---|
96 | 92 | | Sec. 8082.0301. GENERAL POWERS AND DUTIES. The district |
---|
97 | 93 | | has the powers and duties necessary to accomplish the purposes for |
---|
98 | 94 | | which the district is created. |
---|
99 | 95 | | Sec. 8082.0302. MUNICIPAL UTILITY DISTRICT POWERS AND |
---|
100 | 96 | | DUTIES. The district has the powers and duties provided by the |
---|
101 | 97 | | general law of this state, including Chapters 49 and 54, Water Code, |
---|
102 | 98 | | applicable to municipal utility districts created under Section 59, |
---|
103 | 99 | | Article XVI, Texas Constitution. |
---|
104 | 100 | | Sec. 8082.0303. AUTHORITY FOR ROAD PROJECTS. Under Section |
---|
105 | 101 | | 52, Article III, Texas Constitution, the district may design, |
---|
106 | 102 | | acquire, construct, finance, issue bonds for, improve, operate, |
---|
107 | 103 | | maintain, and convey to this state, a county, or a municipality for |
---|
108 | 104 | | operation and maintenance macadamized, graveled, or paved roads, or |
---|
109 | 105 | | improvements, including storm drainage, in aid of those roads. |
---|
110 | 106 | | Sec. 8082.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A |
---|
111 | 107 | | road project must meet all applicable construction standards, |
---|
112 | 108 | | zoning and subdivision requirements, and regulations of each |
---|
113 | 109 | | municipality in whose corporate limits or extraterritorial |
---|
114 | 110 | | jurisdiction the road project is located. |
---|
115 | 111 | | (b) If a road project is not located in the corporate limits |
---|
116 | 112 | | or extraterritorial jurisdiction of a municipality, the road |
---|
117 | 113 | | project must meet all applicable construction standards, |
---|
118 | 114 | | subdivision requirements, and regulations of each county in which |
---|
119 | 115 | | the road project is located. |
---|
120 | 116 | | (c) If the state will maintain and operate the road, the |
---|
121 | 117 | | Texas Transportation Commission must approve the plans and |
---|
122 | 118 | | specifications of the road project. |
---|
123 | 119 | | Sec. 8082.0305. COMPLIANCE WITH MUNICIPAL CONSENT |
---|
124 | 120 | | ORDINANCE OR RESOLUTION. The district shall comply with all |
---|
125 | 121 | | applicable requirements of any ordinance or resolution that is |
---|
126 | 122 | | adopted under Section 54.016 or 54.0165, Water Code, and that |
---|
127 | 123 | | consents to the creation of the district or to the inclusion of land |
---|
128 | 124 | | in the district. |
---|
129 | 125 | | Sec. 8082.0306. CERTAIN NAVIGATION IMPROVEMENTS. (a) The |
---|
130 | 126 | | district is created for the following purposes and has the power to |
---|
131 | 127 | | purchase, construct, acquire, own, operate, maintain, improve, or |
---|
132 | 128 | | extend, inside or outside the district, a canal or other waterway, |
---|
133 | 129 | | bulkhead, dock, or improvement in aid of such canals, waterways, |
---|
134 | 130 | | bulkheads, or docks. |
---|
135 | 131 | | (b) Notwithstanding any other law, the powers provided by |
---|
136 | 132 | | Subsection (a) are subject to the applicable rules, regulations, |
---|
137 | 133 | | and approval of the San Jacinto River Authority. |
---|
138 | 134 | | (c) In the event the district adopts a rule or regulation |
---|
139 | 135 | | relating to boating or navigation, the rule or regulation must be |
---|
140 | 136 | | consistent with the applicable rules or regulations of the San |
---|
141 | 137 | | Jacinto River Authority. |
---|
142 | 138 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
145 | 141 | | obligations secured by: |
---|
146 | 142 | | (1) revenue other than ad valorem taxes; or |
---|
147 | 143 | | (2) contract payments described by Section 8082.0403. |
---|
148 | 144 | | (b) The district must hold an election in the manner |
---|
149 | 145 | | provided by Chapters 49 and 54, Water Code, to obtain voter approval |
