46 AN ACT
57 relating to exemptions to reporting and list requirements for
68 certain attorneys ad litem, guardians ad litem, amicus attorneys,
79 mediators, and guardians.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 36.003, Government Code, is amended to
1012 read as follows:
1113 Sec. 36.003. EXEMPTION. The reporting requirements of
1214 Section 36.004 do not apply to:
1315 (1) a mediation conducted by an alternative dispute
1416 resolution system established under Chapter 152, Civil Practice and
1517 Remedies Code;
1618 (2) information made confidential under state or
1719 federal law, including applicable rules;
1820 (3) a guardian ad litem or other person appointed
1921 under a program authorized by Section 107.031, Family Code; [or]
2022 (4) an attorney ad litem, guardian ad litem, amicus
2123 attorney, or mediator appointed under a domestic relations office
2224 established under Chapter 203, Family Code;
2325 (5) an attorney ad litem, guardian ad litem, amicus
2426 attorney, or mediator providing services without expectation or
2527 receipt of compensation; or
2628 (6) an attorney ad litem, guardian ad litem, amicus
2729 attorney, or mediator providing services as a volunteer of a
2830 nonprofit organization that provides pro bono legal services to the
2931 indigent.
3032 SECTION 2. Section 37.002, Government Code, is amended to
3133 read as follows:
3234 Sec. 37.002. EXEMPTION. The appointment requirements of
3335 Section 37.004 do not apply to:
3436 (1) a mediation conducted by an alternative dispute
3537 resolution system established under Chapter 152, Civil Practice and
3638 Remedies Code;
3739 (2) a guardian ad litem or other person appointed
3840 under a program authorized by Section 107.031, Family Code;
3941 (3) an attorney ad litem, guardian ad litem, amicus
4042 attorney, or mediator appointed under a domestic relations office
4143 established under Chapter 203, Family Code; [or]
4244 (4) a person other than an attorney or a private
4345 professional guardian appointed to serve as a guardian as defined
4446 by Section 1002.012, Estates Code;
4547 (5) an attorney ad litem, guardian ad litem, amicus
4648 attorney, or mediator providing services without expectation or
4749 receipt of compensation; or
4850 (6) an attorney ad litem, guardian ad litem, amicus
4951 attorney, or mediator providing services as a volunteer of a
5052 nonprofit organization that provides pro bono legal services to the
5153 indigent.
5254 SECTION 3. Section 37.004, Government Code, is amended by
5355 amending Subsection (a) and adding Subsections (d-1) and (g) to
5456 read as follows:
5557 (a) Except as provided by Subsections (c), [and] (d), and
5658 (d-1), in each case in which the appointment of an attorney ad
5759 litem, guardian ad litem, or guardian is necessary, a court using a
5860 rotation system shall appoint the person whose name appears first
5961 on the applicable list maintained by the court as required by
6062 Section 37.003.
6163 (d-1) The court may appoint a person included on the
6264 applicable list whose name does not appear first on the list or a
6365 person who meets statutory or other requirements to serve and who is
6466 not included on the list if, within 30 days preceding the date of
6567 appointment, an initial declaration of a state of disaster is made
6668 for the area served by the court.
6769 (g) In this section, "declaration of a state of disaster"
6870 means a declaration made by:
6971 (1) the president of the United States under the
7072 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
7173 U.S.C. Section 5121 et seq.);
7274 (2) the governor under Section 418.014; or
7375 (3) the presiding officer of the governing body of a
7476 political subdivision under Section 418.108.
7577 SECTION 4. This Act takes effect September 1, 2019.
