14 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 11 | | SECTION 1. Section 71.02(a), Penal Code, is amended to read |
---|
16 | 12 | | as follows: |
---|
17 | 13 | | (a) A person commits an offense if, with the intent to |
---|
18 | 14 | | establish, maintain, or participate in a combination or in the |
---|
19 | 15 | | profits of a combination or as a member of a criminal street gang, |
---|
20 | 16 | | the person commits or conspires to commit one or more of the |
---|
21 | 17 | | following: |
---|
22 | 18 | | (1) murder, capital murder, arson, aggravated |
---|
23 | 19 | | robbery, robbery, burglary, theft, aggravated kidnapping, |
---|
24 | 20 | | kidnapping, aggravated assault, aggravated sexual assault, sexual |
---|
25 | 21 | | assault, continuous sexual abuse of young child or children, |
---|
26 | 22 | | solicitation of a minor, forgery, deadly conduct, assault |
---|
27 | 23 | | punishable as a Class A misdemeanor, burglary of a motor vehicle, or |
---|
28 | 24 | | unauthorized use of a motor vehicle; |
---|
29 | 25 | | (2) any gambling offense punishable as a Class A |
---|
30 | 26 | | misdemeanor; |
---|
31 | 27 | | (3) promotion of prostitution, aggravated promotion |
---|
32 | 28 | | of prostitution, or compelling prostitution; |
---|
33 | 29 | | (4) unlawful manufacture, transportation, repair, or |
---|
34 | 30 | | sale of firearms or prohibited weapons; |
---|
35 | 31 | | (5) unlawful manufacture, delivery, dispensation, or |
---|
36 | 32 | | distribution of a controlled substance or dangerous drug, or |
---|
37 | 33 | | unlawful possession of a controlled substance or dangerous drug |
---|
38 | 34 | | through forgery, fraud, misrepresentation, or deception; |
---|
39 | 35 | | (5-a) causing the unlawful delivery, dispensation, or |
---|
40 | 36 | | distribution of a controlled substance or dangerous drug in |
---|
41 | 37 | | violation of Subtitle B, Title 3, Occupations Code; |
---|
42 | 38 | | (6) any unlawful wholesale promotion or possession of |
---|
43 | 39 | | any obscene material or obscene device with the intent to wholesale |
---|
44 | 40 | | promote the same; |
---|
45 | 41 | | (7) any offense under Subchapter B, Chapter 43, |
---|
46 | 42 | | depicting or involving conduct by or directed toward a child |
---|
47 | 43 | | younger than 18 years of age; |
---|
48 | 44 | | (8) any felony offense under Chapter 32; |
---|
49 | 45 | | (9) any offense under Chapter 36; |
---|
50 | 46 | | (10) any offense under Chapter 34, 35, or 35A; |
---|
51 | 47 | | (11) any offense under Section 37.11(a); |
---|
52 | 48 | | (12) any offense under Chapter 20A; |
---|
53 | 49 | | (13) any offense under Section 37.10; |
---|
54 | 50 | | (14) any offense under Section 38.06, 38.07, 38.09, or |
---|
55 | 51 | | 38.11; |
---|
56 | 52 | | (15) any offense under Section 42.10; |
---|
57 | 53 | | (16) any offense under Section 46.06(a)(1) or 46.14; |
---|
58 | 54 | | (17) any offense under Section 20.05 or 20.06; [or] |
---|
59 | 55 | | (18) any offense under Section 16.02; or |
---|
60 | 56 | | (19) any offense classified as a felony under the Tax |
---|
61 | 57 | | Code. |

62 | 58 | | SECTION 2. The change in law made by this Act applies only |
---|
63 | 59 | | to an offense committed on or after the effective date of this Act. |
---|
64 | 60 | | An offense committed before the effective date of this Act is |
---|
65 | 61 | | governed by the law in effect on the date the offense was committed, |
---|
66 | 62 | | and the former law is continued in effect for that purpose. For |
---|
67 | 63 | | purposes of this section, an offense was committed before the |
---|
68 | 64 | | effective date of this Act if any element of the offense occurred |
---|
69 | 65 | | before that date. |
---|
70 | 66 | | SECTION 3. This Act takes effect September 1, 2019. |
