5	10		AN ACT
6	11		relating to the authority of general-law municipalities to impose
7	12		term limits on the members of their governing bodies.
8	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	14		SECTION 1. Subchapter A, Chapter 21, Local Government Code,
10	15		is amended by adding Section 21.006 to read as follows:
11	16		Sec. 21.006. TERM LIMITS FOR GOVERNING BODY OF GENERAL-LAW
12	17		MUNICIPALITY. (a) In this section:
13	18		(1) "Governing body" includes the presiding officer of
14	19		the governing body.
15	20		(2) "Municipal term limit" means a limit on the number
16	21		of terms of service a member of the governing body of a municipality
17	22		may serve on the governing body.
18	23		(b) The governing body of a general-law municipality may
19	24		order an election to impose, amend, or repeal municipal term
20	25		limits.
21	26		(c) The ballot at an election for imposing municipal term
22	27		limits must be printed to permit voting for or against the
23	28		proposition: "Imposing term limits consisting of (insert number of
24	29		terms and length of terms) on a person's service on the governing
25	30		body of (insert name of municipality)." If a majority of the votes
26	31		received at the election favor the proposition, the number of terms
27	32		a person may serve on the governing body is limited as provided in
28	33		the proposition.
29	34		(d) The ballot at an election for amending municipal term
30	35		limits must be printed to permit voting for or against the
31	36		proposition: "Amending term limits to (insert "increase" or
32	37		"decrease") the number of terms a person may serve on the governing
33	38		body of (insert name of municipality) by providing for term limits
34	39		consisting of (insert number of terms and length of terms) on the
35	40		person's service on the governing body." If a majority of the votes
36	41		received at the election favor the proposition, the number of terms
37	42		a person may serve on the governing body is limited as amended.
38	43		(e) The ballot at an election for repealing municipal term
39	44		limits must be printed to permit voting for or against the
40	45		proposition: "Repealing term limits for a person's service on the
41	46		governing body of (insert name of municipality)." If a majority of
42	47		the votes received at the election favor the proposition, the
43	48		municipal term limits are repealed.
44	49		(f) If less than a majority of the votes received at an
45	50		election under Subsection (d) or (e) favor the applicable
46	51		proposition, municipal term limits that existed before the election
47	52		are not affected.
48	53		(g) A municipal term limit imposed or amended by an election
49	54		held under this section does not apply to a term that a member of the
50	55		governing body is serving or was elected or appointed to serve on or
51	56		before the date the election was held.
52	57		SECTION 2. This Act takes effect immediately if it receives
53	58		a vote of two-thirds of all the members elected to each house, as
54	59		provided by Section 39, Article III, Texas Constitution. If this
55	60		Act does not receive the vote necessary for immediate effect, this
56	61		Act takes effect September 1, 2019.
