7	7	relating to the consolidation and allocation of state civil court
8	8	costs; increasing certain civil court costs.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 22.2021(b), Government Code, is amended
11	11	to read as follows:
12	12	(b) To fund the system, the commissioners court shall use
13	13	the court costs fee collected as provided by Sections 133.151(a)(6)
14	14	and 133.1511(a)(4), Local Government Code, [set a court costs fee
15	15	of not more than $5] for each civil suit filed in county court,
16	16	county court at law, probate court, or district court in the county.
17	17	SECTION 2. Section 22.2031(b), Government Code, is amended
18	18	to read as follows:
19	19	(b) To fund the system, the commissioners court shall use
20	20	the court costs fee collected as provided by Sections 133.151(a)(6)
21	21	and 133.1511(a)(4), Local Government Code, [set a court costs fee
22	22	of $5] for each civil suit filed in county court, statutory county
23	23	court, statutory probate court, or district court in the county.
24	24	SECTION 3. Section 22.2041(b), Government Code, is amended
25	25	to read as follows:
26	26	(b) To fund the system, the commissioners court shall use
27	27	the court costs fee collected as provided by Sections 133.151(a)(6)
28	28	and 133.1511(a)(4), Local Government Code, [set a court costs fee

71	71	for each civil suit filed in county court, county court at law,
72	72	probate court, or district court in the county.
73	73	SECTION 10. Subchapter C, Chapter 22, Government Code, is
74	74	amended by adding Section 22.2111 to read as follows:
75	75	Sec. 22.2111. APPELLATE JUDICIAL SYSTEM. (a) The
76	76	commissioners court of each county in the Tenth Court of Appeals
77	77	District by order entered in its minutes shall establish an
78	78	appellate judicial system to:
79	79	(1) assist the court of appeals for the county in the
80	80	processing of appeals filed with the court of appeals from the
81	81	county courts, statutory county courts, statutory probate courts,
82	82	and district courts; and
83	83	(2) defray costs and expenses incurred in the
84	84	operation of the court of appeals.
85	85	(b) To fund the system, the commissioners court shall use
86	86	the court costs fee collected as provided by Sections 133.151(a)(6)
87	87	and 133.1511(a)(4), Local Government Code, for each civil suit
88	88	filed in county court, statutory county court, statutory probate
89	89	court, or district court in the county.
90	90	(c) The court costs fee does not apply to a suit filed by any
91	91	governmental entity or to a suit for delinquent taxes.
92	92	(d) The court costs fee shall be taxed, collected, and paid
93	93	as other court costs in a suit. The clerk of the court shall collect
94	94	the court costs fee set under this section and pay it to the county
95	95	officer who performs the county treasurer's functions. That officer
96	96	shall deposit the fee in a separate appellate judicial system fund
97	97	for the court of appeals district. The fund may not be used for any
98	98	other purpose.
99	99	(e) The funds collected under this section must be forwarded
100	100	monthly to the court of appeals for expenditure by the court of
101	101	appeals.
102	102	(f) The chief justice of the court of appeals is responsible
103	103	for management of the funds forwarded to the court of appeals under
104	104	this section and has sole discretion as to the use of the funds,
105	105	except that the funds must be used for purposes consistent with the
106	106	purposes of the appellate judicial system as described by
107	107	Subsection (a).
108	108	SECTION 11. Section 22.2121(b), Government Code, is amended
109	109	to read as follows:
110	110	(b) To fund the system, the commissioners court shall use
111	111	the court costs fee collected as provided by Sections 133.151(a)(6)
112	112	and 133.1511(a)(4), Local Government Code, [set a court costs fee
113	113	of $5] for each civil suit filed in county court, statutory county
114	114	court, probate court, or district court in the county.
