8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 154.302(b), Family Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | (b) Except as otherwise provided by this subsection, a [A] | |
12 | 12 | court that orders support under this section shall designate a | |
13 | 13 | parent of the child, [or] another person having physical custody or | |
14 | 14 | guardianship of the child under a court order, or a special needs | |
15 | 15 | trust created for the child to receive the support for the child. | |
16 | 16 | The court may designate a child who is 18 years of age or older to | |
17 | 17 | receive the support directly. | |
18 | 18 | SECTION 2. The change in law made by this Act constitutes a | |
19 | 19 | material and substantial change of circumstances under Section | |
20 | 20 | 156.401, Family Code, sufficient to warrant modification of a court | |
21 | 21 | order or a portion of a decree that provides for the support of a | |
22 | 22 | child rendered before the effective date of this Act. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2019. |
