57 Utility District No. 375; providing authority to issue bonds.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Subtitle F, Title 6, Special District Local Laws
810 Code, is amended by adding Chapter 8043 to read as follows:
911 CHAPTER 8043. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 375
1012 SUBCHAPTER A. GENERAL PROVISIONS
1113 Sec. 8043.0101. DEFINITION. In this chapter, "district"
1214 means the Harris County Municipal Utility District No. 375.
1315 Sec. 8043.0102. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
1416 (a) The district is created to serve a public purpose and benefit.
1517 (b) The district is created to accomplish the purposes of:
1618 (1) a municipal utility district as provided by
1719 general law and Section 59, Article XVI, Texas Constitution; and
1820 (2) Section 52, Article III, Texas Constitution, that
1921 relate to the construction, acquisition, improvement, operation,
2022 or maintenance of macadamized, graveled, or paved roads, or
2123 improvements, including storm drainage, in aid of those roads.
2224 SUBCHAPTER B. POWERS AND DUTIES
2325 Sec. 8043.0201. AUTHORITY FOR ROAD PROJECTS. Under Section
2426 52, Article III, Texas Constitution, the district may design,
2527 acquire, construct, finance, issue bonds for, improve, operate,
2628 maintain, and convey to this state, a county, or a municipality for
2729 operation and maintenance macadamized, graveled, or paved roads, or
2830 improvements, including storm drainage, in aid of those roads.
2931 Sec. 8043.0202. ROAD STANDARDS AND REQUIREMENTS. (a) A
3032 road project must meet all applicable construction standards,
3133 zoning and subdivision requirements, and regulations of each
3234 municipality in whose corporate limits or extraterritorial
3335 jurisdiction the road project is located.
3436 (b) If a road project is not located in the corporate limits
3537 or extraterritorial jurisdiction of a municipality, the road
3638 project must meet all applicable construction standards,
3739 subdivision requirements, and regulations of each county in which
3840 the road project is located.
3941 (c) If the state will maintain and operate the road, the
4042 Texas Transportation Commission must approve the plans and
4143 specifications of the road project.
4244 SUBCHAPTER C. BONDS
4345 Sec. 8043.0301. BONDS FOR ROAD PROJECTS. At the time of
4446 issuance, the total principal amount of bonds or other obligations
4547 issued or incurred to finance road projects and payable from ad
4648 valorem taxes may not exceed one-fourth of the assessed value of the
4749 real property in the district.
4850 SECTION 2. (a) The legal notice of the intention to
4951 introduce this Act, setting forth the general substance of this
5052 Act, has been published as provided by law, and the notice and a
5153 copy of this Act have been furnished to all persons, agencies,
5254 officials, or entities to which they are required to be furnished
5355 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5456 Government Code.
5557 (b) The governor, one of the required recipients, has
5658 submitted the notice and Act to the Texas Commission on
5759 Environmental Quality.
5860 (c) The Texas Commission on Environmental Quality has filed
5961 its recommendations relating to this Act with the governor, the
6062 lieutenant governor, and the speaker of the house of
6163 representatives within the required time.
6264 (d) All requirements of the constitution and laws of this
6365 state and the rules and procedures of the legislature with respect
6466 to the notice, introduction, and passage of this Act are fulfilled
6567 and accomplished.
6668 SECTION 3. This Act takes effect immediately if it receives
6769 a vote of two-thirds of all the members elected to each house, as
6870 provided by Section 39, Article III, Texas Constitution. If this
6971 Act does not receive the vote necessary for immediate effect, this
7072 Act takes effect September 1, 2019.