115	115	SECTION 12. Section 22.2131(b), Government Code, is amended
116	116	to read as follows:
117	117	(b) To fund the system, the commissioners court shall use
118	118	the court costs fee collected as provided by Sections 133.151(a)(6)
119	119	and 133.1511(a)(4), Local Government Code, [set a court costs fee
120	120	of $5] for each civil suit filed in county court, statutory county
121	121	court, probate court, or district court in the county.
122	122	SECTION 13. Section 22.2141(b), Government Code, is amended
123	123	to read as follows:
124	124	(b) To fund the system, the commissioners court shall use
125	125	the court costs fee collected as provided by Sections 133.151(a)(6)
126	126	and 133.1511(a)(4), Local Government Code, [set a court costs fee
127	127	of not more than $5] for each civil suit filed in a county court,
128	128	county court at law, probate court, or district court in the county.
129	129	SECTION 14. Section 26.007(a), Government Code, is amended
130	130	to read as follows:
131	131	(a) Beginning on the first day of the state fiscal year, the
132	132	state shall annually compensate each county that collects the
133	133	additional fees and costs under Section 51.703 of this code or
134	134	Section 133.1511(d), Local Government Code, in an amount equal to
135	135	$5,000 if the county judge is entitled to an annual salary
136	136	supplement from the state under Section 26.006.
137	137	SECTION 15. Sections 51.702(c) and (d), Government Code,
138	138	are amended to read as follows:
139	139	(c) Court costs and fees due under this section or Section
140	140	133.1511(c), Local Government Code, shall be collected in the same
141	141	manner as other fees, fines, or costs are collected in the case.
142	142	(d) The clerk shall deposit the fees and costs collected
143	143	under this section or Section 133.1511(c), Local Government Code,
144	144	to be sent to the comptroller as provided by Subchapter B, Chapter
145	145	133, Local Government Code. The comptroller shall deposit the fees
146	146	in the judicial fund.
147	147	SECTION 16. Sections 51.703(c), (d), and (f), Government
148	148	Code, are amended to read as follows:
149	149	(c) Court costs and fees due under this section or Section
150	150	133.1511(d), Local Government Code, shall be collected in the same
151	151	manner as other fees, fines, or costs are collected in the case.
152	152	(d) The clerk shall deposit the fees and costs collected
153	153	under this section or Section 133.1511(d), Local Government Code,
154	154	to be sent to the comptroller as provided by Subchapter B, Chapter
155	155	133, Local Government Code. The comptroller shall deposit the fees
156	156	in the judicial fund.
157	157	(f) A clerk may not collect a fee under Section 133.1511(d),
158	158	Local Government Code, [this section] and under Section
159	159	133.1511(c), Local Government Code [51.702(a)].
160	160	SECTION 17. Sections 51.704(b), (c), and (i), Government
161	161	Code, are amended to read as follows:
162	162	(b) Court fees due under Section 133.1511(e), Local
163	163	Government Code, [this section] shall be collected in the same
164	164	manner as other fees, fines, or costs are collected in the case.
165	165	(c) The clerk shall deposit the fees collected under Section
166	166	133.1511(e), Local Government Code, [this section] to be sent to
167	167	the comptroller as provided by Subchapter B, Chapter 133, Local
168	168	Government Code. The comptroller shall deposit the fees in the
169	169	judicial fund.
170	170	(i) A clerk may not collect a fee under Section 133.1511(e),
171	171	Local Government Code, [this section] and under Section [51.701 or]
172	172	51.702 of this code or Section 133.1511(c), Local Government Code.
