46 AN ACT
57 relating to the authority of the Lubbock County Hospital District
68 of Lubbock County, Texas, to employ and commission peace officers.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter C, Chapter 1053, Special District
911 Local Laws Code, is amended by adding Section 1053.113 to read as
1012 follows:
1113 Sec. 1053.113. EMPLOYMENT OF DISTRICT PEACE OFFICERS.
1214 (a) The board may employ and commission peace officers for the
1315 district.
1416 (b) The jurisdiction of a peace officer commissioned under
1517 this section includes the property owned or controlled by the
1618 district.
1719 (c) In a district peace officer's jurisdiction, the peace
1820 officer has the authority granted by Chapter 14, Code of Criminal
1921 Procedure.
2022 SECTION 2. Article 2.12, Code of Criminal Procedure, is
2123 amended to read as follows:
2224 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
2325 officers:
2426 (1) sheriffs, their deputies, and those reserve
2527 deputies who hold a permanent peace officer license issued under
2628 Chapter 1701, Occupations Code;
2729 (2) constables, deputy constables, and those reserve
2830 deputy constables who hold a permanent peace officer license issued
2931 under Chapter 1701, Occupations Code;
3032 (3) marshals or police officers of an incorporated
3133 city, town, or village, and those reserve municipal police officers
3234 who hold a permanent peace officer license issued under Chapter
3335 1701, Occupations Code;
3436 (4) rangers, officers, and members of the reserve
3537 officer corps commissioned by the Public Safety Commission and the
3638 Director of the Department of Public Safety;
3739 (5) investigators of the district attorneys', criminal
3840 district attorneys', and county attorneys' offices;
3941 (6) law enforcement agents of the Texas Alcoholic
4042 Beverage Commission;
4143 (7) each member of an arson investigating unit
4244 commissioned by a city, a county, or the state;
4345 (8) officers commissioned under Section 37.081,
4446 Education Code, or Subchapter E, Chapter 51, Education Code;
4547 (9) officers commissioned by the General Services
4648 Commission;
4749 (10) law enforcement officers commissioned by the
4850 Parks and Wildlife Commission;
4951 (11) airport police officers commissioned by a city
5052 with a population of more than 1.18 million located primarily in a
5153 county with a population of 2 million or more that operates an
5254 airport that serves commercial air carriers;
5355 (12) airport security personnel commissioned as peace
5456 officers by the governing body of any political subdivision of this
5557 state, other than a city described by Subdivision (11), that
5658 operates an airport that serves commercial air carriers;
5759 (13) municipal park and recreational patrolmen and
5860 security officers;
5961 (14) security officers and investigators commissioned
6062 as peace officers by the comptroller;
6163 (15) officers commissioned by a water control and
6264 improvement district under Section 49.216, Water Code;
6365 (16) officers commissioned by a board of trustees
6466 under Chapter 54, Transportation Code;
6567 (17) investigators commissioned by the Texas Medical
6668 Board;
6769 (18) officers commissioned by:
6870 (A) the board of managers of the Dallas County
6971 Hospital District, the Tarrant County Hospital District, the Bexar
7072 County Hospital District, or the El Paso County Hospital District
7173 under Section 281.057, Health and Safety Code;
7274 (B) the board of directors of the Ector County
7375 Hospital District under Section 1024.117, Special District Local
7476 Laws Code; [and]
7577 (C) the board of directors of the Midland County
7678 Hospital District of Midland County, Texas, under Section 1061.121,
7779 Special District Local Laws Code; and
7880 (D) the board of hospital managers of the Lubbock
7981 County Hospital District of Lubbock County, Texas, under Section
8082 1053.113, Special District Local Laws Code;
8183 (19) county park rangers commissioned under
8284 Subchapter E, Chapter 351, Local Government Code;
8385 (20) investigators employed by the Texas Racing
8486 Commission;
8587 (21) officers commissioned under Chapter 554,
8688 Occupations Code;
8789 (22) officers commissioned by the governing body of a
8890 metropolitan rapid transit authority under Section 451.108,
8991 Transportation Code, or by a regional transportation authority
9092 under Section 452.110, Transportation Code;
9193 (23) investigators commissioned by the attorney
9294 general under Section 402.009, Government Code;
9395 (24) security officers and investigators commissioned
9496 as peace officers under Chapter 466, Government Code;
9597 (25) officers appointed by an appellate court under
9698 Subchapter F, Chapter 53, Government Code;
9799 (26) officers commissioned by the state fire marshal
98100 under Chapter 417, Government Code;
99101 (27) an investigator commissioned by the commissioner
100102 of insurance under Section 701.104, Insurance Code;
101103 (28) apprehension specialists and inspectors general
102104 commissioned by the Texas Juvenile Justice Department as officers
103105 under Sections 242.102 and 243.052, Human Resources Code;
104106 (29) officers appointed by the inspector general of
105107 the Texas Department of Criminal Justice under Section 493.019,
106108 Government Code;
107109 (30) investigators commissioned by the Texas
108110 Commission on Law Enforcement under Section 1701.160, Occupations
109111 Code;
110112 (31) commission investigators commissioned by the
111113 Texas Private Security Board under Section 1702.061, Occupations
112114 Code;
113115 (32) the fire marshal and any officers, inspectors, or
114116 investigators commissioned by an emergency services district under
115117 Chapter 775, Health and Safety Code;
116118 (33) officers commissioned by the State Board of
117119 Dental Examiners under Section 254.013, Occupations Code, subject
118120 to the limitations imposed by that section;
119121 (34) investigators commissioned by the Texas Juvenile
120122 Justice Department as officers under Section 221.011, Human
121123 Resources Code; and
122124 (35) the fire marshal and any related officers,
123125 inspectors, or investigators commissioned by a county under
124126 Subchapter B, Chapter 352, Local Government Code.
125127 SECTION 3. This Act takes effect immediately if it receives
126128 a vote of two-thirds of all the members elected to each house, as
127129 provided by Section 39, Article III, Texas Constitution. If this
128130 Act does not receive the vote necessary for immediate effect, this
129131 Act takes effect September 1, 2019.
