77 relating to the consolidation and allocation of state civil court
88 costs; increasing certain civil court costs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.2021(b), Government Code, is amended
1111 to read as follows:
1212 (b) To fund the system, the commissioners court shall use
1313 the court costs fee collected as provided by Sections 133.151(a)(6)
1414 and 133.1511(a)(4), Local Government Code, [set a court costs fee
1515 of not more than $5] for each civil suit filed in county court,
1616 county court at law, probate court, or district court in the county.
1717 SECTION 2. Section 22.2031(b), Government Code, is amended
1818 to read as follows:
1919 (b) To fund the system, the commissioners court shall use
2020 the court costs fee collected as provided by Sections 133.151(a)(6)
2121 and 133.1511(a)(4), Local Government Code, [set a court costs fee
2222 of $5] for each civil suit filed in county court, statutory county
2323 court, statutory probate court, or district court in the county.
2424 SECTION 3. Section 22.2041(b), Government Code, is amended
2525 to read as follows:
2626 (b) To fund the system, the commissioners court shall use
2727 the court costs fee collected as provided by Sections 133.151(a)(6)
2828 and 133.1511(a)(4), Local Government Code, [set a court costs fee
2929 of $5] for each civil suit filed in county court, county court at

3838 SECTION 5. Section 22.2061(b), Government Code, is amended

5959 SECTION 8. Section 22.2091(b), Government Code, is amended

6161 (b) To fund the system, the commissioners court shall use
6262 the court costs fee collected as provided by Sections 133.151(a)(6)
6363 and 133.1511(a)(4), Local Government Code, [set a court costs fee
6464 of $5] for each civil suit filed in a county court, statutory county
6565 court, statutory probate court, or district court in the county.
6666 SECTION 9. Section 22.2101(b), Government Code, is amended
6767 to read as follows:
6868 (b) To fund the system, the commissioners court shall use
6969 the court costs fee collected as provided by Sections 133.151(a)(6)
7070 and 133.1511(a)(4), Local Government Code, [set a court fee of $5]
7171 for each civil suit filed in county court, county court at law,
7272 probate court, or district court in the county.
7373 SECTION 10. Subchapter C, Chapter 22, Government Code, is
7474 amended by adding Section 22.2111 to read as follows:
7575 Sec. 22.2111. APPELLATE JUDICIAL SYSTEM. (a) The
7676 commissioners court of each county in the Tenth Court of Appeals
7777 District by order entered in its minutes shall establish an
7878 appellate judicial system to:
7979 (1) assist the court of appeals for the county in the
8080 processing of appeals filed with the court of appeals from the
8181 county courts, statutory county courts, statutory probate courts,
8282 and district courts; and
8383 (2) defray costs and expenses incurred in the
8484 operation of the court of appeals.
8585 (b) To fund the system, the commissioners court shall use
8686 the court costs fee collected as provided by Sections 133.151(a)(6)
8787 and 133.1511(a)(4), Local Government Code, for each civil suit
8888 filed in county court, statutory county court, statutory probate
8989 court, or district court in the county.
9090 (c) The court costs fee does not apply to a suit filed by any
9191 governmental entity or to a suit for delinquent taxes.
9292 (d) The court costs fee shall be taxed, collected, and paid
9393 as other court costs in a suit. The clerk of the court shall collect
9494 the court costs fee set under this section and pay it to the county
9595 officer who performs the county treasurer's functions. That officer
9696 shall deposit the fee in a separate appellate judicial system fund
9797 for the court of appeals district. The fund may not be used for any
9898 other purpose.
9999 (e) The funds collected under this section must be forwarded
100100 monthly to the court of appeals for expenditure by the court of
101101 appeals.
102102 (f) The chief justice of the court of appeals is responsible
103103 for management of the funds forwarded to the court of appeals under
104104 this section and has sole discretion as to the use of the funds,
105105 except that the funds must be used for purposes consistent with the
106106 purposes of the appellate judicial system as described by
107107 Subsection (a).
108108 SECTION 11. Section 22.2121(b), Government Code, is amended
109109 to read as follows:
110110 (b) To fund the system, the commissioners court shall use
111111 the court costs fee collected as provided by Sections 133.151(a)(6)
112112 and 133.1511(a)(4), Local Government Code, [set a court costs fee
113113 of $5] for each civil suit filed in county court, statutory county
114114 court, probate court, or district court in the county.
115115 SECTION 12. Section 22.2131(b), Government Code, is amended
116116 to read as follows:
117117 (b) To fund the system, the commissioners court shall use
118118 the court costs fee collected as provided by Sections 133.151(a)(6)
119119 and 133.1511(a)(4), Local Government Code, [set a court costs fee
120120 of $5] for each civil suit filed in county court, statutory county
121121 court, probate court, or district court in the county.
