55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the Medicaid eligibility of certain women after a
88 pregnancy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.024, Human Resources Code, is amended
1111 by adding Subsections (l-1), (l-2), and (l-3) to read as follows:
1212 (l-1) The commission shall continue to provide medical
1313 assistance to a woman who is eligible for medical assistance for
1414 pregnant women for a period of not less than 12 months following the
1515 date the woman delivers or experiences an involuntary miscarriage.
1616 (l-2) Notwithstanding Subsection (l-1), the commission
1717 shall continue to provide medical assistance to a woman who is
1818 eligible for medical assistance for pregnant women:
1919 (1) during the state fiscal year beginning September
2020 1, 2019, for a period of not less than four months following the
2121 date the woman delivers or experiences an involuntary miscarriage;
2222 and
2323 (2) during the state fiscal year beginning September
2424 1, 2020, for a period of not less than eight months following the
2525 date the woman delivers or experiences an involuntary miscarriage.
2626 (l-3) Subsection (l-2) and this subsection expire September
2727 1, 2021.
2828 SECTION 2. If before implementing any provision of this Act
2929 a state agency determines that a waiver or authorization from a
3030 federal agency is necessary for implementation of that provision,
3131 the agency affected by the provision shall request the waiver or
3232 authorization and may delay implementing that provision until the
3333 waiver or authorization is granted.
3434 SECTION 3. This Act takes effect September 1, 2019.
