66 AN ACT
77 relating to the powers and duties of the Rolling V Ranch Water
88 Control and Improvement District No. 1 of Wise County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 9021.104, Special District Local Laws
1111 Code, is amended by amending Subsections (a) and (b) and adding
1212 Subsections (e), (f), (g), (h), (i), and (j) to read as follows:
1313 (a) The district may be divided into two or more new
1414 districts only if the district:
1515 (1) has no outstanding bonded debt; and
1616 (2) is not imposing ad valorem taxes.
1717 (b) This chapter applies to any new district created by the
1818 division of the district, and a new district has all the powers and
1919 duties of the district. [The division procedure is prescribed by
2020 Sections 53.030 through 53.041, Water Code.]
2121 (e) The board, on its own motion or on receipt of a petition
2222 signed by the owner or owners of a majority of the assessed value of
2323 the real property in the district, may adopt an order dividing the
2424 district.
2525 (f) An order dividing the district must:
2626 (1) name each new district;
2727 (2) include the metes and bounds description of the
2828 territory of each new district;
2929 (3) appoint temporary directors for each new district;
3030 and
3131 (4) provide for the division of assets and liabilities
3232 between or among the new districts.
3333 (g) On or before the 30th day after the date of adoption of
3434 an order dividing the district, the district shall file the order
3535 with the Texas Commission on Environmental Quality and record the
3636 order in the real property records of each county in which the
3737 district is located.
3838 (h) Any new district created by the division of the district
3939 shall hold a confirmation and directors' election as required by
4040 Section 49.102, Water Code.
4141 (i) If the creation of the new district is confirmed, the
4242 new district shall provide the election date and results to the
4343 Texas Commission on Environmental Quality.
4444 (j) Any new district created by the division of the district
4545 must hold an election as required by this chapter to obtain voter
4646 approval before the district may impose a maintenance tax or issue
4747 bonds payable wholly or partly from ad valorem taxes.
4848 SECTION 2. Subchapter C, Chapter 9021, Special District
4949 Local Laws Code, is amended by adding Section 9021.105 to read as
5050 follows:
5151 Sec. 9021.105. LAW ENFORCEMENT SERVICES. To protect the
5252 public interest, the district may contract with a qualified party,
5353 including a county or a municipality, to provide law enforcement
5454 services in the district for a fee.
5555 SECTION 3. Subchapter D, Chapter 9021, Special District
5656 Local Laws Code, is amended by adding Section 9021.152 to read as
5757 follows:
5858 Sec. 9021.152. CONTRACT TAXES. In accordance with Section
5959 49.108, Water Code, the district may impose a tax other than an
6060 operation and maintenance tax and use the revenue derived from the
6161 tax to make payments under a contract after the provisions of the
6262 contract have been approved by a majority of the district voters
6363 voting at an election held for that purpose.
6464 SECTION 4. Section 9021.104(c), Special District Local Laws
6565 Code, is repealed.
6666 SECTION 5. (a) The legal notice of the intention to
6767 introduce this Act, setting forth the general substance of this
6868 Act, has been published as provided by law, and the notice and a
6969 copy of this Act have been furnished to all persons, agencies,
7070 officials, or entities to which they are required to be furnished
7171 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
7272 Government Code.
7373 (b) The governor, one of the required recipients, has
7474 submitted the notice and Act to the Texas Commission on
7575 Environmental Quality.
7676 (c) The Texas Commission on Environmental Quality has filed
7777 its recommendations relating to this Act with the governor,
7878 lieutenant governor, and speaker of the house of representatives
7979 within the required time.
8080 (d) All requirements of the constitution and laws of this
8181 state and the rules and procedures of the legislature with respect
8282 to the notice, introduction, and passage of this Act have been
8383 fulfilled and accomplished.
8484 SECTION 6. This Act takes effect September 1, 2019.
