66 AN ACT
77 relating to the participation of campus-based mental health
88 professionals in certain health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 843.010, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 843.010. APPLICABILITY OF CERTAIN PROVISIONS TO
1313 GOVERNMENTAL HEALTH BENEFIT PLANS. (a) Sections 843.306(f) and
1414 843.363(a)(4) do not apply to coverage under:
1515 (1) the child health plan program under Chapter 62,
1616 Health and Safety Code, or the health benefits plan for children
1717 under Chapter 63, Health and Safety Code; or
1818 (2) a Medicaid program, including a Medicaid managed
1919 care program operated under Chapter 533, Government Code.
2020 (b) Section 843.3046 applies to:
2121 (1) a basic coverage plan under Chapter 1551;
2222 (2) a basic plan under Chapter 1575;
2323 (3) a primary care coverage plan under Chapter 1579;
2424 (4) a plan providing basic coverage under Chapter
2525 1601;
2626 (5) the Medicaid managed care program operated under
2727 Chapter 533, Government Code; and
2828 (6) the child health plan program under Chapter 62,
2929 Health and Safety Code.
3030 SECTION 2. Subchapter I, Chapter 843, Insurance Code, is
3131 amended by adding Section 843.3046 to read as follows:
3232 Sec. 843.3046. CAMPUS-BASED MENTAL HEALTH PROFESSIONALS.
3333 (a) In this section:
3434 (1) "Campus-based mental health professional" means a
3535 licensed clinical social worker, professional counselor,
3636 psychological associate, or psychologist who provides mental
3737 health care services primarily or exclusively at a campus of a
3838 school district or an open-enrollment charter school.
3939 (2) "Open-enrollment charter school" means a school
4040 that has been granted a charter under Subchapter D, Chapter 12,
4141 Education Code.
4242 (3) "School district" means a public school district
4343 created under the laws of this state.
4444 (b) If a health maintenance organization includes mental
4545 health care services in the services covered by the health
4646 maintenance organization's health care plan, the health
4747 maintenance organization may not reject the initial application of
4848 a campus-based mental health professional to contract with the
4949 health maintenance organization to provide mental health care
5050 services on behalf of the health maintenance organization based on
5151 a determination that the health maintenance organization has
5252 contracted with sufficient qualified mental health care providers
5353 in the applicant's geographic area.
5454 (c) A campus-based mental health professional who applies
5555 to a health maintenance organization to contract with the health
5656 maintenance organization to provide mental health care services on
5757 behalf of the health maintenance organization is entitled to an
5858 expedited decision on the application.
5959 SECTION 3. Subchapter C, Chapter 848, Insurance Code, is
6060 amended by adding Section 848.111 to read as follows:
6161 Sec. 848.111. CAMPUS-BASED MENTAL HEALTH PROFESSIONALS.
6262 (a) In this section:
6363 (1) "Campus-based mental health professional" means a
6464 licensed clinical social worker, professional counselor,
6565 psychological associate, or psychologist who provides mental
6666 health care services primarily or exclusively at a campus of a
6767 school district or an open-enrollment charter school.
6868 (2) "Open-enrollment charter school" means a school
6969 that has been granted a charter under Subchapter D, Chapter 12,
7070 Education Code.
7171 (3) "School district" means a public school district
7272 created under the laws of this state.
7373 (b) If a health care collaborative includes mental health
7474 care services in the services covered by the health care
7575 collaborative's health care plan, the health care collaborative may
7676 not reject the initial application of a campus-based mental health
7777 professional to contract with the health care collaborative to
7878 provide mental health care services as part of the health care
7979 collaborative's delivery network based on a determination that the
8080 health care collaborative has contracted with sufficient qualified
8181 mental health care providers in the applicant's geographic area.
8282 (c) A campus-based mental health professional who applies
8383 to a health care collaborative for inclusion in the health care
8484 collaborative's delivery network is entitled to an expedited
8585 decision on the application.
8686 SECTION 4. Subchapter B, Chapter 1301, Insurance Code, is
8787 amended by adding Section 1301.0516 to read as follows:
8888 Sec. 1301.0516. CERTAIN CAMPUS-BASED MENTAL HEALTH
8989 SERVICES. (a) In this section:
9090 (1) "Campus-based mental health professional" means a
9191 licensed clinical social worker, professional counselor,
9292 psychological associate, or psychologist who provides mental
9393 health care services primarily or exclusively at a campus of a
9494 school district or an open-enrollment charter school.
9595 (2) "Open-enrollment charter school" means a school
9696 that has been granted a charter under Subchapter D, Chapter 12,
9797 Education Code.
9898 (3) "School district" means a public school district
9999 created under the laws of this state.
100100 (b) Notwithstanding any other law, this section applies to:
101101 (1) a basic coverage plan under Chapter 1551;
102102 (2) a basic plan under Chapter 1575;
103103 (3) a primary care coverage plan under Chapter 1579;
104104 and
105105 (4) a plan providing basic coverage under Chapter
106106 1601.
107107 (c) If an insurer offers a preferred provider benefit plan
108108 that includes mental health care services in the services covered
109109 by the plan, the insurer may not reject the initial application of a
110110 campus-based mental health professional to contract for
111111 designation as a preferred provider under the plan based on a
112112 determination that the insurer has contracted with sufficient
113113 qualified mental health care providers in the applicant's
114114 geographic area.
115115 (d) A campus-based mental health professional who applies
116116 to an insurer for designation as a preferred provider is entitled to
117117 an expedited decision on the application.
118118 SECTION 5. (a) Section 843.3046, Insurance Code, as added
119119 by this Act, applies only to an application to contract with a
120120 health maintenance organization submitted on or after the effective
121121 date of this Act.
122122 (b) Section 848.111, Insurance Code, as added by this Act,
123123 applies only to an application to contract with a health care
124124 collaborative submitted on or after the effective date of this Act.
125125 (c) Section 1301.0516, Insurance Code, as added by this Act,
126126 applies only to an application to contract with an insurer
127127 submitted on or after the effective date of this Act.
128128 SECTION 6. This Act takes effect September 1, 2019.
