66 AN ACT
77 relating to the disclosure under the public information law of
88 certain information related to parades, concerts, or other
99 entertainment events open to the general public that are paid for
1010 with public funds.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.104, Government Code, is amended by
1313 amending Subsection (b) and adding Subsection (c) to read as
1414 follows:
1515 (b) Except as provided by Subsection (c), the [The]
1616 requirement of Section 552.022 that a category of information
1717 listed under Section 552.022(a) is public information and not
1818 excepted from required disclosure under this chapter unless
1919 expressly confidential under law does not apply to information that
2020 is excepted from required disclosure under this section.
2121 (c) Subsection (b) does not apply to information described
2222 by Section 552.022(a) relating to the receipt or expenditure of
2323 public or other funds by a governmental body for a parade, concert,
2424 or other entertainment event open to the general public and paid for
2525 in whole or part with public funds. A person, including a
2626 governmental body, may not include a provision in a contract
2727 related to an event described by this subsection that prohibits or
2828 would otherwise prevent the disclosure of information described by
2929 this subsection. A contract provision that violates this
3030 subsection is void.
3131 SECTION 2. The change in law made by this Act applies only
3232 to:
3333 (1) a request for information that is received by a
3434 governmental body or an officer for public information on or after
3535 the effective date of this Act; and
3636 (2) a contract entered into or renewed on or after the
3737 effective date of this Act.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2019.
