66 AN ACT
77 relating to certain criminal offenses concerning the unlawful
88 transfer or purchase of certain weapons; increasing a criminal
99 penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 46.06, Penal Code, is
1212 amended to read as follows:
1313 Sec. 46.06. UNLAWFUL TRANSFER OR PURCHASE OF CERTAIN
1414 WEAPONS.
1515 SECTION 2. Section 46.06, Penal Code, is amended by
1616 amending Subsections (a), (c), and (d) and adding Subsections
1717 (a-1), (c-1), (e), and (f) to read as follows:
1818 (a) A person commits an offense if the person:
1919 (1) sells, rents, leases, loans, or gives a firearm
2020 [handgun] to any person knowing that the person to whom the firearm
2121 [handgun] is to be delivered intends to use the firearm [it]
2222 unlawfully or in the commission of an unlawful act;
2323 (2) purchases or attempts to purchase a firearm with
2424 intent to deliver the firearm to a person knowing that the person to
2525 whom the firearm is to be delivered intends to possess the firearm
2626 unlawfully or to use the firearm unlawfully or in the commission of
2727 an unlawful act; or
2828 (3) knowingly makes a materially false or misleading
2929 statement in providing information to a person for purposes of
3030 complying with the national instant criminal background check
3131 system in the manner required by 18 U.S.C. Section 922.
3232 (a-1) A person commits an offense if the person:
3333 (1) [(2)] intentionally or knowingly sells, rents,
3434 leases, or gives or offers to sell, rent, lease, or give to any
3535 child younger than 18 years of age any firearm, club, or
3636 location-restricted knife;
3737 (2) [(3)] intentionally, knowingly, or recklessly
3838 sells a firearm or ammunition for a firearm to any person who is
3939 intoxicated;
4040 (3) [(4)] knowingly sells a firearm or ammunition for
4141 a firearm to any person who has been convicted of a felony before
4242 the fifth anniversary of the later of the following dates:
4343 (A) the person's release from confinement
4444 following conviction of the felony; or
4545 (B) the person's release from supervision under
4646 community supervision, parole, or mandatory supervision following
4747 conviction of the felony;
4848 (4) [(5)] sells, rents, leases, loans, or gives a
4949 handgun to any person knowing that an active protective order is
5050 directed to the person to whom the handgun is to be delivered; or
5151 (5) [(6)] knowingly purchases, rents, leases, or
5252 receives as a loan or gift from another a handgun while an active
5353 protective order is directed to the actor.
5454 (c) It is an affirmative defense to prosecution under
5555 Subsection (a-1)(1) [(a)(2)] that the transfer was to a minor whose
5656 parent or the person having legal custody of the minor had given
5757 written permission for the sale or, if the transfer was other than a
5858 sale, the parent or person having legal custody had given effective
5959 consent.
6060 (c-1) The renunciation defense described by Section
6161 15.04(a) is available as an affirmative defense to prosecution of
6262 an attempted purchase under Subsection (a)(2).
6363 (d) An offense under Subsection (a) is a felony of the third
6464 degree.
6565 (e) An offense under Subsection (a-1) [this section] is a
6666 Class A misdemeanor, except that an offense under Subsection
6767 (a-1)(1) [(a)(2)] is a state jail felony if the weapon that is the
6868 subject of the offense is a handgun.
6969 (f) To the extent of any conflict between this section and a
7070 federal law related to the unlawful transfer or purchase of
7171 weapons, the federal law prevails.