122122 SECTION 13. Section 22.2141(b), Government Code, is amended
123123 to read as follows:
124124 (b) To fund the system, the commissioners court shall use
125125 the court costs fee collected as provided by Sections 133.151(a)(6)
126126 and 133.1511(a)(4), Local Government Code, [set a court costs fee
127127 of not more than $5] for each civil suit filed in a county court,
128128 county court at law, probate court, or district court in the county.
129129 SECTION 14. Section 26.007(a), Government Code, is amended
130130 to read as follows:
131131 (a) Beginning on the first day of the state fiscal year, the
132132 state shall annually compensate each county that collects the
133133 additional fees and costs under Section 51.703 of this code or
134134 Section 133.1511(d), Local Government Code, in an amount equal to
135135 $5,000 if the county judge is entitled to an annual salary
136136 supplement from the state under Section 26.006.
137137 SECTION 15. Sections 51.702(c) and (d), Government Code,
138138 are amended to read as follows:
139139 (c) Court costs and fees due under this section or Section
140140 133.1511(c), Local Government Code, shall be collected in the same
141141 manner as other fees, fines, or costs are collected in the case.
142142 (d) The clerk shall deposit the fees and costs collected
143143 under this section or Section 133.1511(c), Local Government Code,
144144 to be sent to the comptroller as provided by Subchapter B, Chapter
145145 133, Local Government Code. The comptroller shall deposit the fees
146146 in the judicial fund.
147147 SECTION 16. Sections 51.703(c), (d), and (f), Government
148148 Code, are amended to read as follows:
149149 (c) Court costs and fees due under this section or Section
150150 133.1511(d), Local Government Code, shall be collected in the same
151151 manner as other fees, fines, or costs are collected in the case.
152152 (d) The clerk shall deposit the fees and costs collected
153153 under this section or Section 133.1511(d), Local Government Code,
154154 to be sent to the comptroller as provided by Subchapter B, Chapter
155155 133, Local Government Code. The comptroller shall deposit the fees
156156 in the judicial fund.
157157 (f) A clerk may not collect a fee under Section 133.1511(d),
158158 Local Government Code, [this section] and under Section
159159 133.1511(c), Local Government Code [51.702(a)].
160160 SECTION 17. Sections 51.704(b), (c), and (i), Government
161161 Code, are amended to read as follows:
162162 (b) Court fees due under Section 133.1511(e), Local
163163 Government Code, [this section] shall be collected in the same
164164 manner as other fees, fines, or costs are collected in the case.
165165 (c) The clerk shall deposit the fees collected under Section
166166 133.1511(e), Local Government Code, [this section] to be sent to
167167 the comptroller as provided by Subchapter B, Chapter 133, Local
168168 Government Code. The comptroller shall deposit the fees in the
169169 judicial fund.
170170 (i) A clerk may not collect a fee under Section 133.1511(e),
171171 Local Government Code, [this section] and under Section [51.701 or]
172172 51.702 of this code or Section 133.1511(c), Local Government Code.
173173 SECTION 18. Sections 51.851(b), (c), (e), (f), (g), (i),
174174 (j), and (k), Government Code, are amended to read as follows:
175175 (b) In addition to other fees authorized or required by law,
176176 the clerk of the supreme court or[,] a court of appeals[, a district
177177 court, a county court, a statutory county court, or a statutory
178178 probate court] shall collect a $30 fee on the filing of any civil
179179 [action or proceeding requiring a filing fee, including an]
180180 appeal[, and on the filing of any counterclaim, cross-action,
181181 intervention, interpleader, or third-party action requiring a
182182 filing fee] to be used as provided by Section 51.852. A fee
183183 authorized by Section 133.151(a)(4) or 133.1511(a)(2), Local
184184 Government Code, by a district court, a county court, a statutory
185185 county court, or a statutory probate court on the filing of any
186186 civil action or proceeding requiring a filing fee and on the filing
187187 of any counterclaim, cross-action, intervention, interpleader, or
188188 third-party action requiring a filing fee shall be used as provided
189189 by Section 51.852.
190190 (c) A fee authorized by Section 133.1512(2), Local
191191 Government Code, [In addition to other fees authorized or required
192192 by law, the clerk of a justice court shall collect a $10 fee] on the
193193 filing of any civil action or proceeding requiring a filing fee,
194194 including an appeal, and on the filing of any counterclaim,
195195 cross-action, intervention, interpleader, or third-party action
196196 requiring a filing fee shall [to] be used as provided by Section
197197 51.852.
198198 (e) A court may waive payment of a court cost or fee due
199199 under this section or Section 133.151(a)(4), 133.1511(a)(2), or
200200 133.1512(2), Local Government Code, for an individual the court
201201 determines is indigent.
