stamped

592592 SECTION 3. (a) The legal notice of the intention to
593593 introduce this Act, setting forth the general substance of this
594594 Act, has been published as provided by law, and the notice and a
595595 copy of this Act have been furnished to all persons, agencies,
596596 officials, or entities to which they are required to be furnished
597597 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
598598 Government Code.
599599 (b) The governor, one of the required recipients, has
600600 submitted the notice and Act to the Texas Commission on
601601 Environmental Quality.
602602 (c) The Texas Commission on Environmental Quality has filed
603603 its recommendations relating to this Act with the governor, the
604604 lieutenant governor, and the speaker of the house of
605605 representatives within the required time.
606606 (d) All requirements of the constitution and laws of this
607607 state and the rules and procedures of the legislature with respect
608608 to the notice, introduction, and passage of this Act are fulfilled
609609 and accomplished.
610610 SECTION 4. (a) If this Act does not receive a two-thirds
611611 vote of all the members elected to each house, Subchapter C, Chapter
612612 8047, Special District Local Laws Code, as added by Section 1 of
613613 this Act, is amended by adding Section 8047.0307 to read as follows:
614614 Sec. 8047.0307. NO EMINENT DOMAIN POWER. The district may
615615 not exercise the power of eminent domain.
616616 (b) This section is not intended to be an expression of a
617617 legislative interpretation of the requirements of Section 17(c),
618618 Article I, Texas Constitution.
619619 SECTION 5. This Act takes effect immediately if it receives
620620 a vote of two-thirds of all the members elected to each house, as
621621 provided by Section 39, Article III, Texas Constitution. If this
622622 Act does not receive the vote necessary for immediate effect, this
623623 Act takes effect September 1, 2019.
