| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter A, Chapter 501, Government Code, is | |
| 11 | 11 | amended by adding Section 501.026 to read as follows: | |
| 12 | 12 | Sec. 501.026. TEMPERATURE REQUIREMENTS AT DEPARTMENT | |
| 13 | 13 | FACILITIES. The department shall ensure that the temperature in | |
| 14 | 14 | each facility operated by the department is maintained at not less | |
| 15 | 15 | than 65 degrees Fahrenheit or more than 85 degrees Fahrenheit. | |
| 16 | 16 | SECTION 2. The Texas Department of Criminal Justice is not | |
| 17 | 17 | required to comply with the requirements of Section 501.026, | |
| 18 | 18 | Government Code, as added by this Act, until September 1, 2020. | |
| 19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2019. |
