| 7 | 7 | | relating to the Medicaid eligibility of certain women after a |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
|---|
| 11 | 11 | | by adding Subsections (l-1), (l-2), and (l-3) to read as follows: |
|---|
| 12 | 12 | | (l-1) The commission shall continue to provide medical |
|---|
| 13 | 13 | | assistance to a woman who is eligible for medical assistance for |
|---|
| 14 | 14 | | pregnant women for a period of not less than 12 months following the |
|---|
| 15 | 15 | | date the woman delivers or experiences an involuntary miscarriage. |
|---|
| 16 | 16 | | (l-2) Notwithstanding Subsection (l-1), the commission |
|---|
| 17 | 17 | | shall continue to provide medical assistance to a woman who is |
|---|
| 18 | 18 | | eligible for medical assistance for pregnant women: |
|---|
| 19 | 19 | | (1) during the state fiscal year beginning September |
|---|
| 20 | 20 | | 1, 2019, for a period of not less than four months following the |
|---|
| 21 | 21 | | date the woman delivers or experiences an involuntary miscarriage; |
|---|
| 22 | 22 | | and |
|---|
| 23 | 23 | | (2) during the state fiscal year beginning September |
|---|
| 24 | 24 | | 1, 2020, for a period of not less than eight months following the |
|---|
| 25 | 25 | | date the woman delivers or experiences an involuntary miscarriage. |
|---|
| 26 | 26 | | (l-3) Subsection (l-2) and this subsection expire September |
|---|
| 27 | 27 | | 1, 2021. |
|---|
| 28 | 28 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 29 | 29 | | a state agency determines that a waiver or authorization from a |
|---|
| 30 | 30 | | federal agency is necessary for implementation of that provision, |
|---|
| 31 | 31 | | the agency affected by the provision shall request the waiver or |
|---|
| 32 | 32 | | authorization and may delay implementing that provision until the |
|---|
| 33 | 33 | | waiver or authorization is granted. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2019. |
