| 7 | 7 | | relating to the powers and duties of the Rolling V Ranch Water |

| 8 | 8 | | Control and Improvement District No. 1 of Wise County. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 9021.104, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended by amending Subsections (a) and (b) and adding |
|---|
| 12 | 12 | | Subsections (e), (f), (g), (h), (i), and (j) to read as follows: |
|---|
| 13 | 13 | | (a) The district may be divided into two or more new |
|---|
| 14 | 14 | | districts only if the district: |
|---|
| 15 | 15 | | (1) has no outstanding bonded debt; and |
|---|
| 16 | 16 | | (2) is not imposing ad valorem taxes. |
|---|
| 17 | 17 | | (b) This chapter applies to any new district created by the |
|---|
| 18 | 18 | | division of the district, and a new district has all the powers and |
|---|
| 19 | 19 | | duties of the district. [The division procedure is prescribed by |
|---|
| 20 | 20 | | Sections 53.030 through 53.041, Water Code.] |
|---|
| 21 | 21 | | (e) The board, on its own motion or on receipt of a petition |
|---|
| 22 | 22 | | signed by the owner or owners of a majority of the assessed value of |
|---|
| 23 | 23 | | the real property in the district, may adopt an order dividing the |
|---|
| 24 | 24 | | district. |
|---|
| 25 | 25 | | (f) An order dividing the district must: |
|---|
| 26 | 26 | | (1) name each new district; |
|---|
| 27 | 27 | | (2) include the metes and bounds description of the |
|---|
| 28 | 28 | | territory of each new district; |
|---|
| 29 | 29 | | (3) appoint temporary directors for each new district; |
|---|
| 30 | 30 | | and |
|---|
| 31 | 31 | | (4) provide for the division of assets and liabilities |
|---|
| 32 | 32 | | between or among the new districts. |
|---|
| 33 | 33 | | (g) On or before the 30th day after the date of adoption of |
|---|
| 34 | 34 | | an order dividing the district, the district shall file the order |
|---|
| 35 | 35 | | with the Texas Commission on Environmental Quality and record the |
|---|
| 36 | 36 | | order in the real property records of each county in which the |
|---|
| 37 | 37 | | district is located. |
|---|
| 38 | 38 | | (h) Any new district created by the division of the district |
|---|
| 39 | 39 | | shall hold a confirmation and directors' election as required by |
|---|
| 40 | 40 | | Section 49.102, Water Code. |
|---|
| 41 | 41 | | (i) If the creation of the new district is confirmed, the |
|---|
| 42 | 42 | | new district shall provide the election date and results to the |
|---|
| 43 | 43 | | Texas Commission on Environmental Quality. |
|---|
| 44 | 44 | | (j) Any new district created by the division of the district |
|---|
| 45 | 45 | | must hold an election as required by this chapter to obtain voter |
|---|
| 46 | 46 | | approval before the district may impose a maintenance tax or issue |
|---|
| 47 | 47 | | bonds payable wholly or partly from ad valorem taxes. |
|---|
| 48 | 48 | | SECTION 2. Subchapter C, Chapter 9021, Special District |
|---|
| 49 | 49 | | Local Laws Code, is amended by adding Section 9021.105 to read as |
|---|
| 50 | 50 | | follows: |
|---|
| 51 | 51 | | Sec. 9021.105. LAW ENFORCEMENT SERVICES. To protect the |
|---|
| 52 | 52 | | public interest, the district may contract with a qualified party, |
|---|
| 53 | 53 | | including a county or a municipality, to provide law enforcement |
|---|
| 54 | 54 | | services in the district for a fee. |
|---|
| 55 | 55 | | SECTION 3. Subchapter D, Chapter 9021, Special District |
|---|
| 56 | 56 | | Local Laws Code, is amended by adding Section 9021.152 to read as |
|---|
| 57 | 57 | | follows: |
|---|
| 58 | 58 | | Sec. 9021.152. CONTRACT TAXES. In accordance with Section |
|---|
| 59 | 59 | | 49.108, Water Code, the district may impose a tax other than an |
|---|
| 60 | 60 | | operation and maintenance tax and use the revenue derived from the |
|---|
| 61 | 61 | | tax to make payments under a contract after the provisions of the |
|---|
| 62 | 62 | | contract have been approved by a majority of the district voters |
|---|
| 63 | 63 | | voting at an election held for that purpose. |
|---|
| 64 | 64 | | SECTION 4. Section 9021.104(c), Special District Local Laws |
|---|
| 65 | 65 | | Code, is repealed. |
|---|
| 66 | 66 | | SECTION 5. (a) The legal notice of the intention to |
|---|
| 67 | 67 | | introduce this Act, setting forth the general substance of this |
|---|
| 68 | 68 | | Act, has been published as provided by law, and the notice and a |
|---|
| 69 | 69 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 70 | 70 | | officials, or entities to which they are required to be furnished |
|---|
| 71 | 71 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 72 | 72 | | Government Code. |
|---|
| 73 | 73 | | (b) The governor, one of the required recipients, has |
|---|
| 74 | 74 | | submitted the notice and Act to the Texas Commission on |
|---|
| 75 | 75 | | Environmental Quality. |
|---|
| 76 | 76 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 77 | 77 | | its recommendations relating to this Act with the governor, |
|---|
| 78 | 78 | | lieutenant governor, and speaker of the house of representatives |
|---|
| 79 | 79 | | within the required time. |
|---|
| 80 | 80 | | (d) All requirements of the constitution and laws of this |
|---|
| 81 | 81 | | state and the rules and procedures of the legislature with respect |
|---|
| 82 | 82 | | to the notice, introduction, and passage of this Act have been |
|---|
| 83 | 83 | | fulfilled and accomplished. |
|---|
| 84 | 84 | | SECTION 6. This Act takes effect September 1, 2019. |
