66 AN ACT
77 relating to reporting and disseminating information regarding
88 public school disciplinary actions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 37.020, Education Code,
1111 is amended to read as follows:
1212 Sec. 37.020. REPORTS RELATING TO SUSPENSIONS, EXPULSIONS,
1313 AND DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM PLACEMENTS.
1414 SECTION 2. Section 37.020, Education Code, is amended by
1515 adding Subsections (f) and (g) to read as follows:
1616 (f) For each suspension under Section 37.005, the district
1717 shall report:
1818 (1) information identifying the student, including
1919 the student's race, sex, and date of birth and whether the student
2020 is in a special education program under Subchapter A, Chapter 29, or
2121 covered by Section 504, Rehabilitation Act of 1973 (29 U.S.C.
2222 Section 794), that will enable the agency to compare placement data
2323 with information collected through other reports;
2424 (2) information indicating the basis for the
2525 suspension;
2626 (3) the number of full or partial days the student was
2727 suspended; and
2828 (4) the number of suspensions that were inconsistent
2929 with the guidelines included in the student code of conduct under
3030 Section 37.001(a)(3).
3131 (g) The agency shall make information collected under this
3232 section, disaggregated by race, sex, and age of the student and
3333 whether the student is in a special education program under
3434 Subchapter A, Chapter 29, or covered by Section 504, Rehabilitation
3535 Act of 1973 (29 U.S.C. Section 794), available to the public in a
3636 manner that does not identify an individual student. The agency
3737 shall also make the information available to the public in a manner
3838 showing all intersectional data for the categories described by
3939 this subsection.
4040 SECTION 3. This Act applies beginning with the 2019-2020
4141 school year.
4242 SECTION 4. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2019.
