55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to written agreements incident to divorce or annulment.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 7.006(b), Family Code, is amended to
1010 read as follows:
1111 (b) If the court finds that the terms of the written
1212 agreement in a divorce or an annulment are just and right, those
1313 terms are binding on the court. If the court approves the
1414 agreement, the court may set forth the agreement in full or
1515 incorporate the agreement by reference in the final decree. If the
1616 court incorporates the agreement by reference in the final decree,
1717 the agreement is not required to be filed with the court or the
1818 court clerk.
1919 SECTION 2. Section 7.006(b), Family Code, as amended by
2020 this Act, applies to an agreement incorporated by reference in a
2121 final decree of divorce or annulment regardless of whether the
2222 decree is signed before, on, or after the effective date of this
2323 Act.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