202202 (f) Court costs and fees due under this section or Section
203203 133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
204204 Code, shall be collected in the same manner as other fees, fines, or
205205 costs in the case.
206206 (g) The clerk of a district court, a county court, a
207207 statutory county court, a statutory probate court, or a justice
208208 court shall deposit the court costs and fees collected under this
209209 section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
210210 Local Government Code, in the appropriate local treasury and remit
211211 the court costs and fees to the comptroller in the manner provided
212212 by Subchapter B, Chapter 133, Local Government Code.
213213 (i) The comptroller shall deposit the court costs and fees
214214 received under this section or Section 133.151(a)(4),
215215 133.1511(a)(2), or 133.1512(2), Local Government Code, to the
216216 credit of the statewide electronic filing system fund established
217217 under Section 51.852.
218218 (j) The comptroller may audit the records of a county
219219 related to costs and fees collected under this section or Section
220220 133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
221221 Code.
222222 (k) Money spent from costs and fees collected under this
223223 section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
224224 Local Government Code, is subject to audit by the state auditor.
225225 SECTION 19. Section 51.971, Government Code, is amended to
226226 read as follows:
227227 Sec. 51.971. JUDICIAL AND COURT PERSONNEL TRAINING FEE.
228228 (a) A filing fee required by Section 133.151(a)(5), 133.1151(a)(3),
229229 or 133.1152(3), Local Government Code, is [In addition to other
230230 fees authorized or required by law, the clerk of a district court,
231231 county court, statutory county court, statutory probate court, or
232232 justice court shall collect a $5 fee on the filing of any civil
233233 action or proceeding requiring a filing fee, including an appeal,
234234 and on the filing of any counterclaim, cross-action, intervention,
235235 interpleader, or third party action requiring a filing fee] to be
236236 used as provided under Section 56.003.
237237 (b) A court may waive payment of a fee due under Section
238238 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government

249249 Code, [this section] in the appropriate local treasury and remit
250250 the court costs and fees to the comptroller in the manner provided
251251 under Subchapter B, Chapter 133, Local Government Code.
252252 (e) The comptroller shall deposit the fees received under
253253 Section 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local
254254 Government Code, [this section] to the credit of the judicial and
255255 court personnel training fund established under Section 56.001.
256256 (f) The comptroller may audit the records of a county
257257 related to costs and fees collected under Section 133.151(a)(5),
258258 133.1151(a)(3), or 133.1152(3), Local Government Code [this
259259 section].
260260 (g) Money spent from costs and fees collected under Section
261261 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government
262262 Code, [this section] is subject to audit by the state auditor.
263263 SECTION 20. Section 101.0611, Government Code, as effective
264264 September 1, 2019, is amended to read as follows:

13501350 Section 51.317(b)(1), Government Code, the clerk of a district
13511351 court shall collect the following fees on the filing of any civil
13521352 action or proceeding requiring a filing fee and on the filing of any
13531353 counterclaim, cross-action, intervention, interpleader, or
13541354 third-party action requiring a filing fee [suit]:
13551355 (1) [$45 for family law cases and proceedings as
13561356 defined by Section 25.0002, Government Code; and
13571357 [(2)] $50 to be used as provided by Subsection (c) [for
13581358 any case other than a case described by Subdivision (1)];
13591359 (2) $10 to be used as provided by Section 133.152;
13601360 (3) $42 to be used as provided by Section 133.154;
13611361 (4) $30 to be used as provided by Section 51.851,
13621362 Government Code;
13631363 (5) $5 to be used as provided by Section 51.971,
13641364 Government Code; and
13651365 (6) $5 court costs fee to be deposited in the appellate
13661366 justice system fund appropriate for the appellate district in which
13671367 the court is located to be used as provided by Subchapter C, Chapter
13681368 22, Government Code.
13691369 (b) The fees under Subsection (a)(1) [(a)] shall be
13701370 collected and remitted to the comptroller in the manner provided by
13711371 Subchapter B.
13721372 (c) The comptroller shall allocate the fees received under
13731373 Subsection (a)(1) [this section] to the following accounts and
13741374 funds so that each receives to the extent practicable, utilizing
13751375 historical data as applicable, the same amount of money the account
13761376 or fund would have received if the fees for the accounts and funds
13771377 had been collected and reported separately:
13781378 (1) the judicial fund to be used for court-related
13791379 purposes for the support of the judiciary; and
13801380 (2) the basic civil legal services account of the
13811381 judicial fund for use in programs approved by the supreme court that
13821382 provide basic civil legal services to an indigent.