173	173	SECTION 18. Sections 51.851(b), (c), (e), (f), (g), (i),
174	174	(j), and (k), Government Code, are amended to read as follows:
175	175	(b) In addition to other fees authorized or required by law,
176	176	the clerk of the supreme court or[,] a court of appeals[, a district
177	177	court, a county court, a statutory county court, or a statutory
178	178	probate court] shall collect a $30 fee on the filing of any civil
179	179	[action or proceeding requiring a filing fee, including an]
180	180	appeal[, and on the filing of any counterclaim, cross-action,
181	181	intervention, interpleader, or third-party action requiring a
182	182	filing fee] to be used as provided by Section 51.852. A fee
183	183	authorized by Section 133.151(a)(4) or 133.1511(a)(2), Local
184	184	Government Code, by a district court, a county court, a statutory
185	185	county court, or a statutory probate court on the filing of any
186	186	civil action or proceeding requiring a filing fee and on the filing
187	187	of any counterclaim, cross-action, intervention, interpleader, or
188	188	third-party action requiring a filing fee shall be used as provided
189	189	by Section 51.852.
190	190	(c) A fee authorized by Section 133.1512(2), Local
191	191	Government Code, [In addition to other fees authorized or required
192	192	by law, the clerk of a justice court shall collect a $10 fee] on the
193	193	filing of any civil action or proceeding requiring a filing fee,
194	194	including an appeal, and on the filing of any counterclaim,
195	195	cross-action, intervention, interpleader, or third-party action
196	196	requiring a filing fee shall [to] be used as provided by Section
197	197	51.852.
198	198	(e) A court may waive payment of a court cost or fee due
199	199	under this section or Section 133.151(a)(4), 133.1511(a)(2), or
200	200	133.1512(2), Local Government Code, for an individual the court
201	201	determines is indigent.
202	202	(f) Court costs and fees due under this section or Section
203	203	133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
204	204	Code, shall be collected in the same manner as other fees, fines, or
205	205	costs in the case.
206	206	(g) The clerk of a district court, a county court, a
207	207	statutory county court, a statutory probate court, or a justice
208	208	court shall deposit the court costs and fees collected under this
209	209	section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
210	210	Local Government Code, in the appropriate local treasury and remit
211	211	the court costs and fees to the comptroller in the manner provided
212	212	by Subchapter B, Chapter 133, Local Government Code.
213	213	(i) The comptroller shall deposit the court costs and fees
214	214	received under this section or Section 133.151(a)(4),
215	215	133.1511(a)(2), or 133.1512(2), Local Government Code, to the
216	216	credit of the statewide electronic filing system fund established
217	217	under Section 51.852.
218	218	(j) The comptroller may audit the records of a county
219	219	related to costs and fees collected under this section or Section
220	220	133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
221	221	Code.
222	222	(k) Money spent from costs and fees collected under this
223	223	section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
224	224	Local Government Code, is subject to audit by the state auditor.
225	225	SECTION 19. Section 51.971, Government Code, is amended to
226	226	read as follows:
227	227	Sec. 51.971. JUDICIAL AND COURT PERSONNEL TRAINING FEE.
228	228	(a) A filing fee required by Section 133.151(a)(5), 133.1151(a)(3),
229	229	or 133.1152(3), Local Government Code, is [In addition to other
230	230	fees authorized or required by law, the clerk of a district court,
231	231	county court, statutory county court, statutory probate court, or
232	232	justice court shall collect a $5 fee on the filing of any civil
233	233	action or proceeding requiring a filing fee, including an appeal,
234	234	and on the filing of any counterclaim, cross-action, intervention,
235	235	interpleader, or third party action requiring a filing fee] to be
236	236	used as provided under Section 56.003.
237	237	(b) A court may waive payment of a fee due under Section

249	249	Code, [this section] in the appropriate local treasury and remit
250	250	the court costs and fees to the comptroller in the manner provided
251	251	under Subchapter B, Chapter 133, Local Government Code.
252	252	(e) The comptroller shall deposit the fees received under
253	253	Section 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local
254	254	Government Code, [this section] to the credit of the judicial and
255	255	court personnel training fund established under Section 56.001.
256	256	(f) The comptroller may audit the records of a county
257	257	related to costs and fees collected under Section 133.151(a)(5),
258	258	133.1151(a)(3), or 133.1152(3), Local Government Code [this
259	259	section].
