55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain consequences arising from a violation detected
88 by a photographic traffic signal enforcement system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 707.017, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 707.017. REGISTRATION OR TRANSFER OF TITLE AFTER
1313 NOTICE OF VIOLATION ISSUED [ENFORCEMENT]. (a) Neither the [If the
1414 owner of a motor vehicle is delinquent in the payment of a civil
1515 penalty imposed under this chapter, the] county assessor-collector
1616 nor [or] the Texas Department of Motor Vehicles may refuse to
1717 transfer the title of or register a motor vehicle alleged to have
1818 been involved in a [the] violation of this chapter solely:
1919 (1) based on the alleged violation; or
2020 (2) because the owner of the motor vehicle is
2121 delinquent in the payment of a civil penalty imposed under this
2222 chapter.
2323 (b) A local authority or the person with which the local
2424 authority contracts for the administration and enforcement of a
2525 photographic traffic signal enforcement system may not provide
2626 information about a violation of this chapter to a person
2727 authorized to register or issue a title for a vehicle under Chapter
2828 501, 502, or 520. [This section does not apply to the registration
2929 of a motor vehicle under Section 501.0234.]
3030 SECTION 2. Section 707.019(a), Transportation Code, is
3131 amended to read as follows:
3232 (a) If the owner of the motor vehicle fails to timely pay the
3333 amount of the civil penalty imposed against the owner:
3434 (1) an arrest warrant may not be issued for the owner;
3535 [and]
3636 (2) the imposition of the civil penalty may not be
3737 recorded on the owner's driving record; and
3838 (3) the failure to pay the civil penalty may not be
3939 reported to a consumer reporting agency, as defined by Section
4040 20.01, Business & Commerce Code.
4141 SECTION 3. This Act takes effect September 1, 2019.
