95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to the enforcement of commercial motor vehicle safety
128 standards in certain municipalities.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 644.101(b), Transportation Code, as
1511 amended by Chapters 138 (H.B. 1355), 142 (H.B. 1570), and 324 (S.B.
1612 1488), Acts of the 85th Legislature, Regular Session, 2017, is
1713 reenacted and amended to read as follows:
1814 (b) A police officer of any of the following municipalities
1915 is eligible to apply for certification under this section:
2016 (1) a municipality with a population of 50,000 or
2117 more;
2218 (2) a municipality with a population of 25,000 or more
2319 any part of which is located in a county with a population of
2420 500,000 or more;
2521 (3) a municipality with a population of less than
2622 25,000:
2723 (A) any part of which is located in a county with
2824 a population of 3.3 million; and
2925 (B) that contains or is adjacent to an
3026 international port;
3127 (4) a municipality with a population of at least
3228 34,000 that is located in a county that borders two or more states;
3329 (5) a municipality any part of which is located in a
3430 county bordering the United Mexican States;
3531 (6) a municipality with a population of less than
3632 5,000 that is located:
3733 (A) adjacent to a bay connected to the Gulf of
3834 Mexico; and
3935 (B) in a county adjacent to a county with a
4036 population greater than 3.3 million;
4137 (7) a municipality that is located:
4238 (A) within 25 miles of an international port; and
4339 (B) in a county that does not contain a highway
4440 that is part of the national system of interstate and defense
4541 highways and is adjacent to a county with a population greater than
4642 3.3 million;
4743 (8) a municipality with a population of less than
4844 8,500 that:
4945 (A) is the county seat; and
5046 (B) contains a highway that is part of the
5147 national system of interstate and defense highways;
5248 (9) a municipality located in a county with a
5349 population between 60,000 and 66,000 adjacent to a bay connected to
5450 the Gulf of Mexico;
5551 (10) a municipality with a population of more than
5652 40,000 and less than 50,000 that is located in a county with a
5753 population of more than 285,000 and less than 300,000 that borders
5854 the Gulf of Mexico; [or]
5955 (11) a municipality with a population between 18,000
6056 and 18,500 that is located entirely in a county that:
6157 (A) has a population of less than 200,000;
6258 (B) is adjacent to two counties that each have a
6359 population of more than 1.2 million; and
6460 (C) contains two highways that are part of the
6561 national system of interstate and defense highways;
6662 (12) [(11)] a municipality with a population of more
6763 than 3,000 and less than 10,000 that:
6864 (A) contains a highway that is part of the
6965 national system of interstate and defense highways; and
7066 (B) is located in a county with a population
7167 between 150,000 and 155,000; or
7268 (13) a municipality with a population between 14,000
7369 and 17,000 that:
7470 (A) contains three or more numbered United States
7571 highways; and
7672 (B) is located in a county that is adjacent to a
7773 county with a population of more than 200,000.
7874 SECTION 2. To the extent of any conflict, this Act prevails
7975 over another Act of the 86th Legislature, Regular Session, 2019,
8076 relating to nonsubstantive additions to and corrections in enacted
8177 codes.
8278 SECTION 3. This Act takes effect September 1, 2019.
