77 relating to the use of direct recording electronic voting machines.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 129, Election Code, is
1010 amended by adding Section 129.003 to read as follows:
1111 Sec. 129.003. PAPER AUDIT TRAIL REQUIRED. (a) In this
1212 section, "auditable voting system" means a voting system that:
1313 (1) uses a paper record; or
1414 (2) produces two paper receipts by which a voter can
1515 verify that the voter's ballot will be counted accurately,
1616 including:
1717 (A) one receipt for the voter's records; and
1818 (B) one receipt to remain at the polling place in
1919 case of a recount under Title 13.
2020 (b) Except as provided by Subsection (d), a voting system
2121 that consists of direct recording electronic voting machines may
2222 not be used in an election unless the system is an auditable voting
2323 system.
2424 (c) Except for a recount under Title 13, the electronic vote
2525 is the official record of the ballot. For a recount of ballots cast
2626 on a system involving direct recording electronic voting machines,
2727 the paper record or receipt copy is the official record of the vote
2828 cast.
2929 (d) This section does not apply to an election held before
3030 September 1, 2021.
3131 SECTION 2. This Act takes effect September 1, 2019.
