66 AN ACT
77 relating to training requirements for a member of the board of
88 trustees and the superintendent of an independent school district
99 regarding sexual abuse, human trafficking, and other maltreatment
1010 of children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.159, Education Code, is amended by
1313 amending Subsection (c) and adding Subsections (c-1), (c-2), and
1414 (e) to read as follows:
1515 (c) The State Board of Education shall require a trustee to
1616 complete every two years at least:
1717 (1) three hours of training [every two years] on
1818 evaluating student academic performance; and
1919 (2) one hour of training on identifying and reporting
2020 potential victims of sexual abuse, human trafficking, and other
2121 maltreatment of children.
2222 (c-1) The training required by Subsection (c)(1) must be
2323 research-based and designed to support the oversight role of the
2424 board of trustees under Section 11.1515.
2525 (c-2) A candidate for trustee may complete the training
2626 required by Subsection (c) up to one year before the candidate is
2727 elected. A new trustee shall complete the training within 120 days
2828 after the date of the trustee's election or appointment. A
2929 returning trustee shall complete the training by the second
3030 anniversary of the completion of the trustee's previous training.
3131 (e) For purposes of this section, "other maltreatment" has
3232 the meaning assigned by Section 42.002, Human Resources Code.
3333 SECTION 2. Section 21.054, Education Code, is amended by
3434 adding Subsection (h) to read as follows:
3535 (h) Continuing education requirements for a superintendent
3636 must include at least 2-1/2 hours of training every five years on
3737 identifying and reporting potential victims of sexual abuse, human
3838 trafficking, and other maltreatment of children. For purposes of
3939 this subsection, "other maltreatment" has the meaning assigned by
4040 Section 42.002, Human Resources Code.
4141 SECTION 3. A superintendent subject to continuing education
4242 requirements immediately before the effective date of this Act is
4343 not required to comply with the continuing education requirements
4444 described by Section 21.054(h), Education Code, as added by this
4545 Act, for any continuing education requirements period that ends
4646 before January 1, 2021.
4747 SECTION 4. This Act takes effect September 1, 2019.
