| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 707.017, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 707.017. REGISTRATION OR TRANSFER OF TITLE AFTER |
|---|
| 13 | 13 | | NOTICE OF VIOLATION ISSUED [ENFORCEMENT]. (a) Neither the [If the |
|---|
| 14 | 14 | | owner of a motor vehicle is delinquent in the payment of a civil |
|---|
| 15 | 15 | | penalty imposed under this chapter, the] county assessor-collector |
|---|
| 16 | 16 | | nor [or] the Texas Department of Motor Vehicles may refuse to |
|---|
| 17 | 17 | | transfer the title of or register a motor vehicle alleged to have |
|---|
| 18 | 18 | | been involved in a [the] violation of this chapter solely: |
|---|
| 19 | 19 | | (1) based on the alleged violation; or |
|---|
| 20 | 20 | | (2) because the owner of the motor vehicle is |
|---|
| 21 | 21 | | delinquent in the payment of a civil penalty imposed under this |
|---|
| 22 | 22 | | chapter. |
|---|
| 23 | 23 | | (b) A local authority or the person with which the local |
|---|
| 24 | 24 | | authority contracts for the administration and enforcement of a |
|---|
| 25 | 25 | | photographic traffic signal enforcement system may not provide |
|---|
| 26 | 26 | | information about a violation of this chapter to a person |
|---|
| 27 | 27 | | authorized to register or issue a title for a vehicle under Chapter |
|---|
| 28 | 28 | | 501, 502, or 520. [This section does not apply to the registration |
|---|
| 29 | 29 | | of a motor vehicle under Section 501.0234.] |
|---|
| 30 | 30 | | SECTION 2. Section 707.019(a), Transportation Code, is |
|---|
| 31 | 31 | | amended to read as follows: |
|---|
| 32 | 32 | | (a) If the owner of the motor vehicle fails to timely pay the |
|---|
| 33 | 33 | | amount of the civil penalty imposed against the owner: |
|---|
| 34 | 34 | | (1) an arrest warrant may not be issued for the owner; |
|---|
| 35 | 35 | | [and] |
|---|
| 36 | 36 | | (2) the imposition of the civil penalty may not be |
|---|
| 37 | 37 | | recorded on the owner's driving record; and |
|---|
| 38 | 38 | | (3) the failure to pay the civil penalty may not be |
|---|
| 39 | 39 | | reported to a consumer reporting agency, as defined by Section |
|---|
| 40 | 40 | | 20.01, Business & Commerce Code. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2019. |