13831383 SECTION 37. Subchapter D, Chapter 133, Local Government
13841384 Code, is amended by adding Sections 133.1511 and 133.1512 to read as
13851385 follows:
13861386 Sec. 133.1511. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
13871387 IN STATUTORY COUNTY COURT, STATUTORY PROBATE COURT, OR COUNTY
13881388 COURT. (a) The clerk of a statutory county court, statutory
13891389 probate court, or a county court shall collect the following fees on
13901390 the filing of any civil action or proceeding and on the filing of
13911391 any counterclaim, cross-action, intervention, interpleader, or
13921392 third-party action requiring a filing fee:
13931393 (1) $10 to be used as provided by Section 133.153;
13941394 (2) $30 to be used as provided by Section 51.851,
13951395 Government Code;
13961396 (3) $5 to be used as provided by Section 51.971,
13971397 Government Code; and
13981398 (4) $5 court costs fee to be deposited in the appellate
13991399 justice system fund appropriate for the appellate district in which
14001400 the court is located to be used as provided by Subchapter C, Chapter
14011401 22.
14021402 (b) The clerk of a statutory county court or a county court
14031403 shall collect a fee of $42 on the filing of any suit to be used as
14041404 provided by Section 133.154.
14051405 (c) The clerk of a statutory county court shall collect a
14061406 $40 filing fee in each civil case filed in the court to be used for
14071407 court-related purposes for the support of the judiciary as provided
14081408 by Section 51.702, Government Code.
14091409 (d) In addition to all other fees authorized or required by
14101410 other law, the clerk of a county court with a judge who is entitled
14111411 to an annual salary supplement from the state under Section 26.006,
14121412 Government Code, shall collect a $40 filing fee in each civil case
14131413 filed in the court to be used for court-related purposes for the
14141414 support of the judiciary as provided by Section 51.703, Government
14151415 Code.
14161416 (e) In addition to all other fees authorized or required by
14171417 other law, the clerk of a statutory probate court shall collect a
14181418 $40 filing fee in each probate, guardianship, mental health, or
14191419 civil case filed in the court to be used for court-related purposes
14201420 for the support of the judiciary.
14211421 Sec. 133.1512. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
14221422 IN JUSTICE COURT. The clerk of a justice court shall collect the
14231423 following fees on the filing of any civil action or proceeding
14241424 requiring a filing fee and on the filing of any counterclaim,
14251425 cross-action, intervention, interpleader, or third-party action
14261426 requiring a filing fee:
14271427 (1) $6 to be used as provided by Section 133.153;
14281428 (2) $10 to be used as provided by Section 51.851(c),
14291429 Government Code; and
14301430 (3) $5 to be used as provided by Section 51.971,
14311431 Government Code.
14321432 SECTION 38. Sections 133.152(b) and (c), Local Government
14331433 Code, are amended to read as follows:
14341434 (b) The fees under Section 133.151(a)(2) [this section]
14351435 shall be collected and remitted to the comptroller in the manner
14361436 provided by Subchapter B.
14371437 (c) The comptroller shall deposit the fees received under
14381438 Section 133.151(a)(2) to the credit of the basic civil legal
14391439 services account of the judicial fund for use in programs approved
14401440 by the supreme court that provide basic civil legal services to an
14411441 indigent.
14421442 SECTION 39. Sections 133.153(b) and (c), Local Government
14431443 Code, are amended to read as follows:
14441444 (b) The fees under Section 133.151(a)(3) shall be collected
14451445 and remitted to the comptroller in the manner provided by
14461446 Subchapter B.
14471447 (c) The comptroller shall deposit the fees received under
14481448 Section 133.151(a)(3) to the credit of the basic civil legal
14491449 services account of the judicial fund for use in programs approved
14501450 by the supreme court that provide basic civil legal services to an
14511451 indigent.
14521452 SECTION 40. Section 133.154(b), Local Government Code, is
14531453 amended to read as follows:
14541454 (b) The treasurer shall remit the fees collected under
14551455 Section 133.151(a)(3) or 133.1511(b) [this section] to the
14561456 comptroller in the manner provided by Subchapter B. The comptroller
14571457 shall deposit the fees in the judicial fund.
14581458 SECTION 41. The following sections are repealed:
14591459 (1) Section 108.006, Family Code;
14601460 (2) Section 51.702(a), Government Code;
14611461 (3) Section 51.703(a), Government Code;
14621462 (4) Section 51.704(a), Government Code;
14631463 (5) Section 51.851(b), Government Code;
14641464 (6) Sections 101.06111, 101.08111, 101.0813,
14651465 101.10111, 101.12121, and 101.1411, Government Code;
14661466 (7) Sections 102.042, 102.062, and 102.103,
14671467 Government Code;
14681468 (8) Section 152.0522, Human Resources Code;
14691469 (9) Section 152.1752(d), Human Resources Code;
14701470 (10) Sections 152.1874 and 152.2496, Human Resources
14711471 Code;
14721472 (11) Section 133.152(a), Local Government Code;

14751475 SECTION 42. This Act takes effect September 1, 2019.
