55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to supplemental environmental projects authorized by the
88 Texas Commission on Environmental Quality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 7.067, Water Code, is amended by adding
1111 Subsections (d), (e), and (f) to read as follows:
1212 (d) The commission may determine the types of projects that
1313 may be approved as a supplemental environmental project. For a
1414 respondent that is a local government, those types of projects must
1515 include:
1616 (1) purchasing, operating, or maintaining:
1717 (A) alternative fuel vehicles, including
1818 passenger cars, light trucks, heavy trucks, and buses; and
1919 (B) alternative fuel heavy equipment, including
2020 tractors, bulldozers, front-end loaders, and motor graders;
2121 (2) constructing, operating, or maintaining
2222 alternative fuel refueling infrastructure necessary to operate an
2323 alternative fuel fleet; and
2424 (3) providing energy efficiency upgrades to buildings
2525 and facilities owned by the local government, including heating,
2626 ventilation, air conditioning, lighting, and building envelope
2727 upgrades.
2828 (e) For a supplemental environmental project involving
2929 alternative fuel vehicles, the commission:
3030 (1) must allow the project to include:
3131 (A) the entire cost of the vehicle; and
3232 (B) any alternative fuel equipment or upgrades
3333 involved; and
3434 (2) may not limit the project to including only the
3535 difference in cost between conventional fuel vehicles, equipment,
3636 or upgrades and the alternative fuel counterparts.
3737 (f) The commission:
3838 (1) may not require a contract associated with a
3939 supplemental environmental project to be for a term of less than
4040 five years; and
4141 (2) must allow a contract associated with a
4242 supplemental environmental project to be renewable for periods of
4343 at least five years.
4444 SECTION 2. This Act takes effect September 1, 2019.
