77 relating to the powers and duties of the Fort Bend County Municipal
88 Utility District No. 168; providing authority to issue bonds;
99 providing authority to impose a tax.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8030 to read as follows:
1313 CHAPTER 8030. FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 168
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8030.0001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "District" means the Fort Bend County Municipal
1818 Utility District No. 168.
1919 Sec. 8030.0002. NATURE AND PURPOSES OF DISTRICT. (a) The
2020 district is a municipal utility district created under Section 59,
2121 Article XVI, Texas Constitution.
2222 (b) The district is created to accomplish the purposes of:
2323 (1) a municipal utility district as provided by
2424 general law and Section 59, Article XVI, Texas Constitution; and
2525 (2) Section 52, Article III, Texas Constitution, that
2626 relate to the construction, acquisition, improvement, operation,
2727 or maintenance of macadamized, graveled, or paved roads, or
2828 improvements, including storm drainage, in aid of those roads.
2929 SUBCHAPTER B. POWERS AND DUTIES
3030 Sec. 8030.0051. GENERAL POWERS AND DUTIES. The district
3131 has the powers and duties necessary to accomplish the purposes for
3232 which the district is created.
3333 Sec. 8030.0052. MUNICIPAL UTILITY DISTRICT POWERS AND
3434 DUTIES. The district has the powers and duties provided by the
3535 general law of this state, including Chapters 49 and 54, Water Code,
3636 applicable to municipal utility districts created under Section 59,
3737 Article XVI, Texas Constitution.
3838 Sec. 8030.0053. AUTHORITY FOR ROAD PROJECTS. Under Section
3939 52, Article III, Texas Constitution, the district may design,
4040 acquire, construct, finance, issue bonds for, improve, operate,
4141 maintain, and convey to this state, a county, or a municipality for
4242 operation and maintenance macadamized, graveled, or paved roads, or
4343 improvements, including storm drainage, in aid of those roads.
4444 Sec. 8030.0054. ROAD STANDARDS AND REQUIREMENTS. (a) A
4545 road project must meet all applicable construction standards and
4646 regulations of each municipality in whose corporate limits or
4747 extraterritorial jurisdiction the road project is located.
4848 (b) If a road project is not located in the corporate limits
4949 or extraterritorial jurisdiction of a municipality, the road
5050 project must meet all applicable construction standards and
5151 regulations of each county in which the road project is located.
5252 (c) If the state will maintain and operate the road, the
5353 Texas Transportation Commission must approve the plans and
5454 specifications of the road project.
5555 Sec. 8030.0055. AUTHORITY TO ESTABLISH DEFINED AREAS OR
5656 DESIGNATED PROPERTY. Notwithstanding the acreage requirement
5757 under Section 54.801(a), Water Code, the district may define areas
5858 or designate certain property of the district as provided by
5959 Subchapter J, Chapter 54, Water Code, to pay for improvements,
6060 facilities, or services that primarily benefit that area or
6161 property and do not generally and directly benefit the district as a
6262 whole.
6363 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
6464 Sec. 8030.0101. AUTHORITY TO ISSUE BONDS AND OTHER
6565 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds or
6666 other obligations payable wholly or partly from ad valorem taxes,
6767 revenue, contract payments, grants, or other district money, or any
6868 combination of those sources, to pay for a road project authorized
6969 by Section 8030.0053.
7070 (b) The district may not issue bonds payable from ad valorem
7171 taxes to finance a road project unless the issuance is approved by a
7272 vote of a two-thirds majority of the district voters voting at an
7373 election held for that purpose.
7474 (c) At the time of issuance, the total principal amount of
7575 bonds or other obligations issued or incurred to finance road
7676 projects and payable from ad valorem taxes may not exceed
7777 one-fourth of the assessed value of the real property in the
7878 district.
7979 Sec. 8030.0102. TAXES FOR BONDS. At the time the district
8080 issues bonds payable wholly or partly from ad valorem taxes, the
8181 board shall provide for the annual imposition of a continuing
8282 direct ad valorem tax, without limit as to rate or amount, while all
8383 or part of the bonds are outstanding as required and in the manner
8484 provided by Sections 54.601 and 54.602, Water Code.
8585 SECTION 2. The Fort Bend County Municipal Utility District
8686 No. 168 retains all the rights, powers, privileges, authority,
8787 duties, and functions that it had before the effective date of this
8888 Act.
8989 SECTION 3. (a) The legal notice of the intention to
9090 introduce this Act, setting forth the general substance of this
9191 Act, has been published as provided by law, and the notice and a
9292 copy of this Act have been furnished to all persons, agencies,
9393 officials, or entities to which they are required to be furnished
9494 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9595 Government Code.
9696 (b) The governor, one of the required recipients, has
9797 submitted the notice and Act to the Texas Commission on
9898 Environmental Quality.
9999 (c) The Texas Commission on Environmental Quality has filed
100100 its recommendations relating to this Act with the governor, the
101101 lieutenant governor, and the speaker of the house of
102102 representatives within the required time.
103103 (d) All requirements of the constitution and laws of this
104104 state and the rules and procedures of the legislature with respect
105105 to the notice, introduction, and passage of this Act are fulfilled
106106 and accomplished.
107107 SECTION 4. This Act takes effect immediately if it receives
108108 a vote of two-thirds of all the members elected to each house, as
109109 provided by Section 39, Article III, Texas Constitution. If this
110110 Act does not receive the vote necessary for immediate effect, this
111111 Act takes effect September 1, 2019.