7272 SECTION 3. Article 59.01(2), Code of Criminal Procedure, is
7373 amended to read as follows:
7474 (2) "Contraband" means property of any nature,
7575 including real, personal, tangible, or intangible, that is:
7676 (A) used in the commission of:
7777 (i) any first or second degree felony under
7878 the Penal Code;
7979 (ii) any felony under Section 15.031(b),
8080 20.05, 20.06, 21.11, 38.04, or Chapter 43, 20A, 29, 30, 31, 32, 33,
8181 33A, or 35, Penal Code;
8282 (iii) any felony under The Securities Act
8383 (Article 581-1 et seq., Vernon's Texas Civil Statutes); or
8484 (iv) any offense under Chapter 49, Penal
8585 Code, that is punishable as a felony of the third degree or state
8686 jail felony, if the defendant has been previously convicted three
8787 times of an offense under that chapter;
8888 (B) used or intended to be used in the commission
8989 of:
9090 (i) any felony under Chapter 481, Health
9191 and Safety Code (Texas Controlled Substances Act);
9292 (ii) any felony under Chapter 483, Health
9393 and Safety Code;
9494 (iii) a felony under Chapter 151, Finance
9595 Code;
9696 (iv) any felony under Chapter 34, Penal
9797 Code;
9898 (v) a Class A misdemeanor under Subchapter
9999 B, Chapter 365, Health and Safety Code, if the defendant has been
100100 previously convicted twice of an offense under that subchapter;
101101 (vi) any felony under Chapter 32, Human
102102 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
103103 involves the state Medicaid program;
104104 (vii) a Class B misdemeanor under Chapter
105105 522, Business & Commerce Code;
106106 (viii) a Class A misdemeanor under Section
107107 306.051, Business & Commerce Code;
108108 (ix) any offense under Section 42.10, Penal
109109 Code;
110110 (x) any offense under Section 46.06(a)
111111 [46.06(a)(1)] or 46.14, Penal Code;
112112 (xi) any offense under Chapter 71, Penal
113113 Code;
114114 (xii) any offense under Section 20.05 or
115115 20.06, Penal Code; or
116116 (xiii) an offense under Section 326.002,
117117 Business & Commerce Code;
118118 (C) the proceeds gained from the commission of a
119119 felony listed in Paragraph (A) or (B) of this subdivision, a
120120 misdemeanor listed in Paragraph (B)(vii), (ix), (x), or (xi) of
121121 this subdivision, or a crime of violence;
122122 (D) acquired with proceeds gained from the
123123 commission of a felony listed in Paragraph (A) or (B) of this
124124 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
125125 or (xi) of this subdivision, or a crime of violence;
126126 (E) used to facilitate or intended to be used to
127127 facilitate the commission of a felony under Section 15.031 or
128128 43.25, Penal Code; or
129129 (F) used to facilitate or intended to be used to
130130 facilitate the commission of a felony under Section 20A.02 or
131131 Chapter 43, Penal Code.
132132 SECTION 4. Section 71.02(a), Penal Code, is amended to read
133133 as follows:
134134 (a) A person commits an offense if, with the intent to
135135 establish, maintain, or participate in a combination or in the
136136 profits of a combination or as a member of a criminal street gang,
137137 the person commits or conspires to commit one or more of the
138138 following:
139139 (1) murder, capital murder, arson, aggravated
140140 robbery, robbery, burglary, theft, aggravated kidnapping,
141141 kidnapping, aggravated assault, aggravated sexual assault, sexual
142142 assault, continuous sexual abuse of young child or children,
143143 solicitation of a minor, forgery, deadly conduct, assault
144144 punishable as a Class A misdemeanor, burglary of a motor vehicle, or
145145 unauthorized use of a motor vehicle;
146146 (2) any gambling offense punishable as a Class A
147147 misdemeanor;
148148 (3) promotion of prostitution, aggravated promotion
149149 of prostitution, or compelling prostitution;
150150 (4) unlawful manufacture, transportation, repair, or
151151 sale of firearms or prohibited weapons;
152152 (5) unlawful manufacture, delivery, dispensation, or
153153 distribution of a controlled substance or dangerous drug, or
154154 unlawful possession of a controlled substance or dangerous drug
155155 through forgery, fraud, misrepresentation, or deception;
156156 (5-a) causing the unlawful delivery, dispensation, or
157157 distribution of a controlled substance or dangerous drug in
158158 violation of Subtitle B, Title 3, Occupations Code;
159159 (6) any unlawful wholesale promotion or possession of
160160 any obscene material or obscene device with the intent to wholesale
161161 promote the same;
162162 (7) any offense under Subchapter B, Chapter 43,
163163 depicting or involving conduct by or directed toward a child
164164 younger than 18 years of age;
165165 (8) any felony offense under Chapter 32;
166166 (9) any offense under Chapter 36;
167167 (10) any offense under Chapter 34, 35, or 35A;
168168 (11) any offense under Section 37.11(a);
169169 (12) any offense under Chapter 20A;
170170 (13) any offense under Section 37.10;
171171 (14) any offense under Section 38.06, 38.07, 38.09, or
172172 38.11;
173173 (15) any offense under Section 42.10;
174174 (16) any offense under Section 46.06(a) [46.06(a)(1)]
175175 or 46.14;
176176 (17) any offense under Section 20.05 or 20.06; or
177177 (18) any offense classified as a felony under the Tax
178178 Code.
179179 SECTION 5. The change in law made by this Act applies only
180180 to an offense committed on or after the effective date of this Act.
181181 An offense committed before the effective date of this Act is
182182 governed by the law in effect on the date the offense was committed,
183183 and the former law is continued in effect for that purpose. For
184184 purposes of this section, an offense was committed before the
185185 effective date of this Act if any element of the offense occurred
186186 before that date.
187187 SECTION 6. This Act takes effect September 1, 2019.
