55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain rights of the sole managing conservator of a
88 child in relation to the child's passport.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 153.132, Family Code, is amended to read
1111 as follows:
1212 Sec. 153.132. RIGHTS AND DUTIES OF PARENT APPOINTED SOLE
1313 MANAGING CONSERVATOR. Unless limited by court order, a parent
1414 appointed as sole managing conservator of a child has the rights and
1515 duties provided by Subchapter B and the following exclusive rights:
1616 (1) the right to designate the primary residence of
1717 the child;
1818 (2) the right to consent to medical, dental, and
1919 surgical treatment involving invasive procedures;
2020 (3) the right to consent to psychiatric and
2121 psychological treatment;
2222 (4) the right to receive and give receipt for periodic
2323 payments for the support of the child and to hold or disburse these
2424 funds for the benefit of the child;
2525 (5) the right to represent the child in legal action
2626 and to make other decisions of substantial legal significance
2727 concerning the child;
2828 (6) the right to consent to marriage and to enlistment
2929 in the armed forces of the United States;
3030 (7) the right to make decisions concerning the child's
3131 education;
3232 (8) the right to the services and earnings of the
3333 child; [and]
3434 (9) except when a guardian of the child's estate or a
3535 guardian or attorney ad litem has been appointed for the child, the
3636 right to act as an agent of the child in relation to the child's
3737 estate if the child's action is required by a state, the United
3838 States, or a foreign government; and
3939 (10) the right to:
4040 (A) apply for a passport for the child;
4141 (B) renew the child's passport; and
4242 (C) maintain possession of the child's passport.
4343 SECTION 2. Section 153.371, Family Code, is amended to read
4444 as follows:
4545 Sec. 153.371. RIGHTS AND DUTIES OF NONPARENT APPOINTED AS
4646 SOLE MANAGING CONSERVATOR. Unless limited by court order or other
4747 provisions of this chapter, a nonparent, a licensed child-placing
4848 agency, or the Department of Family and Protective Services
4949 appointed as a managing conservator of the child has the following
5050 rights and duties:
5151 (1) the right to have physical possession and to
5252 direct the moral and religious training of the child;
5353 (2) the duty of care, control, protection, and
5454 reasonable discipline of the child;
5555 (3) the duty to provide the child with clothing, food,
5656 shelter, education, and medical, psychological, and dental care;
5757 (4) the right to consent for the child to medical,
5858 psychiatric, psychological, dental, and surgical treatment and to
5959 have access to the child's medical records;
6060 (5) the right to receive and give receipt for payments
6161 for the support of the child and to hold or disburse funds for the
6262 benefit of the child;
6363 (6) the right to the services and earnings of the
6464 child;
6565 (7) the right to consent to marriage and to enlistment
6666 in the armed forces of the United States;
6767 (8) the right to represent the child in legal action
6868 and to make other decisions of substantial legal significance
6969 concerning the child;
7070 (9) except when a guardian of the child's estate or a
7171 guardian or attorney ad litem has been appointed for the child, the
7272 right to act as an agent of the child in relation to the child's
7373 estate if the child's action is required by a state, the United
7474 States, or a foreign government;
7575 (10) the right to designate the primary residence of
7676 the child and to make decisions regarding the child's education;
7777 [and]
7878 (11) if the parent-child relationship has been
7979 terminated with respect to the parents, or only living parent, or if
8080 there is no living parent, the right to consent to the adoption of
8181 the child and to make any other decision concerning the child that a
8282 parent could make; and
8383 (12) the right to:
8484 (A) apply for a passport for the child;
8585 (B) renew the child's passport; and
8686 (C) maintain possession of the child's passport.
8787 SECTION 3. The changes in law made by this Act apply only to
8888 a suit affecting the parent-child relationship that is pending in a
8989 trial court on or filed on or after the effective date of this Act.
9090 SECTION 4. This Act takes effect September 1, 2019.