---|
150 | 146 | | before the district may impose an ad valorem tax or issue bonds |
---|
151 | 147 | | payable from ad valorem taxes. |
---|
152 | 148 | | (c) The district may not issue bonds payable from ad valorem |
---|
153 | 149 | | taxes to finance a road project unless the issuance is approved by a |
---|
154 | 150 | | vote of a two-thirds majority of the district voters voting at an |
---|
155 | 151 | | election held for that purpose. |
---|
156 | 152 | | Sec. 8082.0402. OPERATION AND MAINTENANCE TAX. (a) If |
---|
157 | 153 | | authorized at an election held under Section 8082.0401, the |
---|
158 | 154 | | district may impose an operation and maintenance tax on taxable |
---|
159 | 155 | | property in the district in accordance with Section 49.107, Water |
---|
160 | 156 | | Code. |
---|
161 | 157 | | (b) The board shall determine the tax rate. The rate may not |
---|
162 | 158 | | exceed the rate approved at the election. |
---|
163 | 159 | | Sec. 8082.0403. CONTRACT TAXES. (a) In accordance with |
---|
164 | 160 | | Section 49.108, Water Code, the district may impose a tax other than |
---|
165 | 161 | | an operation and maintenance tax and use the revenue derived from |
---|
166 | 162 | | the tax to make payments under a contract after the provisions of |
---|
167 | 163 | | the contract have been approved by a majority of the district voters |
---|
168 | 164 | | voting at an election held for that purpose. |
---|
169 | 165 | | (b) A contract approved by the district voters may contain a |
---|
170 | 166 | | provision stating that the contract may be modified or amended by |
---|
171 | 167 | | the board without further voter approval. |
---|
172 | 168 | | SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS |
---|
173 | 169 | | Sec. 8082.0501. AUTHORITY TO ISSUE BONDS AND OTHER |
---|
174 | 170 | | OBLIGATIONS. The district may issue bonds or other obligations |
---|
175 | 171 | | payable wholly or partly from ad valorem taxes, impact fees, |
---|
176 | 172 | | revenue, contract payments, grants, or other district money, or any |
---|
177 | 173 | | combination of those sources, to pay for any authorized district |
---|
178 | 174 | | purpose. |
---|
179 | 175 | | Sec. 8082.0502. TAXES FOR BONDS. At the time the district |
---|
180 | 176 | | issues bonds payable wholly or partly from ad valorem taxes, the |
---|
181 | 177 | | board shall provide for the annual imposition of a continuing |
---|
182 | 178 | | direct ad valorem tax, without limit as to rate or amount, while all |
---|
183 | 179 | | or part of the bonds are outstanding as required and in the manner |
---|
184 | 180 | | provided by Sections 54.601 and 54.602, Water Code. |
---|
185 | 181 | | Sec. 8082.0503. BONDS FOR ROAD PROJECTS. At the time of |

186 | 182 | | issuance, the total principal amount of bonds or other obligations |

401 | 397 | | SECTION 4. (a) If this Act does not receive a two-thirds |

402 | 398 | | vote of all the members elected to each house, Subchapter C, Chapter |

403 | 399 | | 8082, Special District Local Laws Code, as added by Section 1 of |

404 | 400 | | this Act, is amended by adding Section 8082.0307 to read as follows: |

405 | 401 | | Sec. 8082.0307. NO EMINENT DOMAIN POWER. The district may |

406 | 402 | | not exercise the power of eminent domain. |

407 | 403 | | (b) This section is not intended to be an expression of a |

408 | 404 | | legislative interpretation of the requirements of Section 17(c), |
---|
409 | 405 | | Article I, Texas Constitution. |

410 | 406 | | SECTION 5. This Act takes effect immediately if it receives |

411 | 407 | | a vote of two-thirds of all the members elected to each house, as |
---|
412 | 408 | | provided by Section 39, Article III, Texas Constitution. If this |

413 | 409 | | Act does not receive the vote necessary for immediate effect, this |
---|
414 | 410 | | Act takes effect September 1, 2019. |
