8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 28.004(c), Education Code, is amended to |
---|
10 | 12 | | read as follows: |
---|
11 | 13 | | (c) The local school health advisory council's duties |
---|
12 | 14 | | include recommending: |
---|
13 | 15 | | (1) the number of hours of instruction to be provided |
---|
14 | 16 | | in health education; |
---|
15 | 17 | | (2) policies, procedures, strategies, and curriculum |
---|
16 | 18 | | appropriate for specific grade levels designed to prevent obesity, |
---|
17 | 19 | | cardiovascular disease, Type 2 diabetes, and mental health concerns |
---|
18 | 20 | | through coordination of: |
---|
19 | 21 | | (A) health education; |
---|
20 | 22 | | (B) physical education and physical activity; |
---|
21 | 23 | | (C) nutrition services; |
---|
22 | 24 | | (D) parental involvement; |
---|
23 | 25 | | (E) instruction to prevent the use of |
---|
24 | 26 | | e-cigarettes, as defined by Section 161.081, Health and Safety |
---|
25 | 27 | | Code, and tobacco; |
---|
26 | 28 | | (F) school health services; |
---|
27 | 29 | | (G) counseling and guidance services; |
---|
28 | 30 | | (H) a safe and healthy school environment; and |
---|
29 | 31 | | (I) school employee wellness; |
---|
30 | 32 | | (3) appropriate grade levels and methods of |
---|
31 | 33 | | instruction for human sexuality instruction; |
---|
32 | 34 | | (4) strategies for integrating the curriculum |
---|
33 | 35 | | components specified by Subdivision (2) with the following elements |
---|
34 | 36 | | in a coordinated school health program for the district: |
---|
35 | 37 | | (A) school health services; |
---|
36 | 38 | | (B) counseling and guidance services; |
---|
37 | 39 | | (C) a safe and healthy school environment; and |
---|
38 | 40 | | (D) school employee wellness; [and] |
---|
39 | 41 | | (5) if feasible, joint use agreements or strategies |
---|
40 | 42 | | for collaboration between the school district and community |
---|
41 | 43 | | organizations or agencies; and |
---|
42 | 44 | | (6) appropriate grade levels and curriculum for |
---|
43 | 45 | | instruction regarding opioid addiction and abuse and methods of |
---|
44 | 46 | | administering an opioid antagonist, as defined by Section 483.101, |
---|
45 | 47 | | Health and Safety Code. |
---|
46 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
---|
47 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 52 | | Act takes effect September 1, 2019. |
