4	6		AN ACT
5	7		relating to the authority of the Lubbock County Hospital District
6	8		of Lubbock County, Texas, to employ and commission peace officers.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Subchapter C, Chapter 1053, Special District
9	11		Local Laws Code, is amended by adding Section 1053.113 to read as
10	12		follows:
11	13		Sec. 1053.113. EMPLOYMENT OF DISTRICT PEACE OFFICERS.
12	14		(a) The board may employ and commission peace officers for the
13	15		district.
14	16		(b) The jurisdiction of a peace officer commissioned under
15	17		this section includes the property owned or controlled by the
16	18		district.
17	19		(c) In a district peace officer's jurisdiction, the peace
18	20		officer has the authority granted by Chapter 14, Code of Criminal
19	21		Procedure.
20	22		SECTION 2. Article 2.12, Code of Criminal Procedure, is
21	23		amended to read as follows:
22	24		Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
23	25		officers:
24	26		(1) sheriffs, their deputies, and those reserve
25	27		deputies who hold a permanent peace officer license issued under
26	28		Chapter 1701, Occupations Code;
27	29		(2) constables, deputy constables, and those reserve
28	30		deputy constables who hold a permanent peace officer license issued
29	31		under Chapter 1701, Occupations Code;
30	32		(3) marshals or police officers of an incorporated
31	33		city, town, or village, and those reserve municipal police officers
32	34		who hold a permanent peace officer license issued under Chapter
33	35		1701, Occupations Code;
34	36		(4) rangers, officers, and members of the reserve
35	37		officer corps commissioned by the Public Safety Commission and the
36	38		Director of the Department of Public Safety;
37	39		(5) investigators of the district attorneys', criminal
38	40		district attorneys', and county attorneys' offices;
39	41		(6) law enforcement agents of the Texas Alcoholic
40	42		Beverage Commission;
41	43		(7) each member of an arson investigating unit
42	44		commissioned by a city, a county, or the state;
43	45		(8) officers commissioned under Section 37.081,
44	46		Education Code, or Subchapter E, Chapter 51, Education Code;
45	47		(9) officers commissioned by the General Services
46	48		Commission;
47	49		(10) law enforcement officers commissioned by the
48	50		Parks and Wildlife Commission;
49	51		(11) airport police officers commissioned by a city
50	52		with a population of more than 1.18 million located primarily in a
51	53		county with a population of 2 million or more that operates an
52	54		airport that serves commercial air carriers;
53	55		(12) airport security personnel commissioned as peace
54	56		officers by the governing body of any political subdivision of this
55	57		state, other than a city described by Subdivision (11), that
56	58		operates an airport that serves commercial air carriers;
57	59		(13) municipal park and recreational patrolmen and
58	60		security officers;
59	61		(14) security officers and investigators commissioned
60	62		as peace officers by the comptroller;
61	63		(15) officers commissioned by a water control and
62	64		improvement district under Section 49.216, Water Code;
63	65		(16) officers commissioned by a board of trustees
64	66		under Chapter 54, Transportation Code;
65	67		(17) investigators commissioned by the Texas Medical
66	68		Board;
67	69		(18) officers commissioned by:
68	70		(A) the board of managers of the Dallas County
69	71		Hospital District, the Tarrant County Hospital District, the Bexar
70	72		County Hospital District, or the El Paso County Hospital District
71	73		under Section 281.057, Health and Safety Code;
72	74		(B) the board of directors of the Ector County
73	75		Hospital District under Section 1024.117, Special District Local
74	76		Laws Code; [and]
75	77		(C) the board of directors of the Midland County
76	78		Hospital District of Midland County, Texas, under Section 1061.121,
77	79		Special District Local Laws Code; and
78	80		(D) the board of hospital managers of the Lubbock
79	81		County Hospital District of Lubbock County, Texas, under Section
80	82		1053.113, Special District Local Laws Code;
81	83		(19) county park rangers commissioned under
82	84		Subchapter E, Chapter 351, Local Government Code;
83	85		(20) investigators employed by the Texas Racing
84	86		Commission;
85	87		(21) officers commissioned under Chapter 554,
86	88		Occupations Code;
87	89		(22) officers commissioned by the governing body of a
88	90		metropolitan rapid transit authority under Section 451.108,
89	91		Transportation Code, or by a regional transportation authority
90	92		under Section 452.110, Transportation Code;
91	93		(23) investigators commissioned by the attorney
92	94		general under Section 402.009, Government Code;
93	95		(24) security officers and investigators commissioned
94	96		as peace officers under Chapter 466, Government Code;
95	97		(25) officers appointed by an appellate court under
96	98		Subchapter F, Chapter 53, Government Code;
97	99		(26) officers commissioned by the state fire marshal
98	100		under Chapter 417, Government Code;
99	101		(27) an investigator commissioned by the commissioner
100	102		of insurance under Section 701.104, Insurance Code;
101	103		(28) apprehension specialists and inspectors general
102	104		commissioned by the Texas Juvenile Justice Department as officers
103	105		under Sections 242.102 and 243.052, Human Resources Code;
104	106		(29) officers appointed by the inspector general of
105	107		the Texas Department of Criminal Justice under Section 493.019,
106	108		Government Code;
107	109		(30) investigators commissioned by the Texas
108	110		Commission on Law Enforcement under Section 1701.160, Occupations
109	111		Code;
110	112		(31) commission investigators commissioned by the
111	113		Texas Private Security Board under Section 1702.061, Occupations
112	114		Code;
113	115		(32) the fire marshal and any officers, inspectors, or
114	116		investigators commissioned by an emergency services district under
115	117		Chapter 775, Health and Safety Code;
116	118		(33) officers commissioned by the State Board of
117	119		Dental Examiners under Section 254.013, Occupations Code, subject
118	120		to the limitations imposed by that section;
119	121		(34) investigators commissioned by the Texas Juvenile
120	122		Justice Department as officers under Section 221.011, Human
121	123		Resources Code; and
122	124		(35) the fire marshal and any related officers,
123	125		inspectors, or investigators commissioned by a county under
124	126		Subchapter B, Chapter 352, Local Government Code.
125	127		SECTION 3. This Act takes effect immediately if it receives
126	128		a vote of two-thirds of all the members elected to each house, as
127	129		provided by Section 39, Article III, Texas Constitution. If this
128	130		Act does not receive the vote necessary for immediate effect, this
129	131		Act takes effect September 1, 2019.
