46 AN ACT
57 relating to recommendations by local school health advisory
68 councils regarding opioid addiction and abuse education in public
79 schools.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 28.004(c), Education Code, is amended to
1012 read as follows:
1113 (c) The local school health advisory council's duties
1214 include recommending:
1315 (1) the number of hours of instruction to be provided
1416 in health education;
1517 (2) policies, procedures, strategies, and curriculum
1618 appropriate for specific grade levels designed to prevent obesity,
1719 cardiovascular disease, Type 2 diabetes, and mental health concerns
1820 through coordination of:
1921 (A) health education;
2022 (B) physical education and physical activity;
2123 (C) nutrition services;
2224 (D) parental involvement;
2325 (E) instruction to prevent the use of
2426 e-cigarettes, as defined by Section 161.081, Health and Safety
2527 Code, and tobacco;
2628 (F) school health services;
2729 (G) counseling and guidance services;
2830 (H) a safe and healthy school environment; and
2931 (I) school employee wellness;
3032 (3) appropriate grade levels and methods of
3133 instruction for human sexuality instruction;
3234 (4) strategies for integrating the curriculum
3335 components specified by Subdivision (2) with the following elements
3436 in a coordinated school health program for the district:
3537 (A) school health services;
3638 (B) counseling and guidance services;
3739 (C) a safe and healthy school environment; and
3840 (D) school employee wellness; [and]
3941 (5) if feasible, joint use agreements or strategies
4042 for collaboration between the school district and community
4143 organizations or agencies; and
4244 (6) appropriate grade levels and curriculum for
4345 instruction regarding opioid addiction and abuse and methods of
4446 administering an opioid antagonist, as defined by Section 483.101,
4547 Health and Safety Code.
4648 SECTION 2. This Act takes effect immediately if it receives
4749 a vote of two-thirds of all the members elected to each house, as
4850 provided by Section 39, Article III, Texas Constitution. If this
4951 Act does not receive the vote necessary for immediate effect, this
5052 Act takes effect September 1, 2019.
