46 AN ACT
57 relating to legislative oversight of deferred maintenance
68 projects.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. The heading to Subchapter I, Chapter 2165,
911 Government Code, is amended to read as follows:
1012 SUBCHAPTER I. DEFERRED MAINTENANCE FUNDING [FUND]
1113 SECTION 2. Subchapter I, Chapter 2165, Government Code, is
1214 amended by adding Section 2165.404 to read as follows:
1315 Sec. 2165.404. JOINT OVERSIGHT COMMITTEE ON GOVERNMENT
1416 FACILITIES. (a) In this section, "committee" means the Joint
1517 Oversight Committee on Government Facilities.
1618 (b) The committee is created to review deferred maintenance
1719 plans and receive implementation updates.
1820 (c) The committee is composed of six members as follows:
1921 (1) three members of the senate appointed by the
2022 lieutenant governor; and
2123 (2) three members of the house of representatives
2224 appointed by the speaker of the house of representatives.
2325 (d) The chair of the committee shall alternate annually
2426 between:
2527 (1) a member of the senate appointed by the lieutenant
2628 governor; and
2729 (2) a member of the house of representatives appointed
2830 by the speaker of the house of representatives.
2931 (e) The lieutenant governor shall appoint the first chair of
3032 the committee.
3133 (f) A vacancy on the committee shall be filled in the same
3234 manner as the original appointment.
3335 (g) The committee biannually shall provide a written report
3436 to the legislature that identifies:
3537 (1) the amount of money expended for deferred
3638 maintenance;
3739 (2) planned deferred maintenance projects; and
3840 (3) the status of ongoing and completed deferred
3941 maintenance projects.
4042 (h) The committee shall:
4143 (1) have the powers and duties of a joint committee
4244 created by proclamation; and
4345 (2) obtain funding in the same manner as a joint
4446 committee created by proclamation.
4547 (i) The rules adopted by the 86th Legislature for the
4648 administration of joint committees created by proclamation apply to
4749 the committee to the extent the rules are consistent with this
4850 section.
4951 (j) The committee is abolished and this section expires on
5052 September 1, 2025.
5153 SECTION 3. (a) If this Act receives the votes necessary
5254 for immediate effect, the lieutenant governor and the speaker of
5355 the house of representatives shall make appointments to the Joint
5456 Oversight Committee on Government Facilities not later than July 1,
5557 2019.
5658 (b) If this Act does not receive the votes necessary for
5759 immediate effect, the lieutenant governor and the speaker of the
5860 house of representatives shall make appointments to the Joint
5961 Oversight Committee on Government Facilities not later than
6062 September 15, 2019.
6163 SECTION 4. This Act takes effect immediately if it receives
6264 a vote of two-thirds of all the members elected to each house, as
6365 provided by Section 39, Article III, Texas Constitution. If this
6466 Act does not receive the vote necessary for immediate effect, this
6567 Act takes effect September 1, 2019.