260	260	(g) Money spent from costs and fees collected under Section
261	261	133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government
262	262	Code, [this section] is subject to audit by the state auditor.

264	264	September 1, 2019, is amended to read as follows:

1287	1287	(3) a judicial fund fee imposed by Section 51.702,
1288	1288	Government Code, or Section 133.1511(c), Local Government Code;
1289	1289	(4) a judge's fee imposed by Section 25.0008 or
1290	1290	25.0029, Government Code;
1291	1291	(5) a cost or security fee imposed by Section 53.051,
1292	1292	53.052, 1053.051, or 1053.052, Estates Code; or
1293	1293	(6) a fee imposed by a county officer under Section
1294	1294	118.011 or 118.052, Local Government Code.
1295	1295	SECTION 34. Section 133.004, Local Government Code, as
1296	1296	amended by Chapters 718 (H.B. 2359), 1027 (H.B. 1623), and 1149
1297	1297	(S.B. 1119), Acts of the 80th Legislature, Regular Session, 2007,
1298	1298	is reenacted and amended to read as follows:
1299	1299	Sec. 133.004. CIVIL FEES. This chapter applies to the
1300	1300	following civil fees:
1301	1301	(1) the consolidated fee on filing in district court
1302	1302	imposed under Section 133.151;
1303	1303	(2) the filing fee in district court for basic civil
1304	1304	legal services for indigents imposed under Section 133.151(a)(2)
1305	1305	[133.152];
1306	1306	(3) the filing fee in courts other than district court
1307	1307	for basic civil legal services for indigents imposed under Section
1308	1308	133.1511(a)(1) or 133.1512(1) [133.153];
1309	1309	(4) the filing fees for the judicial fund imposed in
1310	1310	certain statutory county courts under Section 133.1511(c) of this
1311	1311	code or Section 51.702, Government Code;
1312	1312	(5) the filing fees for the judicial fund imposed in
1313	1313	certain county courts under Section 133.1511(d) of this code or
1314	1314	Section 51.703, Government Code;
1315	1315	(6) the filing fees for the judicial fund imposed in
1316	1316	[certain] statutory probate courts under Section 133.1511(e)
1317	1317	[51.704, Government Code];
1318	1318	(7) fees collected under Section 118.015;
1319	1319	(8) marriage license fees for the family trust fund
1320	1320	collected under Section 118.018;
1321	1321	(9) marriage license or declaration of informal
1322	1322	marriage fees for the child abuse and neglect prevention trust fund
1323	1323	account collected under Section 118.022;
1324	1324	(10) the filing fee for the judicial fund imposed in
1325	1325	district court, statutory county court, and county court under
1326	1326	Section 133.151(a)(3) or 133.1511(b) [Section 133.154]; [and]
1327	1327	(11) the portion of the civil or administrative
1328	1328	penalty described by Section 542.406(c)(1), Transportation Code,
1329	1329	imposed by a local authority to enforce compliance with the
1330	1330	instructions of a traffic-control signal; and
1331	1331	(12) [(11)] the portion of the civil or administrative
1332	1332	penalty described by Section 707.008(a)(1), Transportation Code,
1333	1333	imposed by a local authority to enforce compliance with the
1334	1334	instructions of a traffic-control signal.
1335	1335	SECTION 35. Section 133.058(d), Local Government Code, is
1336	1336	amended to read as follows:
1337	1337	(d) A county may not retain a service fee on the collection
1338	1338	of a fee:
1339	1339	(1) for the judicial fund;
1340	1340	(2) under Article 42A.303 or 42A.653, Code of Criminal
1341	1341	Procedure;
1342	1342	(3) under Section 133.1511(a)(2) or 133.1512(2) of
1343	1343	this code or Section 51.851, Government Code; or
1344	1344	(4) under Section 133.1511(a)(3) or 133.1512(3)
1345	1345	[51.971, Government Code].
