| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. The heading to Section 37.08, Penal Code, is |
|---|
| 10 | 12 | | amended to read as follows: |
|---|
| 11 | 13 | | Sec. 37.08. FALSE REPORT TO PEACE OFFICER, FEDERAL SPECIAL |
|---|
| 12 | 14 | | INVESTIGATOR, [OR] LAW ENFORCEMENT EMPLOYEE, CORRECTIONS OFFICER, |

| 13 | 15 | | OR JAILER. |

| 14 | 16 | | SECTION 2. Section 37.08(a), Penal Code, is amended to read |
|---|
| 15 | 17 | | as follows: |
|---|
| 16 | 18 | | (a) A person commits an offense if, with intent to deceive, |
|---|
| 17 | 19 | | he knowingly makes a false statement that is material to a criminal |
|---|
| 18 | 20 | | investigation and makes the statement to: |
|---|
| 19 | 21 | | (1) a peace officer or federal special investigator |
|---|
| 20 | 22 | | conducting the investigation; [or] |
|---|
| 21 | 23 | | (2) any employee of a law enforcement agency that is |
|---|
| 22 | 24 | | authorized by the agency to conduct the investigation and that the |
|---|
| 23 | 25 | | actor knows is conducting the investigation; or |
|---|
| 24 | 26 | | (3) a corrections officer or jailer. |
|---|
| 25 | 27 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 26 | 28 | | to an offense committed on or after the effective date of this Act. |
|---|
| 27 | 29 | | An offense committed before the effective date of this Act is |
|---|
| 28 | 30 | | governed by the law in effect on the date the offense was committed, |
|---|
| 29 | 31 | | and the former law is continued in effect for that purpose. For |
|---|
| 30 | 32 | | purposes of this section, an offense was committed before the |
|---|
| 31 | 33 | | effective date of this Act if any element of the offense occurred |
|---|
| 32 | 34 | | before that date. |
|---|
| 33 | 35 | | SECTION 4. This Act takes effect September 1, 2019. |
