55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution for and punishment for the
88 offense of trespass by certain persons carrying handguns.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30.06, Penal Code, is amended by
1111 amending Subsection (d) and adding Subsection (g) to read as
1212 follows:
1313 (d) An offense under this section is a Class C misdemeanor
1414 punishable by a fine not to exceed $5 [$200], except that the
1515 offense is a Class C [A] misdemeanor punishable by a fine not to
1616 exceed $200 if it is shown on the trial of the offense that, after
1717 entering the property, the license holder was personally given the
1818 notice by oral communication described by Subsection (b) and
1919 [subsequently] failed to depart promptly.
2020 (g) It is a defense to prosecution under this section that,
2121 after entering the property, the license holder was personally
2222 given the notice by oral communication described by Subsection (b)
2323 and promptly departed from the property.
2424 SECTION 2. Section 30.07, Penal Code, is amended by
2525 amending Subsection (d) and adding Subsection (h) to read as
2626 follows:
2727 (d) An offense under this section is a Class C misdemeanor
2828 punishable by a fine not to exceed $5 [$200], except that the
2929 offense is a Class C [A] misdemeanor punishable by a fine not to
3030 exceed $200 if it is shown on the trial of the offense that, after
3131 entering the property, the license holder was personally given the
3232 notice by oral communication described by Subsection (b) and
3333 [subsequently] failed to depart promptly.
3434 (h) It is a defense to prosecution under this section that,
3535 after entering the property, the license holder was personally
3636 given the notice by oral communication described by Subsection (b)
3737 and promptly departed from the property.
3838 SECTION 3. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 4. This Act takes effect September 1, 2019.
