| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 24.124, Government Code, |
|---|
| 12 | 12 | | is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 24.124. 23RD JUDICIAL DISTRICT ([BRAZORIA,] |
|---|
| 14 | 14 | | MATAGORDA[,] AND WHARTON COUNTIES). |
|---|
| 15 | 15 | | SECTION 2. Sections 24.124(a) and (b), Government Code, are |
|---|
| 16 | 16 | | amended to read as follows: |
|---|
| 17 | 17 | | (a) The 23rd Judicial District is composed of [Brazoria,] |
|---|
| 18 | 18 | | Matagorda[,] and Wharton counties. |
|---|
| 19 | 19 | | (b) The terms of the 23rd District Court begin: |
|---|
| 20 | 20 | | (1) [in Brazoria County on the first Mondays in April |
|---|
| 21 | 21 | | and October, and the terms are designated the April-September and |
|---|
| 22 | 22 | | October-March terms; |
|---|
| 23 | 23 | | [(2)] in Matagorda County on the first Mondays in June |
|---|
| 24 | 24 | | and December, and the terms are designated the June-November and |
|---|
| 25 | 25 | | December-May terms; and |
|---|
| 26 | 26 | | (2) [(3)] in Wharton County on the first Mondays in |
|---|
| 27 | 27 | | July and January, and the terms are designated the July-December |
|---|
| 28 | 28 | | and January-June terms. |

| 29 | 29 | | SECTION 3. Subchapter C, Chapter 24, Government Code, is |
|---|
| 30 | 30 | | amended by adding Section 24.6005 to read as follows: |
|---|
| 31 | 31 | | Sec. 24.6005. 461ST JUDICIAL DISTRICT (BRAZORIA COUNTY). |
|---|
| 32 | 32 | | (a) The 461st Judicial District is composed of Brazoria County. |
|---|
| 33 | 33 | | (b) The 461st District Court shall give preference to family |
|---|
| 34 | 34 | | law matters. |
|---|
| 35 | 35 | | SECTION 4. (a) The local administrative district judge |
|---|
| 36 | 36 | | shall transfer to the 461st District Court all cases from Brazoria |
|---|
| 37 | 37 | | County that are pending in the 23rd District Court on the effective |
|---|
| 38 | 38 | | date of this Act. |
|---|
| 39 | 39 | | (b) When a case is transferred as provided by Subsection (a) |
|---|
| 40 | 40 | | of this section: |
|---|
| 41 | 41 | | (1) all processes, writs, bonds, recognizances, or |
|---|
| 42 | 42 | | other obligations issued from the 23rd District Court are |
|---|
| 43 | 43 | | returnable to the 461st District Court as if originally issued by |
|---|
| 44 | 44 | | that court; and |
|---|
| 45 | 45 | | (2) the obligees on all bonds and recognizances taken |
|---|
| 46 | 46 | | in and for the 23rd District Court and all witnesses summoned to |
|---|
| 47 | 47 | | appear in the 23rd District Court are required to appear before the |
|---|
| 48 | 48 | | 461st District Court as if originally required to appear before |
|---|
| 49 | 49 | | that court. |
|---|
| 50 | 50 | | (c) The 461st Judicial District is created on the effective |
|---|
| 51 | 51 | | date of this Act. |
|---|
| 52 | 52 | | SECTION 5. This Act takes effect September 1, 2019. |
