| 7 | 7 | | relating to the disclosure under the public information law of |
|---|
| 8 | 8 | | certain information related to parades, concerts, or other |
|---|
| 9 | 9 | | entertainment events open to the general public that are paid for |
|---|
| 10 | 10 | | with public funds. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 552.104, Government Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (c), the [The] |
|---|
| 16 | 16 | | requirement of Section 552.022 that a category of information |
|---|
| 17 | 17 | | listed under Section 552.022(a) is public information and not |
|---|
| 18 | 18 | | excepted from required disclosure under this chapter unless |
|---|
| 19 | 19 | | expressly confidential under law does not apply to information that |
|---|
| 20 | 20 | | is excepted from required disclosure under this section. |
|---|
| 21 | 21 | | (c) Subsection (b) does not apply to information described |
|---|
| 22 | 22 | | by Section 552.022(a) relating to the receipt or expenditure of |
|---|
| 23 | 23 | | public or other funds by a governmental body for a parade, concert, |
|---|
| 24 | 24 | | or other entertainment event open to the general public and paid for |
|---|
| 25 | 25 | | in whole or part with public funds. A person, including a |
|---|
| 26 | 26 | | governmental body, may not include a provision in a contract |
|---|
| 27 | 27 | | related to an event described by this subsection that prohibits or |
|---|
| 28 | 28 | | would otherwise prevent the disclosure of information described by |
|---|
| 29 | 29 | | this subsection. A contract provision that violates this |
|---|
| 30 | 30 | | subsection is void. |
|---|
| 31 | 31 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 32 | 32 | | to: |
|---|
| 33 | 33 | | (1) a request for information that is received by a |
|---|
| 34 | 34 | | governmental body or an officer for public information on or after |
|---|
| 35 | 35 | | the effective date of this Act; and |
|---|
| 36 | 36 | | (2) a contract entered into or renewed on or after the |
|---|
| 37 | 37 | | effective date of this Act. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2019. |
