| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 85.006(a), Family Code, is amended to | |
| 10 | 10 | read as follows: | |
| 11 | 11 | (a) Except as provided by Subsection (b), a [A] court may | |
| 12 | 12 | render a protective order that is binding on a respondent who does | |
| 13 | 13 | not attend a hearing if: | |
| 14 | 14 | (1) the respondent received service of the application | |
| 15 | 15 | and notice of the hearing; and | |
| 16 | 16 | (2) proof of service was filed with the court at least | |
| 17 | 17 | 48 hours before the time set for the hearing. | |
| 18 | 18 | SECTION 2. Section 85.006(a), Family Code, as amended by | |
| 19 | 19 | this Act, applies only to an application for a protective order that | |
| 20 | 20 | is filed on or after the effective date of this Act. An application | |
| 21 | 21 | for a protective order filed before the effective date of this Act | |
| 22 | 22 | is governed by the law in effect on the date the application is | |
| 23 | 23 | filed, and the former law is continued in effect for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2019. |