1346	1346	SECTION 36. Section 133.151, Local Government Code, is
1347	1347	amended to read as follows:
1348	1348	Sec. 133.151. CONSOLIDATED CIVIL FEE ON FILING A CIVIL SUIT
1349	1349	IN DISTRICT COURT. (a) In addition to each fee collected under
1350	1350	Section 51.317(b)(1), Government Code, the clerk of a district
1351	1351	court shall collect the following fees on the filing of any civil
1352	1352	action or proceeding requiring a filing fee and on the filing of any
1353	1353	counterclaim, cross-action, intervention, interpleader, or
1354	1354	third-party action requiring a filing fee [suit]:
1355	1355	(1) [$45 for family law cases and proceedings as
1356	1356	defined by Section 25.0002, Government Code; and
1357	1357	[(2)] $50 to be used as provided by Subsection (c) [for
1358	1358	any case other than a case described by Subdivision (1)];
1359	1359	(2) $10 to be used as provided by Section 133.152;
1360	1360	(3) $42 to be used as provided by Section 133.154;
1361	1361	(4) $30 to be used as provided by Section 51.851,
1362	1362	Government Code;
1363	1363	(5) $5 to be used as provided by Section 51.971,
1364	1364	Government Code; and
1365	1365	(6) $5 court costs fee to be deposited in the appellate
1366	1366	justice system fund appropriate for the appellate district in which
1367	1367	the court is located to be used as provided by Subchapter C, Chapter
1368	1368	22, Government Code.
1369	1369	(b) The fees under Subsection (a)(1) [(a)] shall be
1370	1370	collected and remitted to the comptroller in the manner provided by
1371	1371	Subchapter B.
1372	1372	(c) The comptroller shall allocate the fees received under
1373	1373	Subsection (a)(1) [this section] to the following accounts and
1374	1374	funds so that each receives to the extent practicable, utilizing
1375	1375	historical data as applicable, the same amount of money the account
1376	1376	or fund would have received if the fees for the accounts and funds
1377	1377	had been collected and reported separately:
1378	1378	(1) the judicial fund to be used for court-related
1379	1379	purposes for the support of the judiciary; and
1380	1380	(2) the basic civil legal services account of the
1381	1381	judicial fund for use in programs approved by the supreme court that
1382	1382	provide basic civil legal services to an indigent.
1383	1383	SECTION 37. Subchapter D, Chapter 133, Local Government
1384	1384	Code, is amended by adding Sections 133.1511 and 133.1512 to read as
1385	1385	follows:
1386	1386	Sec. 133.1511. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
1387	1387	IN STATUTORY COUNTY COURT, STATUTORY PROBATE COURT, OR COUNTY
1388	1388	COURT. (a) The clerk of a statutory county court, statutory
1389	1389	probate court, or a county court shall collect the following fees on
1390	1390	the filing of any civil action or proceeding and on the filing of
1391	1391	any counterclaim, cross-action, intervention, interpleader, or
1392	1392	third-party action requiring a filing fee:
1393	1393	(1) $10 to be used as provided by Section 133.153;
1394	1394	(2) $30 to be used as provided by Section 51.851,
1395	1395	Government Code;
1396	1396	(3) $5 to be used as provided by Section 51.971,
1397	1397	Government Code; and
1398	1398	(4) $5 court costs fee to be deposited in the appellate
1399	1399	justice system fund appropriate for the appellate district in which
1400	1400	the court is located to be used as provided by Subchapter C, Chapter
1401	1401	22.
1402	1402	(b) The clerk of a statutory county court or a county court
1403	1403	shall collect a fee of $42 on the filing of any suit to be used as
1404	1404	provided by Section 133.154.
1405	1405	(c) The clerk of a statutory county court shall collect a
1406	1406	$40 filing fee in each civil case filed in the court to be used for
1407	1407	court-related purposes for the support of the judiciary as provided
1408	1408	by Section 51.702, Government Code.
