57 relating to the creation of a grant program to assist law
68 enforcement agencies with the purchase of opioid antagonists.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter A, Chapter 772, Government Code, is
911 amended by adding Section 772.0078 to read as follows:
1012 Sec. 772.0078. OPIOID ANTAGONIST GRANT PROGRAM. (a) In
1113 this section:
1214 (1) "Criminal justice division" means the criminal
1315 justice division established under Section 772.006.
1416 (2) "Opioid antagonist" and "opioid-related drug
1517 overdose" have the meanings assigned by Section 483.101, Health and
1618 Safety Code.
1719 (b) The criminal justice division shall establish and
1820 administer a grant program to provide financial assistance to a law
1921 enforcement agency in this state that seeks to provide opioid
2022 antagonists to peace officers, evidence technicians, and related
2123 personnel who, in the course of performing their duties, are likely
2224 to come into contact with opioids or encounter persons suffering
2325 from an apparent opioid-related drug overdose.
2426 (c) A law enforcement agency may apply for a grant under
2527 this section only if the agency first adopts a policy addressing the
2628 usage of an opioid antagonist for a person suffering from an
2729 apparent opioid-related drug overdose.
2830 (d) In an application for a grant under this section, the
2931 law enforcement agency shall provide information to the criminal
3032 justice division about the frequency and nature of:
3133 (1) interactions between peace officers and persons
3234 suffering from an apparent opioid-related drug overdose;
3335 (2) calls for assistance based on an apparent
3436 opioid-related drug overdose; and
3537 (3) any exposure of peace officers, evidence
3638 technicians, or related personnel to opioids or suspected opioids
3739 in the course of performing their duties and any reactions by those
3840 persons to those substances.
3941 (e) A law enforcement agency receiving a grant under this
4042 section shall, as soon as practicable after receiving the grant,
4143 provide to the criminal justice division proof of purchase of the
4244 opioid antagonists.
4345 (f) The criminal justice division may use any money
4446 available for purposes of this section.
4547 SECTION 2. The criminal justice division of the governor's
4648 office is required to implement a provision of this Act only if the
4749 legislature appropriates money specifically for that purpose. If
4850 the legislature does not appropriate money specifically for that
4951 purpose, the criminal justice division of the governor's office
5052 may, but is not required to, implement a provision of this Act using
5153 other appropriations available for that purpose.
5254 SECTION 3. This Act takes effect immediately if it receives
5355 a vote of two-thirds of all the members elected to each house, as
5456 provided by Section 39, Article III, Texas Constitution. If this
5557 Act does not receive the vote necessary for immediate effect, this
5658 Act takes effect September 1, 2019.
