96 relating to policies on the recess period in public schools.
107 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. Subchapter A, Chapter 28, Education Code, is
8+ SECTION 1. Section 28.004(l), Education Code, is amended to
9+ read as follows:
10+ (l) The local school health advisory council shall consider
11+ and make policy recommendations to the district concerning the
12+ importance of daily recess for elementary school students. The
13+ council must consider research regarding unstructured and
14+ undirected play, academic and social development, and the health
15+ benefits of daily recess and the model recess policies developed by
16+ the Department of State Health Services School Health Advisory
17+ Committee under Section 28.0047, in making the recommendations.
18+ The council shall ensure that local community values are reflected
19+ in any policy recommendation made to the district under this
20+ subsection.
21+ SECTION 2. Subchapter A, Chapter 28, Education Code, is
1222 amended by adding Sections 28.0047 and 28.0048 to read as follows:
1323 Sec. 28.0047. MODEL RECESS POLICIES. The Department of
1424 State Health Services School Health Advisory Committee established
1525 under Section 1001.0711, Health and Safety Code, shall develop
16- model policies for the recess period during the school day that
17- encourage constructive, age-appropriate outdoor playtime. The
18- model policies must include guidelines for outdoor equipment and
19- facilities on public school campuses that maximize the
20- effectiveness of outdoor physical activity.
26+ model policies for the recess period during the school day. The
27+ model policies must include guidelines for:
28+ (1) the number of minutes of weekly unstructured
29+ playtime; and
30+ (2) whether a student's recess time may be withheld as
31+ a form of student discipline.
2132 Sec. 28.0048. RECESS POLICY. (a) The board of trustees of
2233 each school district shall:
2334 (1) after reviewing the model recess policies
2435 developed under Section 28.0047 and the policy recommendations of
2536 the local school health advisory council provided under Section
26- 28.004(l), adopt a recess policy based on those model policies and
27- recommendations; and
37+ 28.004(l), adopt a recess policy; and
2838 (2) review and, if necessary, revise the recess policy
2939 at least every five years.
3040 (b) The recess policy must specify:
3141 (1) the required number of minutes of weekly
3242 unstructured playtime; and
3343 (2) whether a student's recess time may be withheld as
3444 a form of student discipline.
3545 (c) Each school district campus subject to the district
3646 recess policy adopted under Subsection (a) shall implement the
3747 recess policy.
38- SECTION 2. (a) Not later than January 1, 2020, the

4858 added by this Act, shall implement the adopted policy.
49- SECTION 3. This Act takes effect immediately if it receives

5060 a vote of two-thirds of all the members elected to each house, as
5161 provided by Section 39, Article III, Texas Constitution. If this
5262 Act does not receive the vote necessary for immediate effect, this
5363 Act takes effect September 1, 2019.
