| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 372.0035, Local Government Code, is |
|---|
| 9 | 11 | | amended by amending Subsection (a) and adding Subsection (e) to |
|---|
| 10 | 12 | | read as follows: |
|---|
| 11 | 13 | | (a) This section applies only to: |
|---|
| 12 | 14 | | (1) a municipality that: |
|---|
| 13 | 15 | | (A) has a population of more than 650,000 and |
|---|
| 14 | 16 | | less than two million; [or] |
|---|
| 15 | 17 | | (B) has a population of more than 325,000 and |
|---|
| 16 | 18 | | less than 625,000; or |
|---|
| 17 | 19 | | (C) has a population of more than 100,000 and |
|---|
| 18 | 20 | | less than 125,000 and is wholly located in a county with a |
|---|
| 19 | 21 | | population of more than 650,000; and |
|---|
| 20 | 22 | | (2) a public improvement district established under |
|---|
| 21 | 23 | | this subchapter and solely composed of territory in which the only |
|---|
| 22 | 24 | | businesses are: |
|---|
| 23 | 25 | | (A) hotels with 100 or more rooms ordinarily used |
|---|
| 24 | 26 | | for sleeping, if the district is established by a municipality |
|---|
| 25 | 27 | | described by Subdivision (1)(A); or |
|---|
| 26 | 28 | | (B) hotels with 75 or more rooms ordinarily used |
|---|
| 27 | 29 | | for sleeping, if the district is established by a municipality |
|---|
| 28 | 30 | | described by Subdivision (1)(B) or (C). |
|---|
| 29 | 31 | | (e) A municipality described by Subsection (a)(1)(C) may |
|---|
| 30 | 32 | | undertake a project under this section only for a purpose described |
|---|
| 31 | 33 | | by Section 372.003(b)(13). |

| 32 | 34 | | SECTION 2. This Act takes effect September 1, 2019. |