1409	1409	(d) In addition to all other fees authorized or required by
1410	1410	other law, the clerk of a county court with a judge who is entitled
1411	1411	to an annual salary supplement from the state under Section 26.006,
1412	1412	Government Code, shall collect a $40 filing fee in each civil case
1413	1413	filed in the court to be used for court-related purposes for the
1414	1414	support of the judiciary as provided by Section 51.703, Government
1415	1415	Code.
1416	1416	(e) In addition to all other fees authorized or required by
1417	1417	other law, the clerk of a statutory probate court shall collect a
1418	1418	$40 filing fee in each probate, guardianship, mental health, or
1419	1419	civil case filed in the court to be used for court-related purposes
1420	1420	for the support of the judiciary.
1421	1421	Sec. 133.1512. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
1422	1422	IN JUSTICE COURT. The clerk of a justice court shall collect the
1423	1423	following fees on the filing of any civil action or proceeding
1424	1424	requiring a filing fee and on the filing of any counterclaim,
1425	1425	cross-action, intervention, interpleader, or third-party action
1426	1426	requiring a filing fee:
1427	1427	(1) $6 to be used as provided by Section 133.153;
1428	1428	(2) $10 to be used as provided by Section 51.851(c),
1429	1429	Government Code; and
1430	1430	(3) $5 to be used as provided by Section 51.971,
1431	1431	Government Code.
1432	1432	SECTION 38. Sections 133.152(b) and (c), Local Government
1433	1433	Code, are amended to read as follows:
1434	1434	(b) The fees under Section 133.151(a)(2) [this section]
1435	1435	shall be collected and remitted to the comptroller in the manner
1436	1436	provided by Subchapter B.
1437	1437	(c) The comptroller shall deposit the fees received under
1438	1438	Section 133.151(a)(2) to the credit of the basic civil legal
1439	1439	services account of the judicial fund for use in programs approved
1440	1440	by the supreme court that provide basic civil legal services to an
1441	1441	indigent.
1442	1442	SECTION 39. Sections 133.153(b) and (c), Local Government
1443	1443	Code, are amended to read as follows:
1444	1444	(b) The fees under Section 133.151(a)(3) shall be collected
1445	1445	and remitted to the comptroller in the manner provided by
1446	1446	Subchapter B.
1447	1447	(c) The comptroller shall deposit the fees received under
1448	1448	Section 133.151(a)(3) to the credit of the basic civil legal
1449	1449	services account of the judicial fund for use in programs approved
1450	1450	by the supreme court that provide basic civil legal services to an
1451	1451	indigent.
1452	1452	SECTION 40. Section 133.154(b), Local Government Code, is
1453	1453	amended to read as follows:
1454	1454	(b) The treasurer shall remit the fees collected under
1455	1455	Section 133.151(a)(3) or 133.1511(b) [this section] to the
1456	1456	comptroller in the manner provided by Subchapter B. The comptroller
1457	1457	shall deposit the fees in the judicial fund.
1458	1458	SECTION 41. The following sections are repealed:
1459	1459	(1) Section 108.006, Family Code;
1460	1460	(2) Section 51.702(a), Government Code;
1461	1461	(3) Section 51.703(a), Government Code;
1462	1462	(4) Section 51.704(a), Government Code;
1463	1463	(5) Section 51.851(b), Government Code;
1464	1464	(6) Sections 101.06111, 101.08111, 101.0813,
1465	1465	101.10111, 101.12121, and 101.1411, Government Code;
1466	1466	(7) Sections 102.042, 102.062, and 102.103,
1467	1467	Government Code;
1468	1468	(8) Section 152.0522, Human Resources Code;
1469	1469	(9) Section 152.1752(d), Human Resources Code;
1470	1470	(10) Sections 152.1874 and 152.2496, Human Resources
1471	1471	Code;

1475	1475	SECTION 42. This Act takes effect September 1, 2019.
