| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter F, Chapter 521, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 521.1251 to read as follows: |
|---|
| 12 | 12 | | Sec. 521.1251. OPTIONAL DESIGNATIONS FOR BLOOD TYPE AND |
|---|
| 13 | 13 | | BLOOD DISORDERS. (a) The department shall provide to each |
|---|
| 14 | 14 | | applicant for the issuance of an original, renewal, corrected, or |
|---|
| 15 | 15 | | duplicate driver's license or personal identification certificate |
|---|
| 16 | 16 | | who applies in person, by mail, over the Internet, or by other |
|---|
| 17 | 17 | | electronic means the opportunity to indicate on the person's |
|---|
| 18 | 18 | | driver's license or personal identification certificate: |
|---|
| 19 | 19 | | (1) the person's blood type; and |
|---|
| 20 | 20 | | (2) whether the person has a blood disorder and, if so, |
|---|
| 21 | 21 | | the type of blood disorder. |
|---|
| 22 | 22 | | (b) The department shall include on each driver's license |
|---|
| 23 | 23 | | issued to a person who makes an election under this section a |
|---|
| 24 | 24 | | designation that indicates the person's blood type and blood |
|---|
| 25 | 25 | | disorder, as applicable. |
|---|
| 26 | 26 | | SECTION 2. Section 522.030, Transportation Code, is amended |
|---|
| 27 | 27 | | by adding Subsections (e) and (f) to read as follows: |
|---|
| 28 | 28 | | (e) The department shall provide to each applicant for the |
|---|
| 29 | 29 | | issuance of an original, renewal, corrected, or duplicate |
|---|
| 30 | 30 | | commercial driver's license or commercial learner's permit who |
|---|
| 31 | 31 | | applies in person, by mail, over the Internet, or by other |
|---|
| 32 | 32 | | electronic means the opportunity to indicate on the person's |
|---|
| 33 | 33 | | commercial driver's license or commercial learner's permit: |
|---|
| 34 | 34 | | (1) the person's blood type; and |
|---|
| 35 | 35 | | (2) whether the person has a blood disorder and, if so, |
|---|
| 36 | 36 | | the type of blood disorder. |
|---|
| 37 | 37 | | (f) The department shall include on each commercial |
|---|
| 38 | 38 | | driver's license or commercial learner's permit issued to a person |
|---|
| 39 | 39 | | who makes an election under Subsection (e) a designation that |
|---|
| 40 | 40 | | indicates the person's blood type and blood disorder, as |
|---|
| 41 | 41 | | applicable. |
|---|
| 42 | 42 | | SECTION 3. The Department of Public Safety shall adopt |
|---|
| 43 | 43 | | rules as necessary to implement Sections 521.1251 and 522.030(e) |
|---|
| 44 | 44 | | and (f), Transportation Code, as added by this Act, not later than |
|---|
| 45 | 45 | | November 1, 2019. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2019. |
|---|
