55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the driver responsibility program; reducing the amounts
88 of surcharges.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 542.4031(h), Transportation Code, is
1111 amended to read as follows:
1212 (h) Notwithstanding Subsection (g)(1), in any state fiscal
1313 year the comptroller shall deposit 67 percent of the money received
1414 under Subsection (e)(2) to the credit of the general revenue fund
1515 only until the total amount of the money deposited to the credit of
1616 the general revenue fund under Subsection (g)(1) [and Section
1717 780.002(b), Health and Safety Code,] equals $250 million for that
1818 year. If in any state fiscal year the amount received by the
1919 comptroller under Subsection (e)(2) [those laws] for deposit to the
2020 credit of the general revenue fund exceeds $250 million, the
2121 comptroller shall deposit the additional amount to the credit of
2222 the Texas mobility fund.
2323 SECTION 2. Section 708.054, Transportation Code, is amended
2424 to read as follows:
2525 Sec. 708.054. AMOUNT OF POINTS SURCHARGE. The amount of a
2626 surcharge under this chapter is $50 [$100] for the first six points
2727 and $12.50 [$25] for each additional point.
2828 SECTION 3. Section 708.102(c), Transportation Code, is
2929 amended to read as follows:
3030 (c) The amount of a surcharge under this section is $500
3131 [$1,000] per year, except that the amount of the surcharge is:
3232 (1) $750 [$1,500] per year for a second or subsequent
3333 conviction within a 36-month period; and
3434 (2) $1,000 [$2,000] for a first or subsequent
3535 conviction if it is shown on the trial of the offense that an
3636 analysis of a specimen of the person's blood, breath, or urine
3737 showed an alcohol concentration level of 0.16 or more at the time
3838 the analysis was performed.
3939 SECTION 4. Section 708.103(b), Transportation Code, is
4040 amended to read as follows:
4141 (b) The [Except as provided by Subsection (c), the] amount
4242 of a surcharge under this section is $125 [$250] per year.
4343 SECTION 5. Section 708.104(b), Transportation Code, is
4444 amended to read as follows:
4545 (b) The [Except as provided by Subsection (b-1), the] amount
4646 of a surcharge under this section is $50 [$100] per year.
4747 SECTION 6. Section 780.002(b), Health and Safety Code, is
4848 amended to read as follows:
4949 (b) The comptroller shall deposit 99 [49.5] percent of the
5050 money received under Subsection (a) to the credit of the account
5151 established under this chapter [and 49.5 percent of the money to the
5252 general revenue fund]. The remaining one percent of the amount of
5353 the surcharges shall be deposited to the general revenue fund and
5454 may be appropriated only to the Department of Public Safety for
5555 administration of the driver responsibility program operated by
5656 that department under Chapter 708, Transportation Code.
5757 SECTION 7. The following laws are repealed:
5858 (1) Section 780.002(c), Health and Safety Code; and
5959 (2) Sections 708.103(c) and 708.104(b-1),
6060 Transportation Code.
6161 SECTION 8. The change in law made by this Act applies only
6262 to a surcharge assessed on or after the effective date of this Act,
6363 including a surcharge assessed for a conviction for an offense that
6464 occurred before the effective date of this Act. The state is not
6565 required to refund a surcharge collected before the effective date
6666 of this Act.
6767 SECTION 9. This Act takes effect September 1, 2019.
